  1. Ok So we received a RFE after many months waiting for my wifes ROC to be approved

    So They are asking for Tax forms with W2's

    Will IRS transcripts surfice for this request? Will I need to also send the wage and Income transcript for them to accept the IRS transscripts?

    I assume the wage transcripts will be in my wifes name and they will need those because under my account her information does not show up, is this sound correct?

    I sent the tax documents but didnt send any W2's I dont recall that being one of the items on the list so they didnt accept that set of docs

    They are also asking for more months of Bank Statements which I sent one copy but apparently not enough. So How many should I send?

    They also ask for Child birth certificates etc to which we dont have as I cant have more so we do not have any together

    Our home is not in both names as I had dificulty with the mortgage company so that does not exist and we dont have any utilities in both or her name

    I worked up an Affidavit for a few friends to fill out and sign and will send those in with the Request.

    What else can we send?

    If that's the link you're referring to, it's 1. not new, at all; 2. to check your status at NVC, although it's rarely updated and pretty unreliable; and 3. not used to create appointments. I don't know where you drew those conclusions from, but whoever gave you that info would be wrong.

    first off thanks for the consendending remarks, 2nd it is new to me because it has been quite some time since my wife has has gone through the visa process, and I fround a refernce to a page stating that they were implementing a new process http://bogota.usembassy.gov/pr_sept27_2011.html and it was the only page I had found that seemed to be where you could find you appt. at the time. The old page/pdf is not avaliable but after much research i found how they get the appt and where to set it up etc

    you should answer no. You usually won't have to revoke this unless you will go back and do a tax ammendment for last year. That is very rare.

  4. Last year we filed the forms 2555-S I think to exclude my wife's foreign income which was really nothing but anyway, This year (using turbo Tax ) I imported last years info and it pulls in the forms 2555-S. On the error check it asked me to review this form and check this question.

    6c Have you ever revoked either of the exclusions? yes or no

    My question is do we need to revoke this foreign income exclusion at some point. She had no foreign income last year as she finally started working here in the states and we have W2's for her earned income for 2012

    I'm not sure how to answer this question.

  6. We are not in the your boat, but our has been out for over six months and we have not heard anything either.

    I called today to put in a service request and guess what?

    They were having technical difficulties, so please call back in a few hours.Now I get to go back through the same mess all over again and see if the next person is able to put in a service request or not because of technical difficulties.

    I work in IT and this is a bunch of BS the government not having systems available or redundant systems. If not where is all of our tax dollars going?

    I think I need to ask for a tier II officer, forgot to do that when I was on the Phone, but will do on the next call.

  7. Well you wont believe this... WE WERE APPROVED TODAY!!!! :dance:

    We got the email saying that they are starting production on our green card :)

    I'm telling you... I'm pretty sure the congressmen are the answer. I had contacted mine just yesterday and faxed them all of our info and they called USCIS today, and we got the email today. They helped us out with the I-129 too. I don't know if it was coincidence or they were able to push it though since I haven't talked to them since yesterday. But if you haven't contacted your congressman, I HIGHLY suggest it!

    And yeah I think you're right about the employment based from out of the U.S. one being 60 months, not family based. I must have read it wrong or selected the wrong option or something.

    Congrats on your approval, I saw this a week ago but have been too busy to log in, Our package was received and the check cashed now just waiting for the NOA

  8. When you file forms I-485, I-131 and I-765 together, there is only one fee -- $1,070.

    "Please note that, if you file Form I-485 to adjust your status as a permanent resident on or after July 30, 2007, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131."

    you just have to pay $1070 for the 3 forms. AOS, EAD, AP

    $985 for the form I-485 and $85 for the biometrics

    Total of $1070

  9. I did do a new guide for 2011 tax year in this forum. Is that the one you used?

    So how are you submitting your statement if you e-filed? The IRS told me last week people who do the election for their non-resident alien spouse to be treated as a resident alien for taxes should paper file.

    No I didn't follow your guide. I did use your info here as to where the information gets put into the forms. I went back to TT and found the section in the guided section and there I answered the questions as asked and then submitted and it was accepted. Checking the forms it has form 2555 for my spouse filled out and so far it has been ok

    the main thing was when you go though the guided tour it does not ask you the questions for foreign income but there is a section in the guide where you can select that section for Foreign Income and then I just followed the questions it was lengthy but not too bad.

  10. Well I gave it a shot, filled out everything using the guide and it guided me through all the questions and forms, I answered them and filed electronicly and it was accepted electronicly. So looks like TT has the gude working but you do have to get the right step before it takes you through the right guide section to add the forigen income

  11. We did this in 2008 when my husband came on a K1. We filed a paper return that year after preparing it on TurboTax (desktop edition). There is no requirement to mail any official documentation to the IRS like you would do with a copy of your W2. We came up with the best guess of his income based on what he knew his salary was. I made notes to keep for our records. If there was a great fluctuation in exchange rates, you can calculate the US$ equivilent based on what it was when the money was earned. The US Treasury keeps a report of what they consider the quarterly exchange rates here http://www.fms.treas.gov/intn.html . There are also historical exchange rates at oanda.com.

    Anyway, we made detailed notes on income earned and the exchange rate(s) used to calculate the US$ amount, and the source where we got the exchange rates. That was saved in the files in case we ever had to explain it in an audit because we surely wouldn't remember it for long.

    The US value of her income is reported on the same line as your wages, salaries, tips (line 7). It is later excluded by using form 2555EZ. Don't forget the statement where you each elected for her to be treated as a resident alien for tax purposes for the entire year. (Pub. 519, page 10)

    OK this seems simple enough but how do I add her income into line 7 on the 1040? I am using turbo tax. Maybe we have to manually add it to the total income on line 7? or is there a place to break her income out seperately then it gets added into Line 7?

    Taxes is not one of my strong point so bear with me

    Ok so looking at filing jointly, what I need to know is how do we report her foreign income? She did not get any type of Tax Documents from previous employer.

    I did see where you could use a Form 2555ez.

    Is this the correct or best way to report her income and any tips on how to document anything we may need in the event of future audit.

  13. We are calling their office 3 times a day, apparently they have morning afternoon and evening deliveries. I just called Domesa to see if they'd do something else by saying I was calling from the US but it didn't work. All I got was "call tomorrow at 7am to see if it came overnight". Good luck to you!

    Well I just got word she was able to pick up the visa today, now on to get a flight, and might I say the flight prices are way over priced!!!

  14. We're having the same problem, my fiancee's was approved July 14th... Compared to others it is taking longer

    Thanks so I see we were not the only ones I hope yours is in the delivery to Domesa today as ours is supposed to be. I am still waiting to hear from my fiancee tonight to see what she has found out.
