  1. VISA approved!! Just wanted to thank everyone who helped me during this process.

    Does anyone know, if you get the original documents back? I sent original documents to the NVC then my wife got original documents to bring to the interview. Can someone break down to me what exactly happnens at the POE (CR-1/CR-2)? thanks.

  2. Hello everyone,

    I know this has probably been asked a million times, I tried to find the answer in this forum, but I was not able to. My wife has a interview at the embassy soon, and according to the instrucions from the embassy, they require you to sumbit a DS-2100 and DS-230. Is this just for K-1 applicants? The way I am interpeting the instuctions is that once DS-2100 and DS-230 is sent the embassy will schedule the interview after..

    "APPOINTMENT SCHEDULING: When you have completed the previous steps, the Immigrant Visa (IV) Unit will send you a formal Visa Appointment Package and interview letter. We schedule appointments as they become available. Generally, appointments are scheduled within two months."

    But we already have an interview date. Any input provided will the much appreciated thanks!

  3. Well, that seems very odd, I've never seen anything like this from the NVC. I'd say keep calling and stand firm on whatever they say. The part I don't like about this is that one person will say one thing and then you call again and someone else gives you a different story. If you had gotten the same response from both, then it wouldn't be such a big deal. Keep calling and demand an explanation.

    Thanks, Thats exactaly what I was going to do, so I called again this afternoon, and talked to another operator. Even stranger he told me case is complete, and that interviews on December was at capacity and please call back sometime this week to see if they will scheduele my wife and son's interview for January. I was even more confused because the change took place so fast I thought the guy was just makeing up a random status for my case. I just said thanks and checked the DOS website and to my surprise I got the sign in failed!

  4. Does anyone have suggestions for me? This is the situation. I have 2 cased currently in NVC (wife and son). My wife's case is complete. In late August I recieved a RFE (I messed up on AOS) and Name for my son was misspelled on the I-130. So I sent them a new AOS and a letter to NVC to fix the name for my son. I called in October and it said NVC they recieved on 20th September. After waiting the 6-8 weeks, I called again this time speaking to an operator, she confirmed has been in long time so she will send it to a supervisor and wait 10-15 days. After 10 days I called again and spoke to another operator, he told me that his case needs additional processing. After a week I called again for a status update and the operator told me that its in addional proccessing. Last nite I called and the operator told me that she will have a supervisor look at this case. I told her I was confused because a operator already told me that case was going to be reviewed by a supervisor and another operator told me its needs additional processing. She said she herself was confused about this case and will foward it to a supervisor. I dont know whats going on with my case or with NVC. Seems like its in a loop. Can someone give me some input? thanks

  5. As always, thanks a lot for your comments. I was sure sure I had to pay separate fees for each application until I read that somebody couldn't pay the fee for one of their applications after they paid the first one, that's when I was all confused and started doing some research. As far as the IV fee, yes, that I know has to be paid for each applicant (sure, the cheapest one is the one you only have to pay once...lol).

    I currently have two cases at NVC. In July, I sent the I-864 packet and the IV packet, prior to that, I only payed one affidavit of support processing fee and of course two separate IV fee for wife and son. Unfortunately, I received a RFE last week, to send in 2009 tax and a separate I-864 for my son. I submitted what was requested. After reading Diana’s' post about having to pay another affidavit of support processing fee, I then quickly logged on to the NVC online payment site to see if another invoice had come in and there was no new invoice. Out of curiosity I logged onto my wife’s case and found a sign-in failed...this got me nervous so I called NVC and they told me wife's case was complete and it is on hold until her son's case is completed then sent to the embassy together . The agent also told me I will not have to pay another affidavit of support processing fee. I just wanted to clear this up.

    The NVC is correct because the instructions you're reading are for people who are Adjusting Status from another visa type. For CR1/IR1 and CR2/IR2 visas, the process is different at the NVC where you will need to send individual packets for all beneficiaries as well as pay separate fees for all of them.

    Thanks, that part of the instructions was'nt very clear, I thought it applied to all visas. Anyway I submitted according to the instructions (2009 tax transcript) and new i-864 for son (stepson). So do you think I will probably get another invoice to pay another $70 to process my sons i-864?

  7. I-864 problem, Ok im confused, I sent the I-864 (wife) around 20 july i sent the i-864, tax transcript for 2009,2008,2007, employment letter, and pay stubs. For her son . For her son I made a copy of the original i-864 and submitted it with my wifes i-186. According to the instructions.

    Often a spouse or minor children obtain visas or adjust statusas dependents of a relative, based on the same visa petition. If you are sponsoring such dependents, you only need to provide a photocopy of the original Form I-864, as long as these dependents are immigrating at the same time as the principal immigrant or within six months of the time he or she immigrates to the United States. You do not need to provide copies of the supporting documents for each of the photocopied Forms I-864

    Today i recieved a email from NVC that says they need 2009 tax...ok they probably lost it, fine i will send another copy. It also says "The biographic information provided in this part does not match the principal applicant of the associated petition". I just called NVC to get more specifics and they said that i was suppose to have made a seperate i-864 for my stepson..according to the instructions a copy of the original should have been ok...or maybe i misunderstood.

    (i have two seperate petitions and two seperate cases wife/son)

Hola, nosotros enviamos dos ds230 uno por y otro por mi hijo(stepson my husband) efectivamente, enviamos cada certificado por paquete, todo independiente, es mejor que solicites otro certificado de nacimiento, ya que los niños tienen numero de caso por separado, por lo tanto debe ser todo independiente, o por lo menos asi lo entendimos en las instrucciones y asi lo hicimos.

    Tenemos casi los mismo tiempos que bueno!!!

    yo hable con un agente de NVC hoy, y me dijo que no es necesario que enviar dos originales de certificado de matrimonio que solo esta bien. Pero tengo un otro pregunta, tu enviaste un permiso o declaracion para tu hijo puedes ir a eeuu por NVC? Perdoname si mi espanol esta mal. Gracias!

    Im getting ready to send out the IV packet to NVC. I have all the documents for my wife and I will be sending a DS-230 for my stepson, but I only have one original marraiage certificate. Does anyone know if i will need to send 2 original/certified copy of marriage certificates? Thanks eveyrone!

    Here is my situation, I just paid my AOS bill, but unfortunately I am currently unemployed but I have a joint sponsor that meets the 125% povertly line. And I have all documents in hand ready to be sent out. Fortunately I recently found a job that is well over the 125%, but I wont be starting untill the begining of July. I would like advise on whether I should go ahead and send NVC what I have now, (I-864 unemployed with, joint sponsor) and send my wife an updated I-864 with supporting documents when her interview draws near. Or should I wait after I start work, get a employment letter, and one or two pay stub with tax statements, and then send the I-864 to NVC. What do you guys think? So far I'm opting to send what I have at hand.

    Quick question: Is there a order, AOS process first then IV process, or can they both be processed at the same time?

  12. Hello everybody, I haven't been able to find my answer so decided to post it (sorry if posted already). Does a minor need to sign his/her DS-3032 and any other documents related to CP? I am just wondering if one of the parents can do it, as a background, I filed for my step-children and trying to figure these things out before we get NOA 2's.

    For the DS3032, i did the ds3032 in email form several weeks ago and it worked, I didnt even send the ds3032. I too filed for my step-child. Im having my wife signed on behave of him, hes only 5. I'll let you know how that goes, i'll be sending the DS230 soon.

    i dont know how to work on the online thing... bit scared...i dont want to messed it up.. i have the docs they need.. except the photocopy of the pasport...

    And i have to wait for my daughter I-130 got approve.. is there any chance on NVC to merge those?

    I dont know if this is true, but it looks they NVC does not merge them, I just called NVC and they just recieved my case yesterday, I got my case number today. I punched my 2 USCIS case numbers and got 2 different NVC case numbers.

  14. Unfortunately, it's up to the DAS official to either accept it or deny it. I've seen a couple of cases here where they were denied right before boarding because the permission slip was over a moth old. It's best to get a new one before take off just in case.

    That was terrible to hear, but its reality. I spoke to my wife yesterday, she said the document is a public document and its good up until my son reaches 18 years of age. Thanks again for the heads up on this, last thing i want is to pay for another plane ticket because das denies the document.

    That is crazy, that cant be right. Im not really sure about inner workings of the DAS system, but if you were'nt there how would you get a DAS cert?

The NVC requires translations of documents ONLY if they're in a language different than English or the official language of the country in which the interview will take place so for Colombia thats spanish. Unless ur wife was born in lets say Brazil and her documents are in Portuguese there is no need to translate them at this point.

    1. No, your wife's biographical page does not need to be translated for 2 reasons: 1, translations are not needed at the NVC if the info is written in Spanish. And 2, her passport's bio page is also written in English.

    2. The permission slip your wife currently has does not need to be sent to the NVC. However, your wife will need it to show it to the DAS at the airport the day they leave Colombia, without it, her son won't be allowed to leave. Now, this document has to be issued within a few weeks before departure or they won't allow him to leave either. That means the document she currently has won't be good the day they fly out to the US.

    3. Translations are not needed at the NVC if the documents are issued in either English or Spanish.: http://travel.state.gov/visa/immigrants/info/info_3195.html

    Translation Requirements

    All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations.

    The documents don't need an apostille either, so don't bother with that.

    4. As long as the documents are either original or certified copies, meaning they have a seal from the notary office saying the are certified, you'll be fine. It is not that bad to get certified copies from them if the notary office is not hours away.

    Thanks Diana, I must have misunderstood, I focused on the "not in english" part. I will also have my wife look into it with DAS, her laweyer that handled the permission slip from said it was good for a year.

    2) Im petitioning my son (stepson). According to the Dept of state and US embassy Bogota webpage it doesnt mention anything about it. My wife has already obtained a legal document signed by his biological father granting permission. Does this document have to be sumbitted to NVC?

    3) Translations, is it better for her to send me remaining documents and that I have them translated here in the US, or for her to get them translated there...(running around Bogota to get apostille..etc, we already did that for the I-130 documents while I was there).

    4) NVC accpets certified copies, does this mean getting a copy with a stamp from a notaria? Im worried documents will get lost, and trying to obtain new originals is a pain in the cola in Colombia. We had to sit in a flota for 8 hours just to get a Batismal Certificiate.

  20. Hey NArocks, I'm glad to see things are moving along for your older stepson. :thumbs:

    As for the DAS certificates, the Certificado Judicial is the Police Certificate which they get online, it shows if anyone has been arrested or has had any trouble with the law. You will be sending this to the NVC along with the DS-230.

    The Certificado Migratorio is the Migratory Movement letter. It shows how many times the beneficiary has left and entered the country, if any and to which countries he traveled. The DAS will give this to him in a sealed envelope and he needs to bring it with him to the embassy the day of his interview. The US embassy is the only one allowed to open it.

  21. Most PPL do not wait 'to be mailed' anything.

    Instead - they PUSH into NVC - please read my top link, it's chock full of info FOR YOU.

    FWIW - yer 'post NOA-2 problem' is 100 negated IF, and only IF, you do 'The Push'.
