  1. Fast forward to now. Case was given NOID. It states a summary of the stoke interview Q & A. Things of what the petitioner said and what the beneficiary said. It compares that those Q & A are different. No matching answers. During the long paperwork wait, my brother and wife had a kid and submitted all documents. The kid is now a US Citizen. USCIS has approved the case. Now it's headed to NVC for continue process.

     

    I guess having a kid will prove beyond reasonable doubt. Still a long journey to complete.

  2. How can the petitioner and beneficiary request to meet with the case worker? The petitioner is about to leave to VN in a few days to get a meeting. I notice there is an inquiry section for immigrant visa for cases after the interview was completed. But the email response could take days to reply and usually it's scripted with not useful information. I would assume cafe money would be in the works.

  3. My brother and his wife got the AP interview. Questions were very thorough, however 2 questions were answered not matching. First question was where did you go honeymoon? Wife answer correctly with Thailand. Husband answer wrong with Nha Trang(which was after the honeymoon). They called back again and asked that same question. Husband still answered wrong again with Nha Trang. Second question was what do you use for protection. Wife says condom, while husband says birth control. All other questions were okay since they matched the Timeline and other evidence submitted. They called at 1AM in America for the petitioner, while the beneficiary took about 90 mins for the interview.

    What can be done to resolve this? A letter explaining it? What are the chances of denial? The husband is already planning to make the trip back if they require more evidence of relationship. etc...

    Any thoughts?

  4. The 221g English translation asked for Petitioner and Beneficiary family tree. However, in the Vietnamese translation, it required only beneficiary. Since it would have been a hassle to ask the consulate, included both. It is a mistake in translation and I think it might have been fixed. No harm in turning in both. Better to have more than less.

    Regarding timeline, after the submission of all documents, they asked to wait about 30 mins and came back with approved visa. If you ask me, would the consulate workers sit there and read each page? I doubt it, and if so, will they interview again to verify conflicting info?

    Be careful in reading the English and Vietnamese translations, they make mistakes.

  5. It was not submitted late. It was requested on the day of interview. After submission, then they approved visa. It seems now they are asking all these additional paperwork and have no mention of it before hand.

    Simply stated, they want more than just the timeline now for those who got the 'Request for Additional Paperwork'.

    Anyone else experience such request on interview day?

  6. It appears the consulate is stepping up with the interview paperwork request now. I see now they are requesting new information.

    1) Proof of airplane purchase from credit card records or bank account withdraw(Petitioner)

    2) Family tree information of beneficiary and petitioner(English translation). In the VN translation, it states only beneficiary. Very confusing.

    3) Infamous Timeline(Petitioner).

    Has anyone gotten these request? Or any other different request? It would help for those new people to include it in before submitting to USCIS or NVC first. Once it gets submitted on interview date, too late.

  7. I advised against a wedding ceremony but also tell you the risks that could happen. Someone that knows about the wedding sabotage saying these couple are married to official. Legally it's not official until there is paperwork. Also, something slipped up during interview, documentation or something said wrong. For example, using the words 'husband' or 'wife'. Obviously, k1 visa should not have those vocabulary. Just some food for thought, in case you even think to try it. Any ounce of risk is gamble, and it's serious bust if it happens. Just follow the anti-nike slogan. Just DON't do it.

  8. What is the fastest way for siblings to come to america with US citizens sponsor? My wife is now US Citizen and would like to sponsor her parents and her siblings. One sibling is single. Another is married with a baby. Another is a single mom. How can I file paperwork for them all? Anyone had experience this or knows the eligibility of sponsorship of this type.

    Case 1: US citizen sponsors sibling (~12+ years.)

    Case 2: US citizen's parents sponsors with green card status for their children(what is wait time?)

    Case 3: US citizen's parents become US citizen then sponsors children. (~5+ years to become US citizen granted pass US interview test + 1 year i-130 wait time)

  9. My wife will become US citizenship soon. She wants to sponsor her siblings. One of them is unmarried. Another is single mom. Can the i-130 be used to sponsor all of them? In addition if so, what documents are needed, birth certificate from everyone. I heard it's 10+ years for wait time. Anyone has gone through please provide insight.

    Case 1: US Citizen sponsor sibling , what is wait time?

    Case 2: US citizen sponsors parents, parents become citizen(~6 years time?), sponsors daughter/son, what's the wait time?

    What's the fastest way?

  10. The moving part would be the problem I suppose. Married in a same-sex marriage state and residing back at a civil union state. Unless move permanently to the state that allow it. Anyone know if this is the law?

  11. Illinois does not allow same sex marriage but allows as civil union. I found some information and this voids the notion of marriage.

    Couples who have a civil union will not have any of the protections or responsibilities federal law provides to married couples. These include social security survivors’ and spousal benefits, federal veterans’ spousal benefits, immigration rights associated with marriage, federal spousal employment benefits, the right to file joint federal tax returns, exemptions from income tax on your partner’s health benefits, the federal exemption from inheritance tax, and many other federal protections which are denied same-sex couples whether legally joined in a civil union or a civil marriage.

  12. I have a female family member who would like to file for K1 visa for fiance of same sex marriage. I reside in IL and would like to know if this is possible. My big question is how would the VN consulate view the K1 visa. As the word 'engage' would mean intent to marry. However, the actual marriage would in the US, not VN. Anyone have an experience if this is even possible?

  13. sorry to hijack, but I'm trying to understand this a bit...so a copy of the birth certificate as long as it's notarized is fine?? and everything has to be in English?? nothing has to be translated to Viet?? Thanks, Long

    You don't even need to translate it. Viet or English is fine. My original birth certificate is in Viet. I just copied that. I just went the extra step. I took the original and got it translate into English. I didn't want the risk of it being lost. They never saw my original birth certificate but they have copy of it. The consulate actually want the original and a copy. Hope this explains it. Don't worry about the translating, it is not needed . They can read Viet and English

  14. I was also against the birth certificate but luckily they didn't make a deal out of it. I'm Viet Kieu so I had it translate to English notary stamped and copy the original birth certificate. It is not an issue that you can't be there. When submitting documents I had a binder with tabs labeling each section with a Table of Contents. So when they ask for the document she can easily locate it quickly. I made sure she knows the document names so I label it English and VNese. Best wishes and good luck for both of you guys!!

  15. First of all the K1 visa is expired as soon as she arrives on US soil. Secondly as long as you marry her before I-94 expires(90 days) she can stay in America. The GC process can take from 3 - 5 months. Your next step is to file AOS. In order to do that you need to follow the guidelines here in VJ. Obtain all the documents and file as soon as possible.

    Since the case was not approved last month and we could not re-united as we had wished for, I may go back to VN to visit my wife in a few months.

    What would be your advice (what to do before, during, and after the trip, etc...) so this trip would also be helpful to my case?

    You were in AP and now the case is not approved? Do you mean you are still in AP and now wants to add more evidence to your case?

  17. I would have never mailed anything to the consulate. I sent it to my wife via USPS Express mail takes about 1 week. It cost $30 for a few pages. We also responded to blue slip with 1/2 information from petitioner and 1/2 information from beneficiary. Once she had all the information for blue slip then went to consulate to turn it in.
