  1. Hey Guys,

    My wife ( us citizen) and i (Australian citizen) are assembling our I-130 for DCF with the Melbourne embassy, leading to a IR-1.

    My question regards the 6 months or more of legal residence in Australia that my wife must have done for eligibility of DCF.

    We've been married almost 3 years now and lived in Australia. She now has here permanent residency, but getting that visa is a 2 year 2 step process.

    The first 2 years shes called a temporary resident until the 2 year mark when she is granted permanent residency. She has now had here permanent residence for 2 months. Does the US embassy require 6 months of official permanent residency or does the 2 years on the temporary visa suffice ?

    I as because i've seen it worded in undefined terms on official and unofficial web sites and such. so we're confused and a little worried.

    I've been looking for a migration agent in Melbourne or Sydney that has knowledge of the US Immigation System and can help my wife and I with our CR-1 application direct to the consulate.

    After the painful mess it was getting my American wifes AUS visa, we would like to get some pro help with my Visa as the US department is more complex and unforgiving.

    I've been wanting to know.

    My wife (US citizen) and I (Aussie) were married 2 years ago in the US. Straight afterwards we moved back to Australia to live. She has since obtained her Aus spouse visa.

    Now we have decided that we want to move to the US and go to collage. Because we were married in the US does she have to be in the US to file her i-130 petition ? can we apply fo my CR-1 while i'm in the US (on a visa waiver). Aus immigration had a bridging visa for my wife while she was waiting for immigrations decision, does the CR_1 have this allowance or something. We want to avoid waiting another 6-10 months in Aus to move over, and we defianately do not want to spend time apart.

    Does the fact that we have lived in Aus and my wifes spouse visa have any influence on the proceedings ?
