  1. I was with my fiance during the interview (04/10). The consul who interview usa was the guy who speaks tagalog fluently.

    I brought with me one paystub and the letter from my employer.

    to answer your question RE: co-sponsor they did not accept it ( based on our interview) i even ask the CO if he will accept my parent 1-34. and he just said NO!!!!.. he instead gave us a form asking for additional 3 paystub and it took mw 2 months to get the paystub. 2 days for FEDEX ($54.00). 1 day to submit in the embassy and 10 working days to have the visa delivered. ( keep calling AIR21 instead of the VISA center where you have to pay $18.00 useless they will tell you to wait for 6 weeks...)

    if you can move the interview until you have atleast 3 or 4 paystub to submit its much better, than go to the interview with 1 paystub, Less stress.

    HI thanks for sharing your experience, were you making above the federal poverty guideline? this is troubling news...well i did include pay stubs from my previous employer as well like 8 or 10 of them because thats where i was working up until i got hired at this new place...

  3. As I was reading your post I was getting ready to remind you that you should provide proof of your dad's legal status in the US, but you've already got that covered! :thumbs:

    I don't think you need to provide his pay stubs. You've got sufficient evidence of his income.

    nice thanks a wholeee bunch, ill post the outcome of his interview on the 10th no matter what the outcome, so others can learn of this sort of situation as well.

  4. Yeah, I tend to agree with this. My feeling is that they shouldn't consider her a dependent unless the sponsor specifically says she is dependent on them for support. If they are going to conclude that she is a dependent on the basis of the joint tax return, then they should also be willing to consider her income. But, the consulate can read the evidence any way they choose to.

    This all gets kind of fuzzy because your mom and dad's income is combined on their tax returns. Likewise, you would presume that the dependents they claim are supported from that combined income. It doesn't seem fair that they would consider only his income in determining whether he qualifies, and also consider him entirely responsible for supporting the dependents claimed on the tax return. That would presume that your mother's income isn't used at all in supporting those claimed dependents, which is kind of silly.

    If this concerns you, then list your grandmother and your brother as "partially dependent", and have him write a letter explaining that they are both supported from the combined income declared on the joint tax return, so they are only partially dependent on his income alone. If you really want to try to close all the gaps, have your dad include a statement in the letter that he will sign an I-864 when the time comes, and have your mom include a letter stating that she will sign an I-864A. Remember - you're not trying to cross some invisible finish line with a number on a form. You're trying to convince the consular officer that there's no chance your fiance will become a public charge. At this point in the process, that's the only thing a consular officer is charged with determining. Manila can be very picky when it comes to co-sponsors, but it's generally prudent to always provide more than enough evidence to convince them.

    Thanks man, all you just said totally encouraged me. finally someone finally backs up some of my theories. Well the interview is on the 10th...5 more days yikessss! one more quick question, should i scan and send my fiance my parents most recent pay stubs as well? i sent their affidavit notarized and everything, their 3 most recent ITR w2's and employment letters. i sent all my pay stubs to him like a whoollle bunch of them (including the place i worked before getting this new job) but i didnt send theirs. Yeah i also want to prove that he will not become a public charge, i guess the whole finish line thing is coming from worrying because of the complicatedness of the situation

    a. new job, not been there for a long time

    b. me barely passing the poverty guideline

    c. not having a big enough salary previous years

    d. things i read on here saying they dont accept joint sponsors

    e. the whole joint income tax return of my parents

    ayaaaa. so overwhelming, but since todays responses ive stopped worrying and learning to smile again.

  5. he barely makes it, if my grandmother was not included as a dependent we would be completely off the hook, far far far away from the hook. but when their salaries are combined they can support a family of 10 even 11. there is plenty to go around. I am willing to accept that they might not accept multiple sponsors even if an acquaintance of mine who is an immigration lawyer told me "There is no limit on the number of joint sponsors, but each joint sponsor must meet the 125 percent of the poverty line income requirement for their household size"

    but i cant accept nor understand why my mom should be listed as dependent on my dad. if that were the case, and if that were the basis for determining poverty guidelines for each household in America, then my goodness, many many many Americans would become part of the national poverty statistic. for example a family of 8 needs $46,000+ to pass the poverty guidelines. I dont think one person can cover all 8 people! Not unless he has a really high paying job. Not everyone is an Engineer or a Doctor, thats why only those women who have husbands with those professions can afford to be stay at home wives/moms. and besides since none of her income will be counted towards financially supporting the household size and that my father will carry the responsibility of supporting the whole household, technically she has the entirety of her salary all to herself and it is more than enough to support herself.

    It's not that i dont believe in what pushbrk had to say, I take all of your advise very seriously. Im just probably looking for a way to give myself peace of mind...haha im going crazy... i wish it was the 10th already!!! so I can finally get the answers to questions i have been researching since Monday and only getting about 2 hrs of sleep each night 'cuz of worrying

    hello po sa mga kababayan ko.Meron lang po akong mga katanungan. Nung isang gabi nalaman ko na hindi DAW tumatanggap ang USEM ng co-sponsor para sa k1 Fiance visa? Totoo po ba yon. Please prove this wrong waaah, kung sino man ang pumasa ng interview na may cosponsor, please post you experience. May trabaho ako nung Jan-May kaso grumaduate ako nitong April 2010 lang po then nagkaroon ako ng job offer at kinuha ko naman, nagstart ako sa new work ko nung May 10,2010. Sa sweldo ko ngayon na meet ko naman ung poverty guideline for 2 people, kaso sabi ng iba sa k-1 forum, Malabo daw sweldo ko kc $19,200 lang/yr. Permanent naman ako sa work at wala ng probationary period. Kaso 1 pay stub lang ang mapapakita ko kasi next week pa ung next na sweldo naming and next week na rin ang interview ng fiancé ko. Kaya nagpadala pa rin ako ng co-sponsors, my mom and dad. Sabi nga nila na chamba chamba lang daw ang pagkakatanggap ng CO ng mga co-sponsor, tapos sabi pa nila na isa lang daw ang pwedeng mag co-sponsor.

    Kwento nyo naman po ung nagging karanasan nyo sa interview nyo kung nagkataong pinagbigyan kayong gumamit ng co-sponsor, o kung hindi kayo naaprubahan dahil sa affidavit of support (kulang ang kita). Alalang alala na ako huhuhu. Salamat po ng napakarami

  7. Yes sir I understand. So my conclusion is correct me if I am wrong though, I will list my dad himself, my brother, my fiance and my grandmother. I will not list myself as I have my own income, and I will not list my mother either because she has her own income as well, which would also satisfy our household size, even if on her own. I think she should only be listed there if she does not make any money, on the i-134 as I remember it said "list the people who are dependent on you". therefore i think this should exclude my mother and I. well thats my way of thinking though do correct me if im being stubborn.

    and yes I did include a cover letter, i wish i had a soft copy with me right now so i can post it here. well basically it says that I do not pay rent because my parents have me living with them at no charge free room and board and the same support is extended to my fiance(other members said that this might be a negative factor, but doesnt that mean we have my salary all to ourselves?).

    i also said that I recently graduated, explaining why i didnt make much these past few years, and that i landed a full time permanent job related to my field of study almost right after i graduated. i also advised my fiance to emphasize that I chose to finish college for the better of our future. and also to emphasize that i had another job from the duration of Jan-May, and was confused on whether i should accept the new job offer or not because i have been at my first job of 2010 longer, yet i decided to grasp the opportuniy because it would allow me to support us even more with the higher salary.

    please share more advice if you can, thank you so much, and thank you for explaining simply and clearly, it really helps since my mind is already congested of worries and immigration jargon and calculations and more worries. thank you

    Now that you have mentioned it, what if there is also a partial dependent included. My parents claim my grandmother as a dependent on their taxes, which is totally “stupid” because she doesn’t live with us…she lives with my aunt and uncle, AND they do not have to provide for her because she gets SS benefits every month along with free med insurance etc etc and everything else like clothing, food etc etc is provided by my aunt and uncle. So I guess the question is do I need to state that my grandmother is part of the household because she was claimed on ITR even she isn’t part of the household? Trust me, sometimes being in a Filipino family drives me crazy.

Hi Johnny Thank you for your insight, yes I am permanent and it is also stated in the employment letter, I just have a really bad habit of mixing up temporary and permanent especially when I haven’t been thinking straight for the past few days. Hopefully things go like you’ve explained. I read somewhere that it doesn’t matter if you barely make the poverty guideline, and that the important thing is that I met the required cut. The only thing I was worried about is my duration at my new place of employment and that I was only able to provide one pay stub to show for my income, I get my second one on the 15th which will not make it because his interview is on the 10th. I included pay stubs from my last job though, I hope it helps in anyway. Hopefully they give consideration, all I can do is pray and hope for your responses to shed some hope for me=(

  10. hi thank you for your response here is another vry detailed post i made on my current situation, He is in Manila andi found out last night that thy do not accept co-sponsors? but i know people in the same exact situation who have used co-sponsors evn multiple ones. thank you for giving me a quite optimistic response, many of the other ones were so discouraging please read my post and give me further insight

  11. hi, thanks for that, well my parents file joint taxes and only claimed my brother as their dependent, so if i were to choose one of them to be a co-sponsor how would i list down their dependents? for example i choose my dad i list myself, my brother and fiance? do i include my mom? she has her own income though. and on the tax return since they are joined it makes more sense that they can provide support for us together? how do i go about it? i remember reading somewhere that i can have as many co-sponsors as i want, im confused=( and when my mom petitioned my dad also k1 (long story, they werent marrid yup blahblahblah) her income wasnt enough so the USEM asked for co-sponsors, this was in 2006 and then both my uncle and my aunt co sponsored him and he was here in no time. Im so confused because there are so many different stories and contradictions=(

    my current employer stated that i am a temporary employee, so does that help? even just a little?

    well its not that we cant and wont move out and provide for ourslves, its more of a traditional thing, where Filipino families always stay together, even if thy have huge salaries, yeah kinda weird but its one of those filipino things, I thought it would help because that means i dont have to pay for rent or anything therefor i have 19,200 all to myslf? well and my fiance of course

  12. i was employed Jan-May at a different company (about only $12,000/yr) , on the 10th of May i switched jobs, salary about $19,200/yr, the guideline for household of two (me and fiance) is $18000+. does the period of my employment at the new place affect our petition?

    I qualify in that case, but because I just started last month, will that disqualify me to sponsor him? his interview is on the 10th.

    Last yrs salary was very low i was a full time college studnt part time working

    is current salary more important than previous yrs? if so do i need to be at the job for a certain period for my salary to qualify for sponsoring my fiance?

  13. so i can use a co-sponsor? i guess I kind of wanted to know if I alone as the sponsor will make the cut or not? will they calculate your annual income based on the job you have now even if you havent been working there for a year to provide them with ITRs (for my situation my fiance's interview is also the mark of my 1st whole month at the new company). I just want to play it safe just in case they wont accept my co sponsors that I will meet the requirements. Thank You.

  14. hi there VJ members, i need immediate and knowledgeable advice especially from people who have already experienced the same situation. here goes...

    my fiance's interview is on the 10th of this month. all the while, while waiting we were confident about th whole sponsor thing because I have my parents co sponsoring the petition. but last night I discovered from posts here that USEM does NOT allow k1 cosponsorship! :crying:

    I lost my job August 2008 and only made a small amount of money because it was part time because I was a full time college student. however in January I was employed again making about 800-1000 dollars a month. In April I finally graduated. In May I became employed at a higher paying job, even if just by a little. in one week I make $400 gross. $1600/month. If calculated I make $19,200 annually. and I saw that the min for 2 people is $18,000+. i also attached a letter stating that I live with my parents free room and board and food, free everything almost and thy plan on keeping it that way for as long as I want, the same support is offered to my fiance. i also mentioned why my income was low the past year, again bcause i was a full time student (i heard they give consideration when it regards education) So if you look at it I meet the requirements???

    Im worried because I just started working on the 10th of May, though I am permanent and full time, will that be a problem for our petition? will the CO say, "oh she just started working and we cant rely on this".

    I also included my pay stubs from my previous employer because right now I have only received one check from my NEW job and also a "recommendation" letter from my last job stating that i am welcome back at any time (i hope this helps make the CO think that I will never be jobless and have a strong fall back)

    I know this is kind of long thank you for continuing to read, I just want to get all details in so you can give the best of your knowledge also.

    my fiance has work history and has a bachelors degree in Information Technology which is in High demand here in the silicon valley ( i hope this is also a plus, help convince the CO that he will not become a public charge)

    Please give me some answers, I cant sleep at night thinking about this, Im even distracted at work and verrrrry worried =(

    Just in case though i still forwarded all my parents sponsorship to my fiance. Is it safe to say we have a chance at getting approved on the current circumstances?
