    Unfortunately you have two strikes against you trying to get a tourist Visa. The country you are coming from. And a denied Visa in the system You can apply and try but the probability of an approval is really zero. Sorry.

    You have a US husband and a US citizen child and a denied petition they have flagged you as a sham marriage you look like a high risk to enter.

    I personally would really get in to see a lawyer. Since Marc Ellis lives in Vietnam try him he knows your consulate and may be able to instruct how you need to prepare further.

    Really sorry for all you are going through.

  2. HI, first of all I know my husband and I weren't smart and did some bad decisions when my K1 was in processed. So I would appriciate if you don't call us stupid again. Anyway, here's our story.

    A year ago my husband applied K1 visa with hope that I could come to the US and we would get married there. But not long after we had sent our application I got pregnant. I gave birth to a baby girl in March this year. Since we wanted our baby to be a US citizen and have an American Birth Certificate, we decided to get married. After getting married we found out that it would hurt my fiance visa case and that we would have to start over again for a spouse visa. So we emailed the consulate in Hochiminh City, Vietnam to tell them that we wanted to withraw our case for that reason. They asked us to show them our marriage certificate and we emailed them it. In a mean time we applied for spouse visa. A month later the US consulate sent me a letter and told me that our marriage was a shame. I really don't understand how our marriage was a shame when we are legally married and we have a beautiful daughter together. After they called our marriage was a shame and that I tried to enter the US illegally, they were gladly to give my daughter a US passport, birth certificate and social security number. We were all at the consulate for the interview for my daughter to be an American and everything went smoothly. Anyway, our K1 was denied by the US Consulate. Now we are waiting to hear from the USCIS for our spouse case. They received it in Jun and so far we haven't heard more from them. We don't know how long we will have to wait and whether I'll get the visa. My husband's family really wants to see our baby and me so we now consider applying tourist visa. My 8 month daugher doesn't need a visa since she's an American. But I wonder if I can get the tourist visa? I really don't want to overstay or live illegally since I have a spouse visa in process. Plus, I would want to be able to visit my family in Vietnam every year if I ever came to America. I really apprecicate nice friendly answers. Thank you.

Teaching jobs for Native english speakers are very easy to come by, the main thing that is needed is some type of 4 year college degree, there are some schools that dont even care about the degree, but these schools are not very reputable, and often called backpacker schools, then he will need some type of TESOL or CELTA course, this is a class that is 4 weeks long it usually cost about 1500 to 1700$ and it will allow him to teach english as a foreign or second language, most schools require this, but as I said there are backpacker schools that will hire people with no degree. Depending on if he gets a job at a english learning center or a international school the pay is good, with good benifits, it just depends on his degree. The international schools pay better but they usually do require teaching experiance and a 4 year degree, but they also work monday through friday, while the learning centers are 2 hour classes and they can vary 7 days a week and even night shift hours. But there are plenty of them out there, and there is also a big market for tutoring children and adults, and some of the bigger businesses want people to teach their workers english as well.     Thank you very much, Jerome. Your info is always good and useful for us. So, if he doesn't have a 4 year college degree but wants to teach at English learning center he'll have to take TESOL or CELTA course? We want to have many options open so if one fails we still have the others. But first we will talk to some attorney over there and see what they say. Hopefully everything will work out with or without the visa.

Our only reason for even trying to get the K1 was so Binh could meet my family and friends, we were going to move back to Vietnam and I was going to teach like she does, so for now we are not planning on ever filing for another visa accept maybe a visitor visa so that she can meet my family. Don't be sorry, we will have a better life here in vietnam the cost of living is so cheap, and the pay for teachers is good, but most importantly we are together and happy as you will be. Jerome

    Yeah, like Jimmy also wants me to meet his family and friends. They're nice people. If I can't meet them over there they're still coming in Jan or Feb next year to be on your wedding or engagement ceremony. I can't wait!! I also told him that he can get a teaching job here. He thinks it's a pretty good idea. We just want to be together and have a good life.

    Questions for you. Is it diffficult to find teaching job here? What does he need to be able to teach?

No need to worry, just remember that in life there are things in the way, and sometimes you fall, it truly depends on how you get up from a fall, and the end is what matters, so as long as you have love it will all work out in the end. Binh and I were denied, the CO straight up lied, didnt like my past or something, so I willingly moved here and have not second guessed my decision one bit, as like you all that matters is that Binh and I are together. I am sure with god/buddha's help you will get through this one way or another and you two will be sharing many memories together. Good luck

    I like your last message but I'm sorry that you were denied. Are you going to apply again, or it doesn't matter anymore since you two are already together? I'm sure my fiance would love to move here too so I'm not worried about that part. I mostly worry about going to the consulate again. People work there are pretty mean and I don't want to feel like a beggar.

  7. Thank you everyone. I really appreciate your opinions. I'm more nervous and worried now. But if I can't get the visa my fiance will come and live over here. I'm up to him, just as long as we're together I don't care about anything.

  8. I was told it was $100 us for a consultation fee, and then $1500 for the fee, good luck just remember he is good, but the interview will be totally up to you, as he will not be able to go in there. Jerome and Binh

  9. So you've been there, done that. If I were you, hire a good lawyer, one already named in this forum, this time. Remember, you have to put yourself in the CO's shoes and "try" to guess what he or she thinks about your case.

    Right now, your case looks like this "Ok, this person tried before to get a Visa into the US via person ABC. Failed our screening the first time. Time to retry again, with a new person." They already get bored with the love stories. They only need a small excuse to deny your petition. In your case, it's a BIG one.

    Bottom line, tell your USC S/O to spend $$$ hiring a good lawyer if he really cares to bring you to the States.

    Thank you. We are considering hiring a good lawyer but wanted to hear what people think about this first. My ex applied for k-1 visa in May 2004 till July 2009 we got denied. It was painful but thank God I never got the visa.

  10. Do you know how many times the CO have heard of such stories before? Probably too many times already. See the part of your post that I quote in bold. Be patient and don't rush! You don't have a "clean" record (marriage that is) with USCIS. Rushing the relationship now is a sure recipe for Blue slip. Read many other posts in the past detailing steps to a successful petition. In your case, a marriage in VN is the only choice. Do NOT opt for K-1 Visa. The chance of getting a Pink slip this time is close to 0%.

    I know but we've known each other for over a year and just got engaged. Didn't have a ceremony but plan to have one early next year. His family and some friends wanna come too. If we didn't have to live so far away we wouldn't try to rush anything. Being apart is hard for us. That's why we thought of applying for k-1 visa but we're nervous.

  11. Thanks everyone a lot. My previous case was a mess. I don't think it came from me but my ex. When we applied he had never paid any taxes before. Also he had no stable job. We had to have a co-sponsor. He was married twice. I never knew where his ex's lived but the consulate wanted to know about them. I got a blue slip but submitted all the info and evidence later. I got another green slip saying that they had enough info and asked us to wait. We kept waiting and waiting. I think we waited for 3 years, but during that time things didn't work out between us. We broke up but never asked them to cancel the case. Last year USCIS sent us an email saying

    "On June 22, 2009, the post office returned your document I129F, PETITION FOR FIANCE(E) as undeliverable. We will hold it for 180 days from June 22, 2009 to allow you time to contact us. If you do not contact us at 1-800-375-5283 within 180 days, this document will be destroyed and you will need to file a new application or application for replacement with fee..."

    I don't know what he told them, or he never did. A months later they sent us another email

    "On July 30, 2009, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days from July 30, 2009, please call customer service at 1-800-375-5283 for further assistance...."

    We stopped contacting each other long time ago so I have no idea why we got denied. Do you think I need to contact him to ask what happened? Seriously I don't wanna be in touch with him again since he hurt me a lot.

    First of all I want to introduce a bit about myself. I'm 25 from Saigon, Vietnam. Recently I just got engaged to my fiance, who is American from PA, USA. We didn't have a ceremony yet but plan to have one early next year. My fiance and I are thinking of filling Fiancee visa for me then we can get married in the US. We haven't filled any forms yet because we're not sure what we need to do. We've never been married before. Our criminal records are clean. He has a stable job and pays taxes. It seems everything is good for him and we should not have any problem on his side. But there's one thing that makes us really concerned. I had an ex fiance (I was engaged before too), who was also American. We were in love for 4 years and applied for fiancee visa. But things didn't work out so we broke up. My case was denied and I never got the visa. I was ok with that because I didn't want to go to the US and be with him anymore. Now I'm enaged again but to another man. He's many times better than my ex and makes me laugh always. We've been in love for over a year now. Recently he made a trip here and we traveled all over Vietnam. His family wants us to get married soon and rushes him to make the visa for me. It seems fiancee visa is the fastest way so we want to try that. But we wonder we would have any problem since I asked for the same kind of visa before? So that's our concern. Hope you can help us or give us any advice. Thank you very much.
