  1. In case anyone care for a follow-up, we didn't add any more evidences. And we receive a notice for biometric appointment.

    What usually happen is your application get accepted, you get your biometrics, you go to your appointment, and then they will take months to decide on your case, either send you an RFEs for more evidence or just approve your case...

    So, you can still get an RFEs even after you do your biometrics...but hopefully you don't! :)

  2. I am a fellow ROC July filer...Recently received my Green Card! It was totally a smooth ride for me. I didn't go crazy checking my status online...i think i only checked it twice throughout the 8 months and out of the blue i received an approval letter and a green card a day later via priority mail. Woot Woot!

    Congrats to everyone that already received theirs and please hang on tight to those still waiting for theirs!!! :dance:

    I would add my timeline, i tried but didn't work so i put it under my signature, if anyone would like to help me do it, it would be awesome! Thanks in advance!

    Date of I-751 = 11 July 2012

    NOA Date = 16 July 2012

    Biometrics = 10 August 2012

    Approved = 5 March 2013

    GC Received = 9 March 2013

    I know some who hire a lawyer because they don't have time to do the paperwork and they think that by hiring lawyer, it makes it easier for them and give them "a peace of mind" - and they have the money to do it. But SOMETIMES, that backfires.

    If your SIL agrees after reading the positive comments about DIY AOS application, you have to do extensive research and do many readings, but at the end, it's really easy. All the instructions and samples are there for guidance. VJ forum is like - Site for Dummies as opposed to the Book for Dummies.

    I managed to adjust my status by filing my own paperwork, and having my husband counter-check and making sure I have the right information for each forms that we filled. I really thought I would receive RFE's because I might have some missing evidence or information, but thank god, none of that happen, and my case was adjusted smoothly (as you can see from my signature). We completed all the paperwork within a week, after a month of extensive research and reading.

    Bet they give him an interview and it's not my problem. Thanks guys for the nice words. Hopefully I get a txt message soon or a phone call from the IO, that would be AWESOME!

  5. Thank you!! I got approved! :D It was a weird interview, he didn't ask us any questions just read from the application. Didn't ask for any docs. not even our driver's license or passport...Nothing!!! I posted my review on the May filers thread.

    I hope that you will get the approval notice this week!!

    Congrats Hoppla! Oh man, I think I saw the VERY tall guy...he interviewed people fast and im glad you weren't hassled like I did! :dance::dance::dance:

  6. Hey guys, congrats on all your approvals. Walaa and I still are waiting for a decision, it's been 2.5 weeks. Sorry I was MIA, I was actually in the hospital, stomach flu and extreme anxiety/stress.. go figure! thanks INS. Baby is fine, I am just taking it easy but I am recovering, was off work for a week. I hope to get things back to normal starting monday... GOD WILLING.

  7. The original plan was to live in England, but she does have a 4 year old who is autistic and when we talked more recently we decided its best to keep him in his current environment for a few more years at least.

    Oh yea, I agree, when you have a child who is autistic, it is best to not move to another country, a change of environment really makes alot of difference for him/her. I know of a friend who still had to move back home cos of her autistic son behavior had became worse upon moving to the US.

    And about the VWP, i came on a VWP and yes my IO had asked me the question of intent but didn't drill me further about it, just asked the question of "Was your intention to come to the USA to stay?" and I replied, "No." And I began to explain the situation but she didn't want to hear the explanation.

    I think paying for an extension will have you fork out more money than needed for the overall process. You will be paying about 1.7k in total instead of just about 1.4k since you would have to pay $300 for the extension of stay (Form I-130 cost $355 (additional of $55). I had a loan from someone for my AOS cos I didn't want to risk anything - you never know what they might use against you. Plus, being on VWP, it's REALLY risky to extent since we both know that it's strictly 90 days.

    Do they both (i-130 and i-485) need to be sent in at the same time? Or is it possible to do just the i-130 alone to get a temporary extention or whatever it does, and then later file the 485 for permanent?

    If that doesnt make sense its because i dont fully understand what the 2 forms do....the 485 is self explanatory, its for a permanent change.... but the 130...what is that for exactly?

    It is very IMPORTANT that you send both the I-130 and I-485 concurrently, which means, at the same time, in a very big envelope. Inside the big envelope - it probably best to have the I-130 in one envelope, and the I-485 in another.

    I-130 is for your wife - who is petitioning for you.

    I-485 is for you - the beneficiary.

    Look through the AOS guide and follow what you need to include in BOTH packages. The guide really HELPS ALOT. Not a MIMIC or false one. I followed it closely while I had to prepare for mine AOS.

    If you look through the guide, it will says you would need TWO seperate checks for I-130 and I-485. Please read the AOS guide, as well as the USCIS site, to make sure you have the correct edition forms filed and the latest in the fees.

    Oh, you need to remember that you have to file for the AOS before your I-94 expires, which means, you have to file before October - which means - you have two months to gather all the evidence and supporting documents.

  9. Yes, Darnell is right - there's two route you can choose:

    1) CR-1 visa route

    or

    2) Adjustment of Status (AOS) route

    Number 1 is - You HAVE to go back to England and wait, if you had the intention of staying longer since your wife is already 9 months pregnant when you came.

    Number 2 is - You HAVE to stay in the US after you file, you CANNOT leave the USA until a decision has been made to your case - you could apply for Advance Parole if you would like to go back to England if there's emergency, but most would advice to just wait out for decision on your AOS application. You DO NOT have to file an extension of your stay if you apply for this. You will automatically be a legal-INS-alien awaiting for decision on ur AOS. BUT with this, you would have to PROVE to them that you didn't have ANY intention of staying and adjusting status prior to you coming to the USA. They might ask you and they might not during the interview.

    Also, you could see other VJers' visa timeline in their signature, like mine, if you like to estimate the time it takes.

  10. Well, your case is kinda tricky, you filed seperately but on the same day, to the same P.O BOX but they can really be strict if you don't file it concurrently (i.e you have to have one big envelope and inside are two big envelopes (for I-130 and I-485).

    Your I-485 has already been rejected and now, they ONLY have your I-130, if they process it, your whole AOS application might get rejected even if they didn't reject your I-130. (Reason being that you didn't file concurrently)

    I really hope, when you receive your NOA receipt for I-130 and when you send it together with your I-485, it won't be a problem. (To tell you the truth, technically, it kinda is a problem since they will still receive the I-485 seperately from your I-130).

    So, in this case, it might be best if they didn't cash in all your checks and return you back the 1-130 as well, so you could file BOTH concurrently in the same big envelope.

    To make a very long story short, I will spare most of the details and summarize it all up.

    I had my interview yesterday in Irving, Texas and it was a 2-hour long process. Overall, it was a really good and learning experience even though we were seperated during the interview. Our seperation was based on the lack of evidence, as well as we got married too short of a time and they just wanted to make sure there wasn't any fraud and that our marriage is real.

    When she said she will be conducting a seperate interview, I felt like tearing up and my husband almost cried too. The IO who interviewed us is really good at her job. She interviewed my husband first while I waited outside. We were both asked many questions like -

    1)Who lives in the house?

    2)What was the last movie we watched?

    3)Who pays the bill?

    4)Our first date together?

    5)Where did we first meet?

    6)Where do we usually do our groceries shopping at?

    7)The name of main intersection road where we live at.

    8)What did we do on 4th of July.

    9)What did we do on Valentines day

    10)Number of people who attended our wedding.

    11)The last time we were intimate together.

    12)Have we ever go for vacations or short trip together?

    Among many other questions...but no question was difficult at all that we couldn't answer. Just that we're both horrible at remembering the exact dates of events, and we roughly gave the estimation of either "2 weeks or 1 or 2 month ago" etc... :bonk:

    As she concluded the end of my interview, she went out to call my husband and we were seated together in her office again. She explained to us that interview usually doesn't take as long as ours did but the fact that we lack of evidence (we pretty much only had our bank statement), that we are married such a short time upon after meeting each other and she just wanted to make sure that everything was real. She also said that the seperate interview was nothing compared to what they will drill us IF we lack of evidence (because 1 and half years is sufficient time for us to gather all evidence required to lift the conditions) when we file for my ROC.

    Oh, before she seperated us for the interview, she mentioned that after the interview she will look through our application again and make a decision about our AOS and I will receive the decision via mail.

    After the interviews, she said we both did pretty good during the seperate interviews, even though there were inconsistencies to some of our answers but she said she won't penalized us for it. Then, she went ahead and told us that she will APPROVED our case because everything looks good and I will receive my card in the coming weeks. She went on to explain about the conditional green card, and even wrote down on a POST-IT what we have to file and when we have to file for our ROC after my husband asked how to go about in filing the ROC. :)

    As of this morning, the status for my I-485 that was always at the Acceptance status got jumped to Card/Document Production. :star:

    Lastly, we really THANK GOD for being there with us during our interview. Even though the decision was up to her hands, we believe God already made the decision and planned what is ahead of us. We just have to believe in Him and have faith that everything will be okay and that He is taking care of us. =)

    Question guys, why do they take your EAD and Advance Parole Document?

    So is it advisable to apply SSN when your EAD arrives before your interview so you'll have your SSN earlier? :unsure:

    Cos you don't need AP and EAD anymore once you have a green card in hand which allows you to do both...hehehehe...but on the other hand, i would love to keep it as "souvenirs" lol, esp the EAD card cos I love keeping cards with my photo ID on it..lol

  13. Good luck to you all for the future. I received my denial letter today (I explained it on my other thread). I don't have anything to worry about now, well apart from possible removal procedings if I don't leave within 30 days :help:

    alanakaja...i didn't read the threads why you've got denied but i'm curious to know whether they rejected your I-485 because you didn't file concurrently with your I-130 (that's why the I-130 got approved but not the I-485).. i'm just seeing your timeline and you had filed those two seperately, it might be in their system or the way they do it that if you don't file together (concurrently for both forms)for AOS, one form will just be processed and approved and the other denied because for the simple fact that you didn't file concurrently...
