  1. Hey there. I would recommend to try out this 'do it yourself' kit. I paid $50 for it and it pretty much gives you fillable forms, instructions and sample forms already filled out so that you can refer to. This is the website http://www.usavisanow.com/ . They also provide legal services and is the cheapest out there. I did it all by myself and got approved for my greencard TODAY! I mailed out everything on May 28th and USCIS got everything in July 3rd. but my case was that we were already married and i am already in the US.

    Anyway, I would say try to do it yourself first.

    I was wondering if anyone has ever run into my current situation. On May 25th 2010, I have turn in all the paperwork for AOS. Just received notice I797 that paperwork has been received and is going through initial review. Well right after we mailed the paperwork in, my husband's employer has announced that the company has filed for Chapter 11 bankruptcy and by the end of June the company will no longer exist. The company is actually liquidating all assets and my husband is still on payroll working on inventory. He has applied for 6 to 8 jobs in the same field, no luck so far. I am worried that by the time we go to our interview he would be unemployed, what should I do? I am currently on H1B, employed, I am not too worried since my H1B is valid until 2010. However, I would like to get my GC ASAP, dang it I have been in the US for over 10 years! I have been paying so much money on tax, I should just be granted one without question! lol. I have only put his income on the financial support documents since his income is more than qualify, I did not put mine down (lazy and did not want to make it more complicated since I put down my sister and my parents on my tax return as dependents. They live in the US. my sister in school, my parents retired way too early and never worked in the US and they lived with me). Anyway, any idea? anyone?

  3. I am currently on a H1B visa and believe me it cost a lot and it is not easy to get an H1B visa these days with the economy being so bad. I think your boyfriend should start applying for your K1 Visa now, that will allow you guys some time to get things started once you come over to the US. You need to get married legally asap, establish bank accounts, utility accounts together and take lots of pictures with friends and family and the civil ceremony to show a legitimate marriage before you apply for AOS, you will not be able to work with a K1 visa but once he file for AOS for you, he will also need to turn in an application for work permit at the same time. It will take around 2 months to get a work permit while the AOS is in process, that way you can at least work. An H1B visa cost a lot more, and you need to hire a lawyer to do it and you can only work in the field you graduated it, in some case, with the economy these days it is hard to be picky when it comes to a job.

I recently file for AOS because i got married with my Mr. Right and I have been in the US for like 10 years now (started off just going to school here, but eventually getting JOB after i graduate). I mailed my package out on May 25th and today I got all my I797C showing that department of homeland security has reviewed the documents i submitted. Yay!

  4. Hey Haggen Daz. Since you are no longer employed, I am not sure if USCIS will question you for your current status. My lawyer once told me if you are unemployed, your H1B will no longer be valid and you will be out of status and there is no grace period. I am not sure if filing a change of status to B status will be helpful. (B status - visitors visa).

    What you can do is to go to http://www.usavisanow.com They have some do it yourself kit that you can buy, or just use their service (they are the cheapest I can find). I currently hold an H1B, still employed, just turned in my application for AOS with all other forms required. You should really look into the do it yourself kit, it will answer a lot of your question, because they have sample forms. Again, since your case is kind of touchy with your current status, I would advice you to use their immigration service to get your case done to be save.

  5. I think you will have to provide your I94 record on your EAC receipt. I would suggest providing them with a trail of info showing every change of status, meaning from I20 to J status , H status and then the application to adjust to greencard. I am applying for the same thing myself and my case is 90% as yours, only that I went from F1 to OPT and then to H1B, I have not left the country since my F1 status expires. I tried calling USCIS in regards to what eligible category I belongs to and they were not even able to answer me. I am also looking for someone with the experience to answer your my question.
