    Her husband is unemployed at the moment and they need joint sponsor. So, he fills out one I-864 as main sponsor and attaches 3 years of tax transcripts, and his dad fills second I-864 as joint sponsor and attaches 3 last years of tax transcripts. Right?

    and it's ok that those tax transcripts are the same, because the filed them together those years(sponsor and joint)?

    That is why I was confused thinking his dad has to file I-864a as household member.

    I have a question for my friend. She is about to file for adjustment of status and has problems with I-864 form.

    Her husband's family owns their business and mom dad and him file taxes together, him being the dependant.

    So, how do they do the I-864 form.

    I understand that he has to file I-864 form alone. Do parents fill I-864a each (household members)? or as joint sponsors.

    Her husband used to live with his parents until they go married not too long ago.

    We are so confused how to do this.

  3. I needed to travel internationally and had an expired passport. So I called my embassy (not british) and they issued me emergency travel document. I sent all the things they asked (2 pics, check, application) overnight and I also included a return envelope. I sent this overnight, they issued me travel document next day and mailed it the next day. I got it in 3-4 days. Probably its not the same for all embassies but similar.

    And, also emergency travel document was only to leave the country, not to come back. So, your husband will probably need to apply for new passport in UK.

  4. Yes, your wife has to fill I-864 as a primary sponsor even if her income is 0. Her dad has to fill another I-864 and check the box where it says joint sponsor. He has to include last 3 years taxes (tax transcripts), and if he meets poverty guidelines there is no need to include assets etc. And her dad needs to include proof of citizenship or permanent residence ( passport, birth certificate or naturalization certificate or if PR , copy of front and back of his green card.)

    I'm a French citizen currently enrolled at a university on a F1 student Visa. My fiance (who is a USC) and I are getting married in a few weeks and we are now starting the process for my AOS (we will obviously submit the forms after being married). I have the following questions concerning the process in general and the forms in particular. I thank you in advance for your help!

    General questions:

    #1: I’m on F1 visa. I don’t think I have an Alien registration number (but I have a SSN). If you think I should have an Alien Registration Number, where can I find it.

    #2: We're getting married in a few weeks and I would like to take my husband name. However my passport, DL, bills, rental agreement, etc are under my maiden name. Which last name should I put on the forms? Is this going to be a problem if my green card is under my new name (husband’s) and my passport, etc are still under my maiden name? Could I make the name change on my passport and Driving license after receiving my green card? or is it better to do it before applying?

    Put your husbands last name. and if you travel you have to carry your mmarriage certificate if your passport name is different. I think you can change it anytime, before or after

    Form-specific questions

    Form I-130:

    #14: Date arrived: should I put the date on my current I-94 (May 2010) or the date I initially enter the country on my F1 visa (August 2006)? the last day you entered the country

    #16: Has your relative ever been under immigration proceedings: What are Immigration proceedings?

    it means have you ever been in immigration court, proceedings can be Removal, Exclusion/Deportation, Rescission and Judicial Proceedings

    Form I-131:

    #3: Should I put F1 or Pending AOS?

    F-1

    Form I-765:

    #16: Eligibility Category: I’m a F1 student, getting married to a USC. I’m NOT on a K visa. What should my Eligibility Category be?

  6. I have went through the I-130 and I have a few questions. First on question 14-14b section B if I am a citizen of the US because of birth in the US do I put "N/A" on 14 and then on 14 b not select either of the boxes asking if I gained permanent status through marriage? I know you aren't supposed to leave things blank but neither of those apply to me.

    On question 14 section C is asks if my wife is currently in the US and if she arrived as a: visitor, student, stowaway, without inspection, etc....do I just circle one of the options (which would be visitor) or write it out above it?

    When looking at the date the authorized stay expires do I go by the date that is written on the I-94 or by when the visitors visa expired? The visitors visa expired months ago and the I-94 only has the date 8-26-2010 on it.

    On question 19 section C it asks for my relatives address abroad. If she is living in the US with me do I leave it blank?

    On question 20 section C is asks if my relatives native alphabet is other than Roman letters write her name and foreign address in the native alphabet. Would I have her write her name in her native alphabet and leave the foreign address blank since she doesn't have one or should I put none or n/a?

    How is her/his name written in her/his passport?

    On question 22 section C which office are we filing our adjustment of status at if we are living in Kentucky and filing the I-130 and I-485 concurrently?

    On question 2 section D it asks if I have ever filed a petition for this or any other alien. I'm not sure if this counts or not but I did file for a K-1 visa when she was living abroad. When she came to the US we decided that there was no way that we could be apart anymore. After talking with a few lawyers we were told to just let the application for the K-1 visa expire due to abandonment. Is the K-1 visa that I tried to get for her count or would I say that this I-130/I-485 is the first petition. I really don't know how to answer this question.

    I am not sure. but i think, I would put YES and fill date, place and result, ( abandon)

    When looking at the instructions of the I-130 it says that you can file if you are a citizen and your wife is under 21 years old. She is 22. What does that mean?

    I dont know where you found that. I can only see children under 21[/color]Your wives age doensnt matter

    How do you get a certified copy of your birth certificate?

    Just send a copy of your original birth cerificateor you can send copy of your unexpired passport

    How can you show more evidence of a bonafide marriage if my wife doesn't have a social? I've tried to add her to my lease, my bank account and get her a drivers license or any other kind of ID and they say she needs a social to do so. All I have are people who were at the wedding that are willing to write a statement saying that they are witnesses.

    Affidavits from friends/family, pictures. You dont have to include a lot, they will ask for more evidence at the interview, but by then she should get her EAD and SS# and you can add her, and she can get drivers license

    When you feel like you are done with this process and you take a look to see how many questions you have found its astounding. If it wasn't for visa journey and the lawyers I have spoken to I don't know what we would do. Thanks everybody for all the help you've given us. Thank you.

    I'm filling out allthe paperwork and have few questions, maybe somebody can help me!

    To start, I was engagedto my now husband and planned to get married by the end of this year, but I cameto visit him last may (for two weeks), as I always did before… but we were sotired of traveling and saying good bye (for 4 years) that we decided to get marriedin that moment!

    So now I'm in avisitor visa and I'm filling all the paperwork.. so here are my questions:

    * Form I-130:

    Part C, question 17

    "Information aboutyour alien relative" "List husband/wife and all children of your relative"

    Who do I have to listin that part? In the form example they put the USC name. In my case I'm the alien(wife), he is the USC.. what name do I have to put there?

    Question 19

    "Your relative's addressabroad"

    If I'm already in theUnited States, do I have to write down my address abroad (well were I used tolive before coming to USA and getting married?

    Your address aboroad not in the US. I put my abroad address, even though I have been living in US for 9years

    * I-130 package:

    Do I need to submit anoriginal of my marriage certificate? Or just a photocopy?

    What about my birthcertificate? Is it the original + translation or a photocopy + original translation?

    In my country we alsouse the mother's last name, so I had two last names, for example PerezRodriguez … in almost all forms it ask me "Other names used (include Maiden Name)"..I list my second last name (Rodríguez in the example, because my I-94 has thislast name on it… and my last name after marriage is hyphen so I still have my maidenname… What do you guys think?

    yes , its C9 , and its for working aouthorization and its FREE

    I have two passports(my actual non expire one) and an expire one where my visitor USA visa is on…do I have to photocopy biographical page and entry stamps on the old passporttoo? Or just the photocopy of the page where the visitor visa is?

    I am not sure. it wouldnt hurt to include bio page. but for sure they need visa page

    * I'm confuse on how manychecks do I have to send? Is it one for the I-130 form ($365), one for theI-864 ($70), one for the I-485 ($1,010)… and one for the I-765 ($??) That's all?

    2 checks only. One for I130 - $365, and one for I-485 $1010. thats all, you dont need to pay for I-864 and I-765 (fees are waived)
