I was hoping to see an answer to this question. What we did was say none since my husband hasn't left the states since arriving, even though it was 3 years ago. We did not include any time prior to him arriving in the US. Fingers crossed that this is correct.

Haven't been on VJ for quite a while. Hubby's temporary green card expired Dec 15, 2012. Can't remember our NOA1 date (think it was Sept 20 or so) and biometrics were on Oct 17. It is at VSC so expecting a long wait from what I am reading here.............

Good to see you on here again! I see that everything is going well for you two. I was wondering where all the people were who applied for visa's the same time as us. This seems to be a much quieter wait than the visa process--almost boring!

Yes, i called the MDV in Phoenix and told them of the situation, they advised me to call the supervisor in my home town MDV and they told me to come down and they will see what they can do, and they sorted it for me. Was imperative that I get my license back as I run my own company and cant work without it.

If you have received your NOA that is also enough evidence for them to extend your license.

One little tip, if you have a SSN then they legally can not refuse to extend/renew your license (unless you have a bad driving record) as it is against something called the real ID act.... my attorney told me about this, never heard of it before lol.

my wife's license expired the same day as her green card..she received an extension notice in the mail before that asking to submit proof of legal presence to recieve her extension. We returned that with a copy of her NOA, but the DMV stated that her NOA is not valid until her green card expires...therefore they were unable to process her DL extension until everything had expired! Fortunately, we were able to get them to issue a temporary license in the meantime, until she received her new DL. All of this is done by calling the Legal Presence division of the DMV in Sacramento, since the local DMV was useless. Here is the # for you to call:

I can't even begin to tell you how much the bold, underlined statement is TRUE! I hope no one here works for the Vallejo DMV...

speaking of employment, do you need to fill out a new I-9 to show that you got the extension letter?

That is a good question and in my experience the answer has been no. If you ever need to apply for something (for your job) that will require a background check or proof of legal presence again, then this may come up but most employers won't go back and require this.

When I got here in CA, I received a 5-year DL by showing to the DMV my passport and my EAD, and it won't expire until 2015. It didn't make much sense to me that they would not tie it to the validity of my papers, but who am I to challenge the DMV? Did you receive a license valid for a shorter period of time?

So since the permanent residence expired 10/31/2012, they made the DL expire 10 days before that. We thought that by sending in the extension, we would get the DL extended for a year as well. Not so...

I had that issue also in AZ. What I found out was this......

My 2 year conditional GC expired 09/20/2012, I did not file my ROC till the 19th of Sept (Yes, i'm a male and leave things to the last minute lol), anyway, overnight ed it to them and went down 4 days after my license expired (The same day as my GC). They first told me that I have to wait till I get my new GC after telling them that this could take 6+ months they said tough, that is their rules. So, I went back to my shop and called the main office in Phoenix, they advised me that because I filed in time I can call the supervisor at the MDV in my town and ask them to do a check with my A# to see that I am still in status....after telling the Sup this they told me to come down and they will see what they can do. Went down there and they just signed the form (didn't do a check on me) and got my DL renewed for another year........

I see now why you can't find that info. It is in the NOA letter, which is a separate notice from the Biometrics appointment notice. It seems that you have not received the NOA, based on the table of Sept I751 filers.

If I were you, I would call USCIS about this. Because that NOA is what you present to prove that your permanent residency is still valid for another year. You can show that to your employer, to prove that you are still legal to work; and you can use that at the border/port of entry when you re-enter the US, if you decide to travel.

You are not the first one I've read on here who has not received NOA. Let's hope someone who was/is in your situation replies with what they did. In the meantime, calling USCIS and asking them what you can do, might be a good shot.

So I need to understand, was the statement that the visa was extended for one year supposed to be on the Bio letter or is it a separate letter? All I received was the Biometrics letter and it said nothing of the sort. Thanks!

I'm so late but congrats Resees! I unfortunately ended up having a c-section with both of ours but after going through a few bouts of depression about it, I'm just glad they're here! Wishing you all the best!

Didn't the NOA automatically extend the Permanent Residence status for a year? It is mentioned in that notice. Or at least in mine (?)

I guess you got Bio letter on 9/22? If you send your package on 09/11, you should have gotton NOA letter (receipt notice) already...

Okay, maybe I need to read it again but mine didn't seem to say anything of the sort on the letter. Was it a one liner that I could have missed? And yes, it was the biometrics notice.

Does anyone know when we should expect the extension letter? My husband's drivers license expires on the 21st of October and we don't have biometrics until the 17th. I know, I know, it's our fault for waiting to send it in. But, does anyone know? Thanks,

Received Biometrics letter today....we are scheduled for October 15th in Cleveland for this....I just want this to be over with!

I'm so sorry to hear this! I just don't understand how people can change so absolutely but I have certainly seen it! I pray that one day you find out the root of all this. I wish you all the best in bringing your beautiful child into the world and filling it's life with love and care.

Hi, everyone! We have a few exciting updates. Next week will take my general exams for my PhD program! The exam is 2 weeks long. After I'm done, I will just have to do my analysis writing and present/defend my dissertation, no easy task but its all downhill. Hope to wrap everything up over the summer. I could not have made it this far and maintained sanity without my hubby's support.

We'll be moving to a great new apartment next month. Our unit has an office/retail space attached to our living area. Hubby and I are launching a few businesses over the next few months. I can't wait to be part of our new community. Will update when things come together a bit more. Its strange, we've been talking about moving and having a business for a few years now, but we've been waiting for the right opportunity. On a whim I decided to take a different route home after visiting the salon and we were presented with this wonderful opportunity. Thank you, God! I guess all of our dreaming and planning has paid off because we have some business ideas that we can implement over the next 2-3 months. Its funny but I think the best, most rewarding opportunities in my life have come unexpectedly, including meeting my hubby. : )

It's a new year and I was checking to see if anyone had added to this topic since I last replied. We are finally starting our Citizenship journey, so pray for us ladies!!

Good reminder. My husband is finally here so we are just starting our "happy ending". It is definitely nice to see him everyday and I haven't gotten tired of seeing him around yet! LOL. I'm just feeling really blessed right now and I hope that I'm able to come back a few years from now still feeling the same way.

Don't worry. As you can see from my timeline, we were told to pick up the visa on a specific date and it wasn't ready until about a month later! They said nothing was wrong with our case and we weren't put into AP, they just had a delay. In any case, thank God delay is not denial!
