But if parents are not agreed to the marriage, they not gonna be present in the marriage and they not gonna be writing sworn affidavits for you either. and i am filling my application but the lawyer thought that it gives a negative edge but i was like legally when we are old we can make our own decisions but she was like the interviewer can get suspicious on that so try to convince them in the meanwhile. But what if they didnt get convinced. What are your opinion guyz? Do you think they gonna care

IS it necessary that the joint sponsor or joint sponsor's should be making more then the 125% poverty guidelines to sponsor somebody? for example for 2 person household poverty guidelines are $18,200 so even if i have 2 joint sponsors, each making $12,000 and adding up the total makes it $24000 which is more then the poverty guidelines, can they sponsor me? both the sponsors are single and they don't have any dependent listed on there tax returns and i would be the only sponsor, so for me does it clear the barrier?

  3. Is your wife sure that her entire scholarship is non-taxable? If she used it for things like room and board some of it may be taxable income. You might want to look at this publication.

    But anyway, if she really had no taxable income so didn't have to file a return, you should enter the amounts as zero and put 'see attachment'. You should then attach a brief note stating that she has had completely non-taxable scholarship income (for instance) for 2007 (10,000.00), 2008 (11,000.00) and 2009 (11,500.00) and therefore was not required to file a tax return in any of those years.

    I think after deducting money for her tuition and other stuff from her scholarship, university refund's $18000+ in her account which is for her living expenses. Somebody told me that we can use this money for living expenses to file her own taxes but the issue with this thing is we are not sure that doing this would effect her from getting scholarship in the coming years of college because she is mentioned as dependent on her dad's tax return and she get's this scholarship because her dad doesn't make that much money.

    I am on F-1 Student VISA and my wife is a US citizen and we are applying for AOS. While filling up the form i864 we got stuck as soon as we reach Part-06. My wife is going to school and she is living off the scholarship money(bright future scholarship) so technically she doesn't even file tax returns and she is mentioned as a dependent on her dad's tax return.. She doesn't have any income except the scholarship money and although we have a joint sponsor whoz gonna cover the 125% poverty guidelines we still have to fill i864 for her because she is the principal sponsor. Now when you reach part-06 of i864 with no tax return and no income, we have no idea how to use this information to fill up the part-06. Anybody who faced the same situation and wanna share how he/she filled up the form i864 part06?

  5. Hi,

    I am on F-1 Student Visa but i have recently married a US citizen and we are applying for the green card. I know i can also apply for OPT through the form i765 but for now i am applying for work authorization through the process of Green card through marriage. I have to file the form i765 with my other forms i130,i485,G325A and i864 and i am confused about the category question no 16. Which category i fall in? I think its c9 based on what i read in the instructions document but if somebody can shed more light on it?

    We have to wait for our cosponsor to fill up the i864 form and therefore we were wondering if we can file our rest of application(i131/i485/i693/iG325A/i131/i765) now and send the i864(Affidavit of support form) later like within a month. We don't wanna waste time because the process is lengthy and therefore we want to get started in there system. Any idea? Anybody who is sure about this or who has already done it?

  7. Q1. Yes, if you have income and/or assets.

    Q3. If you have no job and no other income, or assets, you can not be a sponsor. You may have to wait to file until you get a job.

    Q6. Yes. She should have some official letter showing yearly amount of her scholarship.

    Q7. If your friend has $12000 on his tax return, he can not use this to sponsor you, he is at the poverty line himself.

    How much is your wife's scholarship?

    Her scholarship money is $17,700(After the tuition has been taken out) but she doesn't file taxes. Her dad does it for her putting her as a dependent.

    And since there can be a maximum of 2 cosponsor's so what if i find another cosponsor than makes more than $8000 annually? and then the 2 cosponsors combined would be more then $18,000 above the poverty level.

    Me on (F-1 VISA) and my wife(U.S Citizen) recently got married and we wanna start with the application but while looking at the instructions of i130 it says that we should send documents like lease agreement, joint bank account statements/ joint credit card statements and others. We have just opened joint accounts and our lease agreement is pretty recent 2. We have also put our joint names on other bills pretty recently. Should we wait before we have couple of statements from the bank and other bill statements or can we submit the forms right now with whatever we have (like affidavit sworn) and take these statements to the interview later?

  9. I am on F-1 and applying for Green card through marriage to a US citizen. In 2009 i worked on campus so i have filed tax return this year(form 1040NR-EZ) with my total taxable income $7100.

    Q-1:Can i also join in sponsorship?

    Q-2: if answer to the above question is YES, then do i have to file the separate i864 along with i864A because me and wife are living together so i can be a household member?

    Q-3: Is it necessary to submit current job letter because i am not working right now but i have tax return from last year?

    My wife is going to school as well and she is living off the scholarship money because her dad shows her as her dependent. She is not employed at all in 2009 and so she didn't file tax return for herself although her dad did

    Q-4: Since my wife is the main sponsor, does she still have to submit i864 for me along with other cosponsor's?

    Q-5: if YES what she is gonna attach with form i.e she doesn't even have any tax return

    For sponsor's household size 2, 125% poverty guidelines are $18,212.

    Q-6: Is my wife contributing anything towards meeting this poverty guideline because she just has scholarship money?

    Q-7: If my friend has $12,000 on his tax return, so can i use him as a cosponsor? because his $12,000 + $7100(mine) makes it more than $18,212 and my friend has no dependent on his tax return.
