    I see. What do other people from PA have to say about this. How long is the waiting time for Oath ceremony there ?

    I had biometerics in October and still no change on online status.

    Sorry to hear that. I don't understand, why can't they make it this process more transparent ?

    Until this whole process is over, one cannot even relax.

  2. Im in same Boat , USCIS has 120 to Approve your case and schedule your Oath , I passed my test on November 7 , No updates on online status as of yet

    As far as calling Uscic ONLY LEVEL/TIER 2 OFFICER Can provide you more info , Level one support only can see what you see on USCIS website

    Did you also have interview at Federal Plaza, NY ? My wait is nothing compared to yours, in that case.

    I spoke with a 2nd tier officer. They told me that my case was approved but I have to wait for Oath letter. I can call back in two weeks to get an update if doesn't arrive by then.

    Hopefully, we will both hear good news soon.

    I am a September Filer. I had filed for Citizenship back in April but because I had applied one day too soon, I was denied. Anyways, long story short, I had my interview of Dec 9th at Federal Plaza, NY. The officer told me that I passed the test and she will submit my case for approval. However, I haven't seen any movement in my online case status since the interview. I know in NYC, Oath Ceremonies take place frequently, so, most people are placed in que for Oath ceremony soon after the Interview.

    I am worried if my previous application (Denied) is causing a problem in approval. I also called USCIS service center, but you know they are useless.

  4. I'm sorry about that brother. I can't believe that they wanted to deny your application because of a one day. I'm sorry but that's BS. I hope you do it next time and you get everything quick.

    I know it sucks. But, I guess others can learn from mistake and make sure that they meet all eligibility criteria before applying. Now that we know, not even one day is excused.

  5. Finally I got a call today and officer told me that he will not be able to approve my application so I can either wait for denial or withdraw my application. I chose to withdraw and will have to re-do everything all over. Moral of the story " USCIS would love to take your money twice, its up to you how to prevent that from happening. Read all the rules carefully before you apply."

    Such a disappointment !

  6. The reason they say you can file 90 days before the day is because the process is expected to take at least 90 days. It is expected that at the end of the process you would've been qualified for whatever you are filing for BUT in some cases, the process takes less than 90 days leaving the petitioner in a fix.

    I had exactly the same issue when I filed for citizenship years ago. I concluded the process 3 days early. I could have had my oath ceremony the same day but because I was not yet qualified, they had to send me an invitation for another ceremony. That 3 days early ended up taking about a month before I could do it.

    When my wife qualifies for citizenship, instead of 90 days, we'll file 60 days as the process seems to be getting faster. That way we'll completely avoid this issue.

    So to answer your question, you should not be denied. They should send you an invitation to an oath ceremony AFTER you have met the conditions and qualified for citizenship.

    Thats not the problem. Problem is that I was not married for full 3 years before I applied. It was 2 yrs, 11 months and 30 days. They can only make an exception or I will have to redo everything all over.

  7. It is 3 years of being a green card holder and married to a US citizen for 3 years.

    • Be a permanent resident (green card holder) for at least 3 years immediately preceding the date of filing Form N-400, Application for Naturalization
    • Have been living in marital union with the U.S. citizen spouse, who has been a U.S. citizen during all of such period, during the 3 years immediately preceding the date of filing the application and up until examination on the application

    Now I know. Wish I had known before I applied.

    Define 3 years. 1095 days? 8/1/2010 to 8/1/2013 is 1096 days. Technically there was an extra day in 2012 for leap year, maybe you could leverage that.

    Mine came out to be 1095 days if we exclude last day.

  8. I am so sorry to hear about your situation. Just try to keep in mind that you are dealing with uneducated government workers reading from a job descriptiion and/or a script. Try to remember what it is like, or can be like, dealing with a customer service representative - uneducated people reading from a script. To be honest, don't worry about it as long as you have met all of the requirement for "citizenship." Best of luck!

    Trying to keep a positive attitude. I hope common sense will prevail over them while making this judgement. I may have applied one day earlier, but I was still married to same US citizen at time of interview and thats well over 3 years requirement.

    Isn't the 90 days prior from the point the USCIS get's your paperwork? Or are they going by the date you put on the n 400? If it's USCIS then you're probably good since the NOA is usually 3 or 4 days later. Hope you'll be fine.

    90 day requirement sometimes doesn't overlap your 3 years marriage requirement. I was married for 2 years, 11 months and 30 days instead of 3 complete years. LOL

    Its so hard to do it all over again. In addition, you have to pay $680 all over. Who has that amount of money to throw away.

  9. Not sure they will let it slide as I believe it is a firm requirement to shorten the otherwise five-year residency requirement. We are in the same situation with our three year wedding anniversary falling a day after our three-year less 90-days residency.

    Thats why I am concerned. In the past they have sometimes excused people who applied one day earlier than 90 day window.

    You are in the same boat, meaning you also applied one earlier ???

  10. i pretty sure they will approve it , if visa officer wanted to deny you he could deny you at that time but he didn't that's a good sign ,

    I am hoping that too. He told me that if it were 5-6 days, it would definitely be denied, but "One Day !!!". He told me he has never come across a situation like this before.

    I doubt they'll give you problems... I mean if they really think the date on the application is an issue, they'd return your whole N-400 packet before you even know it.

    If it's in the process of interview and such? You should be fine.

    That's what I was thinking too. If you wanted to reject me, just send the packet when you first received it. After I went through all this, is it fair to Deny me.

  11. Well, there are 2 rules:

    1. You have to be married for 3 years to US citizen before you can apply.

    2. You have to legal permanent resident for 3 years (-90 days) before you can apply.

    I am within the time frame for 2nd rule, but for the first one, I applied 1 day earlier than my 3 rd Marriage Anniversary.

  12. Dear Friends,

    I had my Citizenship interview today. It all went well, until the officer told me there is a small issue with the date I applied. He told me we have to married for exactly 3 years, before we can apply. I applied "1" day sooner. He was like he is not sure, if an exception can be made. He will have to run it by Attorney's before he can tell me if I am okay or will I be denied. He did feel bad about this whole situation and said he will try his best.

    Has anybody else known of a similar situation, where an exception was made ?
