  1. Hi everybody,

    I have an urgent question regarding form I-864.

    If the sponsor did not make over the poverty guidelines on last years tax return but has been employed since October last year and is currently making over the poverty guideline this year, do they qualify to be the sponsor?

    The sponsor can prove they currently make over the poverty guideline however we are wondering if they base the sponsors eligibility off last years tax return or off what they are currently making now?

  2. Congrats on being here :)

    First, head on over to the AOS thread mentioned in my signature. That will help with required forms :)

    To answer your qns though:

    1. put unknown and unknown. There is no issue with this because of the exact reason you mentioned, emergencies. Some people actually have trips planned, and the form's also used for re-entry permits etc so writing Unknown for both is fine (got mine no issue)

    2. the DS-3025 is the vaccination copy that you got from your panel physician in Australia. If at the bottom of the form it says "complete" you don't need to see a CS (civil surgeon) but if it says incomplete (which mine did) then you will need to see a CS who will complete form I-693. They will not complete it all though (have a read of the instructions, it explains it in the FAQs on the form about a K1 not needing a new medical). You will only need to complete Part 1 (about you), Part 2 (Vaccination table only) and Part 5 (their signature). That's it. Some CS's don't know this though so if you have to call one ask for the cost of "vaccination transcription" and hopefully they know what it means. Should not cost more than $50 for it and you DO NOT need a TB skin test. The price doesn't include any shots that you might require though. Sometimes they have the forms in their office so make sure you ask whether you need to bring the form in, or if they have the most recent copy.

    3. No. You have to go to the SSA yourself and apply. You can find the form SS-5 on their website and you can complete that, take it and your passport with K1 in it and you're good to go. If you're married you can TRY and get it in your married name but a lot of people have had issues with that so first you should get it in your maiden name because it matches on their system. Then when you get your EAD you can go and get it changed. For AOS purposes you don't NEED a SSN, and if you have one in your maiden name but complete the AOS forms in your married name it's not a problem (mine is still in my maiden name because we just haven't had a chance to get down to the SSA).

    Just one last question? Even though we will be married once we send the AOS stuff off, do i put my maiden name or my married name on all the forms? The reason i ask is becuase i thought you also have to go through the name change process after you get married and i might not have done that before i send off AOS?

    I have been here in the states with Kelvin now for 6 weeks and it feels so good to be together again! :-)

    We are getting together everything we need for the AOS but we just have a few questions that hopefully someone will be able to help us with:

    1. We are applying for the EAD and AP with the AOS. For the AP form, it asks the expected date of my travel and the length of the trip. I am only applying for the AP in case there is an emergency or something back home and i have to travel back to Australia, so what should i put for this question?

    2. Since I am a k-1 visa holder it says you do not have to have another medical exam since it is less than a year since i had the one for k-1 interview. But i did read that you are still required to see a doctor and show proof of your vacinations becuase the doctor still needs to fill out part of the medical forms. Is this correct, do i have to see a doctor?

    3. Lastly, Do you receive a Social Security Number when you file for the AOS or is this something that you have to apply for after the AOS?

  4. Personally, I would take the short delay to make sure the documents were correct because the risk is there is a longer delay later if the letter stating it was a mistake is not accepted. Then again, it could be fine...

    We decided to take the short delay and get the letter resent. We didnt want to take the risk of not having everything in order. It arrived in the mail today, so now we just have to send it all off :)

    If the NVC confirmed the e-mails of both myself (petitioner) and the beneficiary, is it likely that we will BOTH receive an e-mail from the Sydney Consulate with Packet 3, or is it only sent to the beneficiary? Also, if they send an e-mail with Packet 3, is a physical copy still sent to her address? We're a little bit concerned because she has been having troubles with her e-mail lately, and I really want to make sure nothing has been lost, especially because there is no definite way to see if the consulate has received the package from the NVC or not.

    She sent an email to the SydneyIV@state.gov e-mail address asking for the case status, but didn't receive the automated response back, and then 2 days letter receivd an e-mail saying it was undelivered and her e-mail servers were having trouble delivering. I just really don't want to the Packet 3 to get lost in the e-mail.

    The NVC forwarded the packet on June 3rd, so maybe its a little bit too early to be concerned, but we haven't heard anything so we're just a little concerned. Especially since she just gave her 4 weeks notice!

    Our packet 3 was sent to both of us, so hopefully you should both get it too. It also took the consulate 1 week to send us packet 3 from the time that the consulate received our file from NVC.

  5. Hey guys,

    Thank you for clarifying things for me about taking a copy of the I-129f package to the interview.

    Now i have another problem. I just received a package in the mail from my fiance containing the I-134 affidavit of support and supporting documents. I was looking over everything he sent and i realized that the letter from the bank says that the account was opened on May 26 2010 (the day the bank wrote the letter for him) when in fact it was suppossed to state that the account was opened in May 2009. Is this small mistake a problem? We also have bank statements from each month showing activity for every month dating back to May 2009. So is this enough to show that the account has really been open for a year? Or are we going to have to get a new letter from the bank?

    We were also thinking maybe we could get an email from the bank stating that they made the mistake with this date and just attach the email to the letter from the bank?

    We are hoping that we dont have to wait to send the letter all over again because as soon as we receive packet 3 (which should be any day now) we want to send it back straight away. We are hoping for the earliest possible interview date as i am trying to leave to be back in the states by the end of June.

    However, if a new letter is essential we would rather wait for it and know that we have all the requirements in order. What do you guys think?

  6. Hey Zoe -- Matt does need to send you ALL the original documents for the I129F. Eric put together the original packet & mailed it to me -- though only copies of the birth cert/passport for him.

    I am very confused now!

    What do you mean by we need all the oroginal documents of the I-129f? Do you mean we need to have the I-129f form and the G-235A etc to take to the consulate aswell? How do you get the oroginals of these when they were sent to USCIS? Do we need all this for the I-134?

    I am so confused, any help would be much appreciated.

    Sorry that i keep bugging you guys but i have another question :)

    Vanessa - You told me in an earlier post that when i immediately send back form DS-230, i only need part 1. When i open the form DS-230, it includes both part 1 and part 2. Do i just fill out part 1 and ignore part 2? Or do i fill out the entire form, part 1 and part 2, and send it all back?

    Does anybody know how to track your petition to see when it arrives at the consulate? The NVC told us that our case left for Sydney on the 26th May. I tried using some instructions i found somewhere else on visa journey to track using the DHL site, but it didnt work for me. Can anyone help?

  9. YAY!! Congrats!! I think we all understand how you feel now you have NOA2. For a while there you can't help but think "have they forgotten about me??" but now you're just SO close to being all done with it :)

    2. Just the letter from the banks and job. If it makes you feel better to take them though (the payslips or tax returns or anything else you have), take them to the interview, they're not needed but just in case they ask (which I honestly doubt!)

    3. DS-230 Part 1 yep. Part 2 isn't needed and yes you can send it all together :) That's what Astrid AND Terri did I believe. My stuff took a little longer to come together. You should hear about your interview a couple of (business) days after you send P3 back.

    4. About 3 weeks when I was booked in. I think Terri got it in like a week or something. So honestly I think it's anyone's guess, probably 2-3 weeks though.

    Congrats again! Very exciting. You're nearing the end :)

    **Edit - now would also be a good time (if you haven't already) to get all the relationship evidence together. Like phone logs, chat logs, emails, letters, photos etc. If you're anything like us they probably won't even look at them but you know if you don't have it they'll wanna see it :)

    Also, start looking into hotels in Sydney unless you live near enough to stay/drive. I wouldn't personally fly in the day of the interview. There is FAR too much stress involved if your flight gets cancelled, and then delayed twice making you over an hour late for your interview :S

    We are so exited now. I really want to call the NVC to see if our case is there but im trying to hold out a few more days (i barely have any patience left in me!)

    We should hopefully have all the required documents ready by the time we receive packet 3, so i think i will send it all in together along with the DS-230. And for the I-134, i think we are just going to take the letter from the bank, letter from the job, and pay slips. Im hoping i can definitely get my interview by the end of June becuase it is my fiance's birthday the first week of July and i really want to be there for it :)

    So when we send back packet 3, do we send in the I-134 and our medical results, or do we take these to the interview with us?

  10. Hi Everybody,

    We finally got our NOA2 yesterday after 116 days! We are so happy :yes:

    Now we just have a few questions about the next steps.

    1. Does the I-134 affidavit of support need to be notarized?

    2. Vanessa, i know that you told me earlier on that you did not take your fiance's tax returns with you with the I-134. We have bank statements and a letter from my fiance's job showing that he makes over the poverty guideline. And that is all that the instructions on the I-134 actually ask for, so im hoping that we will be ok with that. Vanessa, did you also take your fiance's pay slips, or just the letter from bank and job?

    3. Also, i know that once you receive packet 3 you have to immediatley send back form DS-230. Then once you have all the other documents ready you send them in to show that you are ready for an interview. My question is, If you already have all the documents ready can you send everything immediately along with form DS-230?

    4. Lastly, does anybody know what the current wait time for an interview is once you send back packet 3?

  11. Well, maybe so, but I hit the website last night, as I always do, only to find out that I had been locked out. Evidently the systems down, or at least that's the answer I got when i call them tnis morning. Maybe today it'll be back up.

    I see what you mean, we are locked out too!

    So does that mean that if we get approved today (wishful thinking i know, but we are all aloud to dream) that our case will not be updated online at all and we would only receive the NOA2 in the mail?

    Please USCIS get the case status up and running again! :huh:

    Married not even 12 hours after your fiancee arrives! It is kind of romantic in a way, plus your in-laws will love you for respecting their wishes. You'd BETTER post some wedding pics!!!

    I hear you about the man-cave. I've never scrubbed so hard or so long! I'm even getting my 7 year old son used to "putting the seat down"... lol.

    My preparations are just about done, just some last minute odds and ends and then I'm off to San Jose.

    Johnny, I sincerely wish you and Wilma the best of luck for a healty and happy life together. You're an awesome dude, so tell Wilma we said she's getting a great guy!

    Lohninck - Come on!!! You GOTTA be getting your NOA2 any freakin' day now. Once you get yours, the January class is just about done.

    Are there ANY other Jan filers who still haven't received their NOA2?

  13. I'd say it's a little early to be worried right now. VSC is not moving too quickly and right now they supposedly are working petitions around your timeframe. You could see some action any day so keep your fingers crossed...pray and get ready for the next phase. I'd start worrying as you approach the 5 month mark without any activity.
