    I'm so sorry to hear all these things that happened to you.Don't ever lose hope and always keep the faith! Just always remember that every challenges that we face in life happens for a reason, and believe that someday, this will make you a better and much stronger person. Look forward to the future and never cease to pray. Believe in your heart that what men meant for evil, but God meant it or good! Jesus will make all things beautiful for us in His perfect time.     [/size]Hi everyone,

    I'm so thankful that I found this forum.. It assures me that I am not the only one going through this painful journey. I got married to My USC abusive husband in March of 2007. We filed I-485/I-130/I131/1765 all in May of 2007. I have not recieved anything since then. My EAD and AP were approved 7 months later due to a "Background check". He started drinking and cheating on me with a stripper "of all people". I was a virgin when I married him. He gave me HPV, which eventually evolved into cervical cancer because of his unfaithful ways. I was brought up into a culture where the man does as he pleases, and us women have to shut up and take the consequenses because no one wants to marry a non virgin who has been "used". I had 3 major operations at 2 different state of the art facilities. He continued accusing me of the adultry stating that I was the dirty ####### that got this disease... I can go on and on about the physical and mental abuse this man has put me through. I continued to be patient because I had in mind that one day this man will change, and that I cannot go back to my country and shame my parents by being a divorcee and having an STD.. No man would ever want to tocuh me again. To top that I had an awful lawyer that wanted nothing but money. I was naive and totally trusted every word he said. I did not do my own research until life with my husband became unbearable. We seperated and I was in desperate need of help. I went to another lawyer just to get another opinion and he beleives that I have a strong case of VAWA. It has been over 3 years that I have not recieved any response from USCIS regarding my case. I had 2 interviews with them already. One back in August 2007 that I attended with him, while the other one in February 2010 that I attended without him. I took my lawyer and we explained the situation to the immigration officer. He was extremely intimidating and rude and my lawyer told him several times to stop interoggating me and using accusing tones with me.

    I had been through so much already "Cancer is not an Easy thing to survive" I filed my I-360 with this new lawyer in April of 2010. I just got my EAD and AP a few days ago.. and Am counting the days for adjucation of my I-360. My heart goes out to all of you. I wish everyone happy approvals. USCIS takes its sweet time while we are all suffering with different scenarios and stories.. Mya God be with all of you throught your journies...

    Below was a response I would like to share to you. I was also planning to do my self petition solo from last time. I got this response from Langa, and she advised me that If I can read and write- I can do this on your own. I find that very encouraging. I have no luck with lawyers and always getting ripped-off, so I did gathered all the requirements and evidences that I needed to present myself petition on my own.I just mailed my self-petition just 2 days ago so I can't say much of the progress yet. I couldn't afford to pay for all the filing fees so I also wrote a fee waiver. You have to do some research on all the requirements and evidences before doing it yoursel. There are more than this to present and one of these are your strong letter of declaration about the abuse, statements from witness, pictures, all utility bills etc. in both your names,any kind of documents where you both lived together. If you feel more comfortable with assistance, I think it would be better for you to make an appointment in womens shelter n your county,and ask for immigration advocate that handles a VAWA (Violence Against Women Act)cases.They can all do this for you with no charge.

    You seem to have a strong case esp. you have a child with the abuser. I pray and hope that all things work out for you.Take care now and keep the faith. Never lose hope!

    I'm new here and I'm just about to start to file for a VAWA case for myself. Could anyone advise me if I have to hire a lawyer for this. I prefered not because I couldn't afford it. Has anyone experienced of filing their case by doing it themselves and without a lawyer?

    Please help. I will highly appreciate all advises.

    Hi, you can do this on your own believe me you can. As long as you can read and write you can. The burden of proof is on you. I filed in 2005 and I was approved and I did everything all on my own. The lawyers tried to tell me my case was a difficult one and they also wanted me to pay alot of money but I prayed about it and decided to do it on my own. My case had a child involved and I had intitially filed as married to a USC and had to change everything in the middle of my ex-husband's petition because of the abuse. It was alot but I did it and so can you!! Please email me anytime if there any information I can help with.

    For the past month I have been checking my mailbox twice, sometimes 3 times, a day. My mailbox is located about 2 miles from my place. Last week I made a decision to stop.     Lostinnj, you need to write a letter. Stop with the phone calls. Write a letter along these lines:

    I filed a VAWA Self-Petition (I-360), which was received on Feb 07 2007 and granted Prima Facie on Feb xx 2007. More than 15 months has elapsed and no determination has been made on this case. I am hereby requesting that your office adjudicate my I-360 as soon as possible.

    yes i did.. its kust to tell you what your current status is: deferred action and that uscis wont start removal proceedings yet so you should file for aos asap

    Hi! On your vawa application , what exactly do mean by "IO had to "research" for more info, why do i kno the law more than an immigration officer?

    It just caught my attention because I want to know what you did as it shows the same date and day you were approved of your greencard.

  5. Thanks Kwala for the advise. I'm going to see a representavive from a Catholic Charities who deals with Immigration matters. I cannot afford a private lawyer I 'm totally broke! I hope with everyone's experiences and by helping one another here without judging we all make it either way.

    I SO highly appreciate your attention to my message! Thank you so much for your advice. I'm in the middle of divorce from my abusive husband and an immigration lawyer adviced me that I cannot apply for self petition (Vawa) if the divorce is not yet final, so wait. My soon to be ex (can't wait) abuser husband is doing all kinds of delay tactics knowing we have no children or property to fight for ,yet the divorce is taking now almost 9 months. He filed for my petition on Nov.2009 but abandoned the case in the middle of it and threathened to deport me and became very abusive. I finally got a restraining order against him and now out of the relationship. Thank God! In my heart, I believe that I can do this, like you said, since I also have all the evidences needed in this case. But acccording to the immigration lawyer I couldn't file for VAWA bec the divorce is not yer final. By waiting in this divorce case, I ran out of money. I'm in my dire situation. I'm so much behind my rent. I'm not working because couldn't work until I have of course the work permit. Just trying so hard to get by day by day. I couldn;t afford a lawyer.

    I'm taking your advice and started gathering all my paperworks, read the instructions fr. USCIS.gov website, and did more research online and some idea I got fr. this site on how to file the case myself. Before I finalize and submit everything to USCIS VT, I would want to go to the Catholic Charities and perhaps they could assist me with my filing.I'm sure this will encourage me as well and never to lose my hope. It's about time to file this myself and not be misled by other lawyers who are just money hunger and taking advantage of people's vulnerability.
