  1. Thanks Karen!, we just called DOS and were given to understand that they have all the necessary information and our case is in AP. The wait time according to the operator was 4 to 8 weeks . This is a bummer and quite upset now :crying:.BTW,Did you call DOS?

    Not sure if India is considered to be in a high fraud country -God this testing period is getting too much to endure!

    OMG... what??? 4 to 8 weeks?? Do not even want to think what is the wait time for someone with a work visa in Canada! My visa will expire on August 12th and my interview was June 21st. All I can say is that if they take longer than August 12th to do the AP I have no other choice than to stay in Canada illegally as they have my passport... So be it!!

  2. out of curiosity, is there anyone we can contact to find out what the hold up is? (as in, if we ended up in AP?) I'm only a week since my interview on Monday and with Canada Day Friday and Independence day Monday, I figured I wouldn't hear much until this week, but I'm -really- hoping to hear early this week because hubby is supposed to be coming up next weekend to move me.. /sigh.

    according to a DOS representative, it depends on the person at the consulate handling your file...they go over the docs and stuff... i had my interview 2 weeks ago and as of friday my visa had not been printed yet (according to DOS)...

    They gave us a green slip because the consul wanted an I-864A from my sister's husband (she is our co-sponsor). I feel so stupid not thinking it may be needed since they did their taxes together :( ... But bottom line is all we have to do is bring this document as soon as possible and drop it off with his passport so that they can print his visa.

    The consul was very nice and she asked 0 questions about us. it basically went like this:

    consul (in spanish): Hello, good morning

    Us: Good morning

    consul (to me): everything looks good, do you have your sister's W-2? I don't see her individual income on her tax transcript

    Me: No, I don't. I have an employment letter that shows annual income.

    Consul (to me): well in that case you guys have to come back, bring Jose's (my sisters hubby) i-864A and copy of his green card, and Lorenzo's (my hubby) Passport so that we can issue his visa. (then she gave me the green slip with visa can't be issued now and Section 221(g) checked off)

    Me: Do we have to make another appointment? how soon can we bring this?

    consul (smiling): not at all, as soon as you have the documents drop them off outside and pay for the courier service that will deliver lorenzo's passport.

    us: ok thanks :)

    So is not good news yet, but almost good news :rofl: now let's see how fast fedex really is! let's hope Tom Hanks was right lol

    Well, as if they were going to deny your visa after you submit the i864A.... there is no possible way that can happen!! I am sending you my CONGRATS right now!!!!!!!!!!!!!!!!!

    By the way, about the IRS transcripts: the Tax transcripts does not show the W2's but the 'wages transcript' does. I submited both tax and wages transcripts.... hope that helps someone!

  4. congratsssssss!!!!!!! Idont know how to do the smileys from my phone but know im jumping for joy for u!!!!!!! I pray within a week or so i can als say approved we submitted the xtra docs yesterday so hopefully they will call or email us soooon!! Still have to go thru mandatory AP but that was no shock.....just want him here soon......

  5. I have no knowledge on this so I cannot say whether the attorney is wrong or not. But based on common sense, I would think the safest bet is to not present the lease just in case the attorney is right... It is assumed that the foreign spouse is not in the US yet so a lease at this point is not expected... So, if you have other substancial evidence of bonafide marriage I would leave this one out just to play it safe. You can still do the lease but just don't show it. Or if you are afraid of a background can you just have your name added on to it later?

  6. Hi, I had (have) the same problem. I am on a work visa in Canada that expires on August 12th... and I am from Argentina. According to NVC I can only interview in Montreal if they find me a date before the expiration of my visa, otherwise I must interview in Argentina. Good luck!

  7. The Argentina PCC has slowed me down significantly at NVC and I wanted to share some info about Argentina PCC's so that others can avoid this hussle.

    If you need to get an Argentinian Police Certificate but you are not residing in Argentina, pay attention to this:

    In few words: NVC only accepts Argentina PCC that are ISSUED by the "Departamento de Reinsidencia" and not the Argentine Consulate. Many Argentine consulates like the one in Montreal offer 2 options to issuing the PCC:

    1) To send a power of attorney to someone in Argentina that can issue it for you (only one accepted by NVC).

    2) The embassy takes your fingerprints and sends them digitally to the "departamento de Reinsidencia" who sends back the info to the Consulate who then issues the PCC (with the info taken from the same place it would be taken if you were to issue it in person in Argentina).

    Of course, I chose option 2 as it was way easier, but after 2 rejections at NVC they finally told me that there was nothing on their manuals that said that the PCC could be issued by the Consulate, regardless of where the info is coming from, and regardless that the PCC clearly states that it is coming from the "Departamento de Reinsidencia from the Ministry of Justice, Security & Human Rights".

    So, BE CAREFUL! NVC says that you can get it from the consulate but they don't tell you this. I know, it does not make any sense but those are the rules...

    Last but not least, do not forget to request the PCC "con excepcion al articulo 51 del codigo penal" (NVC won't take the PCC if it does not say this either).

  8. I was in the same situation as I married a USC while on a B1/B2 and left the US to marry. All I can say is that once your I-130 is filed and your wife's name appear on the USCIS system she will have a hard time trying to cross as you supossedly cannot cross to the US with one status while you have an immigrant status pending. So, the officers at the border can rightfully deny her entry and its up to them. I managed to cross 2 times from Canada while on process and this is what the border officers told me. I had to take proofs of strong ties to Canada (lease etc) so that they can be convinced I would return. I don't know about the potential visa fraud you are mentioning if marrying in the US, but what I can say is that be aware that if you marry outside the US the process can take up to a year or a bit more, whereas within the US I know its about 4-5 months on average.

If anyone reads this post later and is confused whether they can interview in Montreal or not I wanted to clarify: NVC confirmed to me that as long as they can schedule an interview in Montreal before my work visa expires then I can interview in Montreal. Now, in my case that might not be possible since I am having issues with my Argentine PCC which has delayed everything.

    As far as tourist visas are concerned, seems like they are valid too. NVC only wants to see proof of 'legal status' in the country of residence. But issuing a tourist visa in Canada takes about 5 months right now so that is not an option for me.

  10. If anyone out there has experienced anything similar please share your experience!

    To make the story short: I am from Argentina but currently working in Canada. So, I requested the Argentine PCC through the Argentine Consulate in Montreal who issues it with all the requirements stated on the NVC Country Reciprocity Schedule. This PCC was rejected twice by the NVC and I don't know what to do! Today supervisor Sue said she put a request to know what was wrong with the PCC.... but to me that does not mean they will review it again, it only menas they will tell me what is wrong... so I do not see a solution unless I go to Argentina myself and issue it in person???

    Has anyone out there issued an Argentine PCC from an abroad consulate, or any country's PCC from an abroad consulate and experienced problems at NVC???

    Could I expect and acceptance of my PCC after 2nd rejection?? Has anyone heard of such thing before??

    I am going insane...

  11. I know that what people say is the more the better... I only sent my marriage certificate and our joint checking account... nothing else (out of lack of knowledge actually). Never got an RFE and was approved after 6 months approx. I did put my facebook profile open to public where I had tons of pics with him... not sure if this helped or not. To be safe sentd as much as you can, but they generally place more value to the financial co-mingling so if you can add the spouse to the other spouse's bank account. Good luck!
