  1. You do not have to pay medicare and SS if you are F-1, provided you have been in the USA less than 5 years. If you have been in the USA for more than 5 years, you are considered a resident for tax purposes and have to pay it. Of course with the GC, we're all residents now. No more 1040-NR.

I am/was on F-1 too. Do you know if we can still file 1040-NR for the year of 2010 since we have been on F-1 status for at least 6 months?

Also I am currently doing a summer CPT. Should I notify my empoyer that my status has changed and pay the medicare taxes?

  2. We had our interview today. The officer said he approves us but the final decision is up to the supervisor. He took my I-94 but he didn't stamp my passport. He said I should have the conditional green card within 30 days.

It was an easy and short interview. I guess our case was straightforward. We have been together for 3 years, living together in the same apartment for 2 years and we had tons of evidence with us. But he did not bother to see most of it... It was funny when he suddenly stopped the interview, turned to his computer and said that he is approving us.

For anyone wondering, at least in the San Diego Field Office, I was able to bring inside the building a laptop and containers with our lunch.

    Good luck everyone!

  3. I am an early May filer (AOS from F-1 student via marriage to USC) and have not yet received any biometrics letter... My I-485 was lastly touched on 05/07/2010 while the I-130, I-131, and I-765 were lastly touched on 05/19/2010. I called customer service on 06/01/2010 but the only thing they could do was issue a service request.

My biometrics letter was finally sent on 06/01/2010, I guess after the service request I issued on the same day. I received the letter on 06/05/2010 and did a walk-in on 06/07/2010. The guard checked the original appointment date on the letter that was 06/28/2010 and he wouldn't have let me enter if I hadn't have my employment offer letter showing that I will be out of town.

Now is the waiting for the interview... and I hope no RFE in the meantime...

  4. I REALLY wish there was a table option for this. I think I have added everything, but I am guessing I have a lot of work to do re: formatting. On the other hand, we really do seem to be clicking along!

Maybe you should consider using google docs.

I feel bad for the April filers, some of them have not yet seen a biometrics letter. :(

  5. Hi!

I am an F-1 student and I've applied for AOS based on marriage to a USC. I am anxiously waiting for the biometrics appointment... I want to do it by June 11 since from June 14 till the end of the summer I will be in Seattle doing my CPT internship. My I-485 was lastly touched on 05/07/2010 (3 days after my NOA) while my I-130, I-765, and I-131 were lastly touched on 05/19/2010. I wonder if this means that they sent me the biometrics appointment letter on 05/19/2010... Also I noticed that on the I-797C of my I-485 I have an alien number when I never had one. Does anyone know if they automatically assign you one the moment you file I-485?
