  1. Hello, I have a H1b visa and i came here on it in early 2009 and worked for 4 months and then went back to India. Can i now come back on the same visa since it does not expire until 2012.

  2. If you apply based on 3 years, then they will need to establish some particular things:

    1. Your eligibility (physical presence, continuous residence, good morals, etc...)

    2. Your spouse is a USC and has been for the past 3 years.

    3. You are living together (some evidence)

    i am a divorce waiver so i think it would be 5 years for me. so i am guessing they would only need point 1 for me?

    Yes - save as you go. You need a much smaller list of evidence when (and if) applying for citizenship.

    RFEs come in two ways. Sometimes they are specific and other times they just ask if there are any other things you would like to submit. Sometimes people basically submitted all they can and get an RFE, so they try to get some few more things and then include a cover letter explaining the lack of some specific items. For example, the spouse owned the house before marriage and we never had a mortgage together.

    Interviews are very rare but if requested, they usually like to see originals but make sure you take copies as well if they want to keep.

    They would need evidence for citizenship? why? Wouldn't citizenship be automatic once we are done 5 years on GC? how long does that whole process take?

  4. My cases was touched (last updated is 9/12/2010) but didn't receive any notifications in the email. I updated my address almost 10 days ago, could that be the reason why it is touched or am I going to be receiving something from them?

    Do you mean 8/12? It could be anything, you really cant say anything although you would hope it is something to do with your approval than the address

  5. I-751 Approved.

    8/12/08 conditional GC

    5/3/10 filed I-751, divorce waiver

    5/6/10 uscis received

    7/6/10 fingerprint done

    8/9/10 approved

    We have a child. It seems that uscis holds the application till your conditional GC is about to expire. I did some research, it does apply to many people including me.

  6. 1. There's no way to predict accurately as each case is uniquely different and treated as such. Could take a few weeks to a few months.

    2. Re-read your NOA1 to find out how and when you'll be able to access your case online. :thumbs:

    You cant check the case online with the number on the NOA, you have to wait for the biometrics letter and use that number to check the case online.

  7. i have a quick question. I would like to accept an overseas assignment from my company (top 10 tech firm in US). I am currently on a GC which i got in late 2008.

    I am looking into filing n-470 which would allow me to stay outside US while still preserving my residency for naturalization purposes.

    My question is around the eligibility requirements for n-470 which seem to be two pronged:

    - one year uniterrupted stay in the US as a green card holder. I stayed in the US for one year from may 2009 to may 2010, then travelled outside for 2 weeks and then back in now. does that comlete that requirements?

    - 2.5 years of stay in the US.If i move before i have completed 2.5 years of stay, then can i come back to some point, stay for another couple of months and then apply after accumulating 2.5 yrs.

  9. The whole point is proving to the immigration officer that you entered the marriage with the intention of staying in it and not for the green card. Usually that is proved by showing joint assets and proof of living together. If you dont have those evidences but have a good reason for not having them, you can try t apply with others but you would need something to provide that your marriage was bonafide
