    my husbands conditional GC expires in Feb. We are going to file to remove conditions in January.

    I am the USC and we are england right now. we have been here for 90 days, will be here 40 more (4 months).

    I asked before on a forum and was told it was fine to leave for four months, but now someone on another forum said that they might think my husband abandoned his status??!?!?!?!

    is it okay that he will be gone for 4 months?!?!?! will they let him back into the US?!?!?! :help:

    Not without a valid green card.... or Advance Parole....

    Hi, yes, he will have a valid green card...it will have 45 days remaining on it (we will file his removal of conditions upon our return).

    I dont tink my original post was very clear, sorry.

    ive looked at the london embassy site and it appears as long as wel have domicile in the usa then we are fine. and, as i am only here on a semester abroad program, we have proof of that.

    Bear with me....I am very confused! :innocent:

    Okay. My husband (British, came to the US on an 1-130 green card) and I are going to England for 4 months this fall.

    --First of all, I understand he is allowed to leave the US for up to 6 months at a time,and not mess up his US residency, is this correct?

    We will be returning to the US in late December of this year ('07). My husband is on a conditional green card which expires Feb. 16th, 2008.

    ---I think? Is it 2 years from the time he entered the country on his marriage visa (I-555 or something....sorry, it's been a year since i've thought about this stuff)? He entered on Feb. 16th of 2006.

    If this is indeed the case, when we get back into the USA, his green card will only have about 45 days left on it. Is this okay???

    I understand we have to file for removal of conditions within 90 days of the expiration...is it okay to wait until he only has 45 days left, and also importantly, will they let him back into the country?

    I really appreciate any help with this.

    Good luck to EVERYONE with upcomig interview dates....main thing....don't worry....easier said than done, i know.....but from what my husband says, its a breeze and they are very nice people in London....we are lucky to have them as our embassy!

    My husband had his interview in London this morning, and could you please update me on the list to.........APPROVED!!!!! Wow I've been waiting a year to say that!! :dance::dance:

    I am so relieved/happy/exhausted....and I wasn't even at the interview! :D I've been awake nearly all night, though, worrying.....

    My husband said he was in and out of the embassy in London within 2 hours. They didn't ask him ANY questions at all, just took his documents and then called him up again for fingerprints and told him he was approved!

    Thank you SO MUCH to everyone on VJ , you have been so helpful to me over the past year....I don't know how I would have known half of what I do without this site. It really is appreciated.

    I am reunited with my hubby in exactly one week! Im so happy.

  6. The NVC apparently only sent that with the file, and not the actual affivadit we sent them, so the immigration officer didn't even get to see it herself, so she said to just do another one and send it in via their courier and gave him the instructions on how to do that.

    The NVC apparently only sent what with your file? A denial?

    Could you please elaborate on your case so its easier to understand...since this is the first I've heard of an income based denail at London maybe your story will be helpful to others.

    It's very strange that the NVC wouldn't send the Affidavit....I can't quite understand that one?!

    Also, did the embassy just ask you to send back a new I-864 instead of making a new interview apppointment?

    Its fantastic. Good luck with all of your weddings coming up as well (lucky as Im a CR-1 thats all well behind me...although theres something exciting about anticipating your wedding, of course, that i miss!)

    Your taxes don't need to filed until April 15th. If your wife is coming in March I would just wait for her to get here and file then once she has an SSN.

    Unless of course, she doesn't have an SSN by April 15th. But when I spoke to the IRS they told me if my spouse was getting an SSN I may as well wait and do that.

    But apparently its an easy transfer from ITIN to SSN, so if you are in a hurry do it now with the ITIN.
