Hi,

I am preparing the N400 online application based on 5 year rule for my parents who have been permanent residents for 11 years.

For some reason when I get to the Evidence page, it lists "Your marriage certificate" as a required evidence. And also it lists birth certificates for me and mine brother as additional evidence needed.

I am wondering why is this being asked for 5 year based applications

My parents were married in 1970's and they only have a marriage certificate the church.

Please let me know what can be done

It was at the federal courthouse in downtown Detroit. And after the ceremony applied for passport at the passport agency right across the street.

I had my N400 interview today morning.

It was eventful before I got to the interview. On the way to the USCIS office we got a flat tire. Talk about timing. My wife who had accompanied me stayed with the car calling roadside assistance. I got taxi to pick me up and take me to the USCIS office.

I barely made it on time. Handed over the letter and the green card. They noted in their system and asked me to wait for the officer to call me.

Before I took a seat I was called in. The officer introduced himself. Very professional and nice guy. He took me inside to the interviewing area where they had all the office rooms.He told me he would be doing the interview and made me take the oath.

He first asked for my Green card, Drivers license and Passport. On his table there was a big bundle of all the documents that I have sent to USCIS.

Once we were seated, he gave me a preview of what steps he was going to do. As the first step he asked me the 6 civic questions which i answered correctly.

After that he asked me to read a sentence. Then write another sentence.

Then he said we will review the N400 application. He went through the application step by step asking me every question ensuring that all the information in the application was right. He didnt ask me any other documents.

After that he made me sign a couple of documents and the front of the photographs I had sent with the application

Once that was done, he said congratulations and that he was recommending me for approval. He said I will have to take the oath ceremony and the next available time slot of oath ceremony I could attend was on Thursday 08/20. I decided to take that day. He said I will have wait outside until my name is called to get the Oath ceremony letter. He then walked me out to the waiting area.

The whole thing lasted about 15 mins.

It took about 45 mins to get the letter. Its scheduled for 08/20/2015 AM.

I received my interview letter yesterday as well. Interview on Aug 17.

Received my In line for Interview notification today. Right around a month before the 5(or 3) year anniversary.

I think you should try to do a walk-in the earliest day possible and explain the situation. They could accommodate you. No harm in trying.

So apparently, my bio notice was sent 6/6/15, but I just got it today. It was scheduled for 6/22, yesterday morning, so now I have to wait on a reschedule.

The last thing you said is correct. When you are placed inline for an interview, it GENERALLY means that you are done with the background check. It means that at some point in the future you will have your interview scheduled. There is no associated letter; just an e-notification.

The next thing is for you to get an e-notification that your interview has been scheduled. There is a letter that accompanies this step.

Some people are placed in line a day after biometrics and then wait months for an interview. Some people wait months to be placed in mine and then have their interview scheduled later the same day. So it's hard to tell. Sometimes (quite often) have a policy of placing applicants in mine exactly 1 month before his 3 or 5 year green card anniversary. But then the interview will take however long the local office will take to scredible the interview.

I say GENERALLY above because some people are placed in line and are even scheduled for an interview but are then told they have to wait until the background check is done. That's a very rare occurrence.

So in short, the in line status doesn't mean much. It just means that there's a chance that your background and it means that your case is progressing and isn't stuck at the bottom of a pile somewhere.

Just curious about the 'In line' status.

What does this notification say? Does anyone have an understanding on the time taken after fingerprinting before it goes to In line?

I have done some checking some of the monthly threads and it seems to vary from a couple of days to more than a month after fingerprinting... with most people getting it with in a few days after FP

Is it the e-notification about the interview being scheduled with the letter expected in the next few days ?

Or is it something that says when you are done with the background check and are waiting for availability at the field office for a interview?

Adding my case

Hello everyone,

I was a conditional perm resident. Unfortunately my marriage ended in divorce. Filed for I-751 waiver which got approved recently and I did receive my 10 year green card.

Now if I am marrying someone in near future who is not a US citizen nor a perm resident, am I eligible to sponsor that person? Is there any wait time before I can file for petitions or some other restrictions?

Can anyone share some light?

You will not be denied because you got divorced in Dec 2011 and didnt apply for ROC waiver right away. But since you are divorced now and since you have not filed for ROC, I think I have heard that as per the law they could terminate your conditional permanent residence status if they find out about the divorce. But as long as it is not terminated your status is valid until the card expires. The chances of someone coming up and checking if you are still married is very remote.....

I would recommend applying for ROC waiver sooner than waiting for the 90 day window...

I myself applied for waiver after 6 months once my divorce was granted. But well before 90 day window...

I'm freaking out now ,please help . I got my divorce decree on december 2011 , I didn't know that i can file for ROC when I got my divorce decree , my CGC expires in February 2013 and i being waiting for my 90 days window , wich start now november 25th >Do you guys think that I will be denied because i didn't apply in december when I got my divorce decree. please Help

It is advised to sent a personal self affidavit briefly explaining to your marriage and events which lead to your divorce. Its purpose should be provide them a picture of what happened in your case. I am not sure how much it will affect the decision to call you for an interview or not. I have seen cases in these forums where people who didnt sent the self affidavit were given an RFE asking for it. So may be its a good idea to send one upfront with your other documents

Sorry to hear about your situation...

you did not say whether you were planning on getting a divorce.

In order to apply for a waiver

One must show

1) That one entered into the marriage in good faith, but that the marriage was terminated in

divorce; and/or

2) That one entered into the marriage on good faith, but the married was terminated due to the

death of the United State Citizen spouse; and/or

3) That one entered into the marriage in good faith, and that one was subjected to physical

battering and/or extreme mental cruelty; and/or

4) That one would suffer extreme hardship if returned to his/her country of origin.

I am not sure if you were subject to physical or mental abuse/battery .. and if so how you can prove that. I have heard this type of waiver applications are scrutinized thoroughly ... without an abuse police report or medical report I think option 3 is far fetched ...

In order to go by option 1, you have to be divorced... You could submit the waiver application before getting the final divorce decree, but USCIS will eventually send an RFE for divorce documents. By that time if you are able to get the final divorce, you can send them.

There are many people who filed a waiver and got approved without an interview. Anyone can be called for an interview - waiver or a non-waiver I-751 filer, but it is not mandatory... It could be just a random pick or may be the processing officer feels like the individual needs to be interviewed.

so yesterday I called USCIS to find out why I haven't got my receipt notice and to make sure they have my address correct. They directed me to the second tier officer lady who said she was not sure why I hadnt received it yet. She said the applicant and the filing attorney are both supposed to get an NOA each. She confirmed my correct address they have on the file and the EAC number from the NOA receipt. Also she told me the CR189 receipt number(the one supposed to be on the Bio Appt notice which can be checked online). She also mentioned that the ASC Bio Appt notice has NOT yet been sent for me and I should wait a couple of weeks more. She said the delay for that could be because of the heavy load at my local ASC.

Later in the evening I open my mail and the surprisingly there is my Bio Appt letter.. Soon an email from my attorney that they too got a bio-appt letter for me. I dont know what to say considering what the USCIS lady told me earlier .. Anyways much glad I got that...

But I still have not received the NOA receipt. Guess waiting game is the only option.

BTW.. Bio appt is on 02/17
