  1. Thank you for the reply Jackie.

    When the status for your I765 read that there was an "undeliverable" mail did the status change at all (like those little circles on the top)? Because ours is still on the "Initial Review". Even though it has been at least 80+ days (subtracting the days we took to respond to the RFE). I am wondering if your card came before the status actually was at the "Card/Document Production"

    It is so very frustrating! I had the tax returns in my hands but it was just a matter of me procrastinating and I guess prolonging everything without knowing :unsure:

    I do hope that it is just the status that has not updated, I have read that sometimes it just does not change.

    It is so confusing because each person that I have talked to at USCIS has given me a different answer regarding the two cases.

    We will probably go ahead in person if we hear nothing within the next week.

    I will keep updated. Any other advice is also much much appreciated

  3. Hi, my husband has applied for both I485 (AOS) and I765 (EAD).Here is what happened

    We filed for I485 and I765 on January 18th, 2011.

    The first RFE came on January 23rd -The check was for the wrong amount, corrected it and sent it back the same day.

    After this the NOA1 came the following week.

    ASC Appointment Notice was dated March 8th, 2011 and the biometrics appointment was for April 5th.

    Suddenly on March 28th I checked both cases on the USCIS website and for both of them it said:

    On March 28, 2011, the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

    I called immediately and told them we had Not moved and our address was the same. They said it was a RFE, they would mail it again and we would receive it within 30days.

    Well the next day we received it (turns out there was a mistake in our building's mail..)

    The letter was indeed a "Request for Initial Evidence (I-485)" It asked to send a "complete Federal Income Tax return within 87 days" Also it stated- "The Service will process your Form I-765, Application for Employment Authorization (if submitted) within 90 days of the receipt of your missing initial evidence."

    Right away I called USCIS to make sure that I was sending the right evidence and the man whom I spoke to told me that this RFE was for the I-485 and ONLY for the I-485, he also said that it WOULD NOT delay the processing of the I-765. I asked multiple times, not believing him, but he kept reassuring me!! Also I asked weather they should cancel the request that I made the previous day about Not receiving the letter they sent me- he said that would not be necessary.

    So I took my time and responded to the RFE with my Tax Return and sent it on April 17th...

    The status since then changed for the I485, it said they received my evidence. It changed again today, April 26th and it says that:

    On April 26, 2011, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action.

    However, my other case the I765 has still NOT changed and it still reads:

    On March 28, 2011, the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.

    It has been almost a full month since any activity there.

    My husband already did the biometrics (on april 5th). And they said the EAD is usually approved within a week!

    I think that both cases were Stopped due to the RFE,- but there is still NO change for the I765 and they already received my reply to the RFE.

    I have spoken to about 4 different USCIS representatives and they keep telling me that these are TWO SEPARATE cases and that the I485 is in California and that they have No information about the I765.

    I keep asking then- if they are NOt related How come the I765 has been stalled! It has been well over the 90 days normal processing time..

    I have no idea who to contact or what is going on with my I765.

    Any ideas? Any body with any similar situations???

    Please Anything would help..

  4. ook then I shall start getting everything ready. especially since I'll be in Bulgaria visiting my fiance when we're expecting the NOA2

    and of course I didn't make a copy of the I-129F packet as it asked, so now I have to recreate it if I can remember accurately.

    I'm Sooo happy (and a little jealous) of everyone whose getting approved!! our turn is Slowly coming!

    I have kept every stub since I started my current job (a year ago). You make a good point that if I'm a college student one or the other has got to go. But I started working at my job last June just when my fiance came to the States and lived with me for 5 months. I was able to support him, as he never found a job in Chicago. Then my semester started and I kept my job, supported him, and I actually have very decent grades. I mean what if I show them a transcript (I bet they won't care) but I just want to prove that my work will not affect my school as it has never in the past!

    My job is very flexible with me and will actually do anything to keep me so every quarter (semester) they accommodate to my class schedule so I will be able to keep on working and going to school. But I guess how to prove this to them?

  6. how many hours do you work a week and how much do you earn per hour, use the below formula to compute how much you earn per year, I-134 uses the amount before tax.

    Amount Earned Per Hour X 2080 = How Much you earn per year (This is the number you would put in the I-134)

    2080 hours is for full time position.

    oh okay thank you!! so according to this my income will be $27,040. I earn 13/h but like I said sometimes I work more/less so overtime is 20/h. anyway that is way over the poverty line requirements, just my concern is will they accept this income? and disregard what the tax returns will show.. because as I mentioned I don't think I'll be able to find a co-sponsor. :unsure:

  7. Hi Everyone!

    So I am trying to start on the next step while I wait for my NOA2 to arrive .. but regarding the I-134 and whole supporting my fiance. I'm lost.

    Where it asks about my income, I'm not sure how much I'll make this year. I have a full time job, but I am an hourly employee so I do not have a definite amount that I can say.

    I'll provide a letter from my employer saying that I have a secure job, but it's the exact income that worries me.

    Someone here told me that depending on who reviews my application it will depend if they'll review my current income or my past tax returns more. But the problem with my past tax returns is that they'll all show that I earned Below the 125%. I graduated high school last year (I know I'm young) but I've been working part-time since I was 16 and last year's return I believe I made only $15,000, but I lived at home for most of the year and my parents supported me. The year before that I made even less.

    By the end of this year I Hope to have made at least $22-25,000 ... but since I am also a full time college student my hours sometimes vary from week-week. Sometimes my paycheck (bi-weekly) may be 1,000+ sometimes 900 or less. So there really is no 'definite' income that I can say for this year.

    Please help!! any ideas what I should say on this form??

  8. We do spend a couple of hours a day on Yahoo messenger and phone calls ever few days. It is hard one one of us is very busy with the time difference and have to miss out on spending as much time talking. At least we are getting close to the time apart being over.

    Yes I completely understand. There will be a day though when time difference won't matter :whistle:

  9. It's been 7 months for us, it is pretty hard to deal with waiting and unfortunately we probably wont see each other until she is approved. That is several months away still. :(

    We have to hang in there. I keep telling myself that yeah it's horrible now.. but once this whole thing is over we will NEVER have to leave each other again!

    Do you guys keep in touch everyday? Because that's our biggest problem lately- sometimes we can't hear each other for two days.. gosh I HATE the phone game!

    I sent mine on April 19th :]] my NOA1 was dated April 26th! :))

    Reading all the posts here made me smile a lot because I really believed that the NOA2 would come like 3-4 months after the NOA1.

    Anyway I haven't seen my fiance in 8 months now :( .. I am flying to Bulgaria on July 14th to stay with him for 1.5 months and I cannot wait .. my life is pretty much a series of countdowns right now.. Two months exactly till I finally see him :unsure:

    On a separate note have any of you guys not seen your loved ones for that long? How is that ? We have been doing the long distance for 4 years now, and for the first time we are fighting so much :( and none of his friends understand , they think we should just break up .. and I feel like he is buying into this lately! I feel like all this waiting may be wearing his patients out.

    I just want my NOA2 and for him to come here !!

    Anyway good luck to everyone.. keep posting. This place is keeping me from going insane.. seriously. :blink:

  11. Same with my fiance, he had a tourist visa denial in February. Which was super weird because he was in the US last year on a J1 and left before the visa expired. He had NO intentions of staying here he just wanted to see me for 1 month. (and now I know that he was planning to purpose in person too :( )The lady who denied him simply said "Sorry, I encourage you TO TRY again. But I will not be giving you a visa today". And just like that. I have not seen my fiance in 9 months. :( I hope this lady knows how much her "decision" impacted us and our lives ...ahh :ot:

    :ot2: We just sent our petition in on April 19th... and I've read in some forums that his tourist visa denial should not influence the interview or the process and I am PRAYING that this is true!

    If anyone knows from experience though it would be very reassuring to hear your story.
