  1. We made a whole Powerpoint Presentation explaining our story. And included tons of messages. I dont know about other cases but our got aprooved fairly soon. You can check out my timeline. Ok I know all the "be patient, you know that is the game, we had it way worse than you" comments, because I know I am just winning and I should wait (most of you are real troopers which unfortunately I am not:( ). I am in the dark of what now, that is why I am posting this topic. My accurate timeline is this:

    - December 26th petition for permanent residence ( I-485) + petition for employment authorization ( I-765) were received by the USCIS.

    - January 3rd, - they sent me notice of action on both cases, official acknowledgement of them receiving my application ( both of them)

    - January 5th - Biometrics appointment was sent to me for the EAD

    - January 20th - RFE for I-485 ( tax records required, employment verification for the affidavit of support)

    - January 26th - Biometrics done in Seattle USCIS office in Tukwilla

    - February 26th - RFE sent ( finally we got all the docs needed)

    - March 1st - Called the uscis, they put a wrong service request (non-deliverance of EAD)

    - March 3rd - USCIS acknowledgement of received Response to RFE, I-485 updated ( we will notify you in 60 days about our decision.

    - March 7th - Email received regarding the service request of ( non delivery of employment authorization card(On 3-3-11 we received your response to our request for additional evidence on your I-485 therefore, the processing has resumed on your pending applications.)

    - March 10th - called the USCIS, they explained to me that one of their agents put in the wrong service request and when within 75-90 day approaching the 90 days, they can put a new service request so I can get some info on my EAD (since it has not been touched since January 5th)I was also told, that regardless of request for evidence, if a response was received by the uscis, I am entitled in a decision.

    - March 16th - (10 days before 90 days expire) put in the right service request ( approaching regulatory time frame) for EAD. I was told the I am gonna get a response within a week from the USCIS by mail or e-mail.

    -March 18th - update on my I-485, ANOTHER RFE.

    -March 21 - RFE received, sent back the same day ( another tax form )

    -March 21 - letter was sent on this day to me regarding my service request ( the right one ) saying : Our records indicate that we are awaiting for your response to RFE, your case is currently on suspense or on hold until we receive that response. and they sent me a copy of the RFE notice.

    -March 25th - USCIS acknowledged the response to RFE

    -March 25th - I received the fore mention letter regarding the service request.

    - March 26th - 90 days are done.

    - March 27th - Calling the uscis to see what does it mean, is my service request still valid, should I put in another on. The agent couldn't understand that I had RFE on I-485, but it put my service request on I-765 on hold. they couldn't do anything about it, and I have to wait 31 days to put in another service request. That is April 17th. They advised INFO-PASS appointment, but they weren't sure if the local office can help.

    - Today - Called the uscis, they explained the answer I got on my service request is final ( I wont get anymore updates on that? ) and the status is as in the letter I received a week ago, and I am not eligible for another service request.

    Now I dont know what to do, and most of all is just more and more torture. No one can tell me the status of my case, the agents of the USCIS are changing their story, apparently I need to subtract the days when my case was on hold, and if I dont hear anything after that I should go to the USCIS local office, which by the agent's story would not help me too much ( cause my case is being processed by the National Benefits center, not a local office. I am suppose to be eligible about an interim EAD, after the subtracted days pass and I dont have any response. However they cannot issue me an

    interim EAD, but they can help me with it.

    Tell me, do infopass anointments help? Should I have one? What should i do?

    I have been in the states for almost 7 months now, without a job, without a life, I am becoming passive and depressed, losing all my friends, every day I run to the mailbox and open my email 5 times a day, to hear any news. I have been even applying for jobs ( lying that I have the EAD, and I had to refuse some offers since i cant legaly work. My husband is caring, patient and loving but all the burden of providing from rent to bills and food is on him. This whole process has taken a toll on me, and I just want to be done with it. Please share your opinions,advices and comments. I can use some info now, cuz I feel blind def and mute at this point. Suggestions?

  3. you should probably wait. Did you got an NOA1? or you have just sent it? you shouldn't really panic about it...its already sent. If you dont have a case number,there is no way for them to know for which case are you sending additional documents (unless required by them.). I have had the unfortunate case of getting RFE for my AOS and they specifically say "sent only what you are asked for" and give us some time to process it.

  4. You are suppose to get a response within a week. Thats what happen with 2 of my service request. The invoice number aparently doesnt do you much good unless you dont hear from the VSC within 31 days, and then you can call and give the agent the invoice number so they tell you the status of your case. That is what happen to me. Unfortunately I got a RFE in a mean time so it did not help me much. But if you do not have RFE you should get a response of your SR within a week, especially if is : approaching regulatory time frame request. hope this helped you.

  6. You might get an NVC notice that they received your application and forward it to your embassy, you might get and RFE from NVC ( Ireally hope you dont), or your case might be directed to the embassy, it really is different for every case.

    check your embassy website. after I got an NOA2, I wrote my embassy right away for additional instructions. It depends on the country about how long should you expect a packet 3 to arrive. IN my country for example, we have the packet 3/ packet 4/ sent together.

    it means if you dont here anything about your case till then, you need to call the uscis, cause for the interview @the embassy you need a valid NOA2 and yours expires on 24th of June. so it is expected that you are gonna have your interview scheduled within that time frame.

  7. I really think this should be in the dictionary of immigration cuz I had the same question long time ago. "Touches" are the actual updates on your case file once you sign up for an account on the USCIS website and add the case receipt number (: for K1 is the WAC43636936 sth numbers we get, for AOs is the MSCXXXXXXXXx numbers we get etc )to your "portfolio". After you first register, its gonna give you the initial update date on your case, like when did they received the application, and you can check periodically if the date from when your file was last reviewed ( it updates automatically, whenever they review your case) had changed.

    This DOES NOT mean that your case its approved, its just means that someone touched it, like actually reviewed your case for something.

  8. Here is a list of things to do, The Santamarias:

    - Before I ever got the NOA2 I tried to stay on top of my game, like RESEARCH : What kind of documents you might need for the embassy interview, cuz for me after NOA2 everything started moving quickly, so you would wanna know what kind of documents should your fiance send you,

    - look into how long it takes to get a police certificate, birth certificate etc ( documents you might need for an actual in interview in your embassy)

    - the thing about talking online its not about staying together all the time, but it helps just hanging out online before bed ( So many times I have fallen asleep in front of my laptop) facebook games, skype games ( bowling:D ) anything that you would do normaly just do it while you are both online:D its more fun anyways.

    - write him a little good morning message, keep it as a practice it make his and your day better. and after that you dont have to be online and on the phone talking so much. when I was looking through the hundreds of pages of messages sent withhin year and a half between us, it was amazing of what kind of written words we have used, phrases that we would never say in our normal lives.

    - if you have a wedding to look forward to, grab the opportunity. You will be able to celebrate the happiest day of your life, with your family and friends sooner than 90 percent of the people that went through the immmigration process like you guys did

    - talk to your parents more, I started cooking this summer before I came to the US. My mom realized that I am gonna be married and all and she wanted me to know how to make a few dishes that she always made for me. I wish I have learned more.

    - If you plan to move together with your fiance, you should look up houses in that area, just have fun.

    - Do you wanna drive in the US ? See whats up. How to get your lisence, ask him to send you a driving guide from his state, so when you come over and have your ssn you can go to the dmv and get your learners permit.

    there is so much more stuff that when we are alone and apart and suffering we dont really think about, ways to be productive and happy. Its not gonna be like your better half is there, but at least it gives you the oportunity to decide what do you wanna do with your life. And not to forget:

    This next couple of months, are your last months being single!!! Go out have fun! You deserve it after so much waiting and stress!!!

  9. Question for all you who got their green cards: After that you went to get your SSN right? Well what if I already have an SSN with my married name on it? Should I go and get a new one, or just update my status with the social security office?

    Oh. GONgrats To your learners permits/driving lisences! I have had mine for a while but I do not know how to drive AT all :( I feel sorry for everyone that its gonna be driving w me:D

  10. The agent said that its gonna do a service request because I have no info since NOA1 about my EAD. Its not paused they say, and its not being processed at all, its just at initial review , and in my file says its not on hold, so it is about time I hear anything. My Evidence were actually delivered on monday feb 28th, so I know they got them, but I have no confirmation, none so ever from the uscis yet.

  11. Stay positive, look into what you need to do, stay busy. Thats what I did. Take care of all of your documents prior leaving to the states. If you wanna be with your love sooner, you will REALIZE that the time difference doesnt matter, Just see Barbara here ( 16 hours difference? ) and I was 8 hours difference with my now hubby. But things are gonna get better, You cant stop believing that. Yes it will take a long time. Even after you marry, its gonna be horrible for the waiting period ( I have been in the States for 5 months without working) and the frustration that it brings. I still know that one day its all gonna be ok. And an advice, is to spend more time with your family and friends there, because you are gonna miss them dearly for a while before you get your AP/GCard. I wish, I had taken the initiative to spend some time with friends and family from my country that I dont see often:D You think about it later and you see there are so many things that you could have done, while home, which now in the US you cant:D:D:D

Because the RFE needed some documents that we needed time to gather, (tax transcripts for 2010, employment verification letter) I was really worried about it, and thats why I called to make sure it does not effect my EAD, and they said it doesnt so I was pretty relaxed about that cause I already have my SSN, so I wasnt in a real hurry about the GCard, I just wanted to make everything right, you know. After how long did you received news, they said I should wait 15-30 days...FOr what? is this like an official notice to the case assigned officer to remind him/her to review and update my case? I just dont wanna find out that i have created problems for myself when I shouldnt have. Spasiba, for the info, Nadia.

  13. Hello. First of all, check out my timeline, and see.: ( I entered the country on a fiance visa, got married and I know all the expected timelines, but I am stubborn and I wanna know more. I applied for AOS/EAD after that:D)

    December 26th 2010 - Applied for AOS/EAD

    January 5 2011 - NOA1 paper, received in the mail for both EAD/AOS

    January 10th or so (5th on the document) - Biometrics notice Received in mail

    BIOMETRICS scheduled ( and done ) - January 26th

    BUt...

    Got an RFE for AOS- Sent Jan 20th, received January 24th

    Called and called and cALLED the USCIS, till triple checking that the RFE is for the AOS only and DOES NOT affect my ead.

    Send RFE response - Feb 26th

    Called and called and called the USCIS on account that my EAD case hasn't been touched since Jan 5th, when my biometrics notice was sent, and today, one of the representatives, said they are gonna sent a REFERRAL NOTICE to the uscis about my case and gave me a case number, since it has almost been 60 days from when I got the last notification. They said the referral is to update my case.

    I dont know what a referral number is? Can anyone tell me what will that do to my case. Ask for additional info from me I am glad to provide it. I am just frustrated of sitting on my butt every day for the last 5 months since I have been in the country, thats all. Thanks so much:D

  14. Congrats to all the filers that got their green card. I was on a job fair yesterday, it was fun. A lot of opportunities and stuff. But I dont have my EAD, and I sent my RFE finally last Saturday. On the USPS tracking says it got their on 4:30 on monday, but still not a word from the uscis. I am so bummed out, its not fair. But you people give me hope cuz if it could work for you, it has to eventually work for me, Right? Anyways all best to a ll the people that got the ead's and GC and good luck finding JoBS, People!!!!!Oh, and one more thing, how long after the biometrics if you dont hear anything about your ead you should start calling?

  15. Thanks for the response, MIss Jess!!!. Neither I nor my husband have children, and we are living just by our selfs, no one else. But thank you for answering. I called the Uscis this morning, and as you probably already know they werent really helpfull. I like having control over my situation so we already sent out requests to emplyer, IRS, Bank for the needed documents.I was just wondering does anyone got a similar RFE, and how they handled it? is there anything that I shouldnt be doing? and as MIss Jess saing: Uscis making a mistake it hardly unusual:D:D:D:D Hope none of you has an RFE, and everything goes smooth to you and your spouses, family members etc!!!!

  16. Sorry that I'm Late !!!! AOS packeage sent on 23 December, received by the USCIS - Christmas eve.

    NoA 1 on the I-485 and I-765 received 0n the 13th? I think. Biometrics scheduled, did them yesterday at the Seattle USCIS office in Tukwilla, (26 january 2011). Last thursday (20 january) my husband got a text about RFE being sent our way.Just received the copy last night. the RFE is about the Affidavit of support mainly and here is what it says:

    * Submit a complete Federal Income Tax Return submitted to the IRS from the petitioner( sponsor) on form I-864 , afidavit of support for the mosr recent tax year/ well SORRY FOR THE CAPS, BUT WE HAVE SUBMITTED INITIALLY THE FORM NEEDED WITH THE AFIDAVIT OF SUPPORT B-U-T;we submitted tax returns from 2009, 2008, and unfortunately 2006. I did a research and having an RFE in January/Feb about your tax form for the most recent year does not mean you have to submit a form that you dont have (like the W2 from 2010, right now) they just want a consistency of 3 consequential years. To order a transcript from a previous year from the IRS is fairly simple, we ordered it through the phone, and I think its free (the girl on the phone explained that a lot of people right now are asking copies from their previous years tax returns for immigration purposes this period of the year.) . so our 2007 W2 will be coming soon in the mail and we are gonna send it with coppies from all the 4 consequential years. ( if anyona else has a different experience with this type of RFE and we are wrong please write me ASAP!!! I dont wanna screw up!!!!

    * The petitioner/ sponsors income on the tax return DOES NOT MEET or exceed 125 percent of the poverty guideline (well sorry but again I have no idea what this is : our house hold income for 2 member family is around 49000 $ per year and the guideline is like 18000 or sth)The petitioner/sponsor lists their current income as sufficient, however no evidence has been submitted as proof of current income ( we actually did but the letter from the employer was just short and didnt contained the details that they are listing after this statement)

    Please submit evidence of the petitioner/sponsor's income. Such evidence should include:

    - Letter of employment CONTAINING THE FOLLOWING:

    Dates of employment ( we had that contained in the previous employment letter)

    Nature of Job (also contained previously)

    Wages or Salary earned ( also contained)

    Number of hours per week worked (also)

    Prospects for future employment and advencment (??????????? Did anyone had this we didnt)

    Pay stubs or other documentation of pay for the previous 6 months ( my husbands work doesnt actually have pay stubs, but well we requested them yesterday)

    Evidence of other income, such as Tax exempt interest, Qualified Dividends, IRA distributions, Pension, Annuities and Social Security Benefits (only SSA-1099 and or SSDI -1099)

    * BASED ON THE DOCUMENTS The petitioner/ sponsors income on the tax return DOES NOT MEET or exceed 125 percent of the poverty guideline for the household (#######??? again ) Submit evidence of assets that meet the standards listed below or obtain joint sponsor.

    Ok I get this, but we didnt fill out the part 7 of the affidavit of support cause the part where you are listing your assets was optional as long as you have te sufficient funds to support your household and now they are asking us for it? Dunno whats up with that but I am wondering should we prepare a WHOLE NEW AFFIDAVIT OF SUPPORT with a brand new documents and send it to them, cause I dont see how you can send a half form?

  17. just an addition to the note above, I included facebook messages (since Facebook is the big thing right now, and we dont have e-mails, and it worked perfectly fine. The USCIS didn't mind. I would agree, like everything that would show that you too have ongoing relationship. (I didnt had an engagement ring so you dont have to worry about it). Will sent you a template of my Proof of relationship PPoint presentation (that my fiance included in the application, printed out of course) so you can have it like a start thing to get oriented by.   18. Hello. Just got the notivication from NVC.:D It said.

    Your fiance will soon receive a packet with instructions from the consular section on how to apply for the K1 VISA at that post and what documents will be required. In the meantime you should visit the Department of State's website at www.travel.state.gov/visa/immigrants/types/types_4323.html to determine if the processing post has any information of which you should be immediately aware.

    The case will be processed at:

    US Embassy

    U1 Samoilova #21

    1000 Skopje Macedonia

    And also we have an INS number. Does this mean our case its on its way to my embassy? oh I am freaking out:D

    I know this is like a punch in the face for all people who are waiting still for NOA2 but I had to share. Advice for all people that are about to apply for a fiance visa.   19. Hi, CBM, I saw a previous thread that you started about this whole issue. I was in the us, on an Undergraduate Exchange Program, sponsored by the OPEN SOCIETY institute, NY, and my visa was sponsored by the university of Washington, where I attended the program. I already sent an e-mail to my UW coordinator, and they said they will look into my case, and see whether they have my DS 2019 or not. I am absolutely positive that I sent a copy to my scholarship coordinator at the OSI, but he is no longer a coordinator of the program that I attended. So thats where the problem is. The only person I am positive that can give me a copy of the ds2019 is no longer responsible for that. :( sucks. I have a bit of hope that the University will come up with solution. :D

    I am really worried, and I dont know why. Is it absolutely necessary to show your ds 2019 form, to proove that you are not a subject to the 2yr rule, and can you get a K1 VISA without it? I am sure that someone must have knowledge about the issue. Like, we are not the first ones that are going through the process of obtaining a visa after having a J1 earlier...

  20. So, hello there. I have a little problem. Me and my fiance filed a K1 petition at the USCIS, at the CSC. We just got our NOA2, and the case is going to the NVC. I am a former J1 holder, who's visa expired June 2009,and on the visa itself, it says I am not subject to the 2yr HRR.But I have lost my DS-2019.Also I looked through the websites and my J-1 :

    *wasnt sponsored by goverment (US, or my state's goverment)

    *and I didnt studied abroad in any field that my country has a lack of skilled people in

    *and I wasnt on a grauate program of any kind, nor medicine.or something like that.

    As I could understand, those are basically the cases in which you have the 2yr HRR on your J-1. I am pretty positive that my DS-2019 also stated the same thing (that I am not subject to this rule). But I started to worry when I read all the post of some J-1 waivers and about you you need to show your DS-2019 at the interview, or they will not aproove you the K1 visa. My heart stops as I write this, but is it possible that I get rejected just because I dont have my DS-2019 at the interview? Thanks. I would appreciate your help. I havent found a thread that says exactly what should you do in this kind of case, so thats why I wanna be clear.
