  1. I married her mother in 2010 (K-1) Visa and step-daughter (20 years old at the time) arrived from Philippines later in 2010 as well as K-2. Daughter received her 2-year Green Card and then departed back to Philippines October 2010 with an approved re-entry permit. Daughter returned back to USA November 2011 (399 day duration out of US). No problems with re-entry and subsequent 10 Green Card issuance after she returned from Philippines. Since October 2011, she's traveled back to Philippines once for 28 days and several trips to Canada, mostly weekends but one 10 day vacation to Canada. If I removed the 2010-2011 trip to Philippines, she have a total of 67 days out of the country over the last five years but, I dont think eliminating the 399 days in Philippines is correct.

    My math may be faulty but five years from today is March 14, 2011 and she returned from Philippines on November 19, 2011. Doesn't that time fall within the 5 year period and you'd need to include it?

    Need to check with forum members to make my calculations are correct. My wife is now a US Citizen. Her daughter arrived as a K-2 in 2010 and received her Permanent Resident status (green card): 09/08/2010. She returned to Philippines to finish her University studies (399 days) and returned to the US in 2011 with a re-entry permit in addition to her green card. She has since received her 10 year Permanent Resident status. Over the last five years she’s had one 28 day vacation with us to Philippines and a few trips with us to Canada for holidays.

    My understanding is that she needs 5 years before she can apply for Citizenship with 30 continuous months in the US without leaving the country longer than 6 months in any given period in order not to reset the ‘continuous clock’ again. I may have this incorrect. She has the five years and I believe she meets the 30 continuous months but again, I want to be sure before we send the application and fees in for processing. Please let me know your opinion.

    I am completing the N-400 with her and below is her total time time out of country. The longest period was the 399 University period, then a 28 day trip back to Philippines for vacation and several trips to Canada for the weekend.

    Total Days of 24 hours or longer spent out of the US = 466 days

    Total trips out of the US during the last 5 years = 10

  3. Provided she had no income of her own, this is fine. Make sure to list her name and SSN as a dependent (I am sure you did)

    Even after they have a job they can still be claimed as depedents on your taxes AND file their own return. On their return they need to check off that they are claimed on another person's return as a dependent. We claim both our K-2 sons as dependents, they both file their own tax returns also.

  4. My stepdaughter, arrived in the US on a K2 in 2010. She returned to Philippines later that year to complete University and using a reentry permit came back to the US last year without any problems. In 2010 and for last year's taxes in 2011, I filed her as a dependent child with her SSN on my joint Federal tax return.

    Now that I've filed our 2011 Federal tax return, I'm wondering in retrospect, if this is adequate for my stepdaughter's federal tax return requirement? It would seem so to me but I'd like to know what others think. If I have her listed as a dependent for the 2010 & 2011 Federal Tax Return with her SSN, why would she need to file her own tax return when in fact she had no income, was a student and dependant on us for support, tuition, etc.? In 2012, she will be working and will no longer be our dependent and need to file her own Federal Tax return.

    vj is a big help on us since we started our process ,upon receiving noa 2 we call nvc then we have our confirmation that case was sent in manila,then after 3 days i call manila embassy and scheduled my interview and pay the bdo ,then after i attended my cfo seminar ,i take my medical 1 week b4 my interview.my interview went well because of the arranged documents that i have and i would like to thank the vj and vj family for the 1st hand info i and my fiancee got from here it saves us time of waiting thank thank you so so so much...

  6. hi. i'm an LPR (came to US on K1). i'm now here in PI to get my 2 kids who are below 21 yrs old (on K2).

    my question is, will i need a Cenomar (certificate of no marriage) for my 20 year old daughter for the interview? i hope to be able to get the interview/visa stamping done with no problem as she is aging out in july. we need to do her AOS soon as we get back to US.

    I had my 20 year old step daughter get one. She now has the K2 Visa and will be here in 2 weeks. She also has the CFO stamp.

  7. Good day everyone, but I'm definitely not good, I'm piss with this doctor. If anyone who's near tacoma, puyallup, federal way or WASHINGTON AREA. Don't be fool that this Dr. Renato Fajardo charge very minimal amount with your transcription for AOS. If you request for transcription, he will seal lacking forms or I-693. Just be aware of this silly doctor!!! He doesn't know what his doin definitely. I trust him because he is a Filipino, but no, Filipinos that do business don't care if you are a Filipino.

    Now I did the whole medical thing because my husband wants to be sure that there's no possible RFE. But take note I'm still good for just a transcription because I'm not over a year took the whole medical thingy.

    I took my new bride to have her I-693 transcribed along with a couple need vaccinatons to this doctor. Everything seemed very professional and on the up and up. I sent her papers in this week. He provided her papers in a sealed envelope for the I-485 Application. I have no reason, at this time, to doubt his capabilities. I live in Federal Way so it was very convienant.

  8. My 20 year old step daughter will be coming to Seattle mid-april on a K-2 Visa. Does anyone know whether a K2 Visa holder is requred to take the PDOS or CFO seminar? If so, are you required to register in advance?? Thanks,

  9. My Fiancée arrived last month via her K-1 and we recently married. My Stepdaughter arrives next month via her K-2. I'm now assembling and completing my wife's AOS to send off next weekend.

    One section of the I-864 Affidavit has a question that is driving me crazy: Part 3 #9: Information on Immigrant(s) you are Sponsoring. At first I did not check the box (question #9) but if you read it thoroughly, it states "I am sponsoring the following family members immigrating at the same time or within six months of the principal immigrant....."

    Since her daughter will arrive via her K-2 next month, perhaps I'm required to check this box and list her on the form?? On the other hand, the next sentence states "Do not include any relative listed on a separate visa petition. These two sentences seem to contradict each other.

    I will have to send a complete AOS package for the daughter which will include an I-864 so I'm wondering whether to include her on her mother's I-864 or not. Any advice is appreciated. Thanks.

  10. I am completing the I-485 Form and have a question regarding Part 3, section B. My step daugther will arrive next month on a K2 and I will submit a separate I485 Form (and other docs) after her arrival. My question is in regards to "Part 3 Section B-Applying with you?" I assume since the daughter is following to join and must submit her own I-485 that the answer is "No"?

    Perhaps the answer "yes" is for the situation where people are applying together on the same I-485 form at the same time? Thanks.

  11. Thanks. For those who never flown out of the PHILS in their lifetime, perhaps a non-stop flight is the way to go. Step in the plane in Manila and step out in Los Angeles. However, I suspect their is still a lot of angst for someone who's never left the PHILS just going through the Manila international terminal check in, the security checks and etc etc...

    I flown so much internationally, I have a tendancy to forget or imagine what it might be like for a 20 year old teen age Pinay leaving the country by herself and alone for the very first time on a long flight to the USA. She would prefer to fly with a relative to the USA I suspect.

  12. I've been in and out of the PHILS many times but always on Northwest Airlines, now Delta. I understand Philippine Air offers non stop service between MNL-LAX, about 13 hours. Is it really non-stop or, is realy with a stop in Hawaii?

    Yes, I'm not sure she will sleep tonight. She's moving to Seattle in two weeks herself so there is all that saying goodbye to Canada and her friends stuff, then a week or two later the daugther arrives. This will be the frist time they've lived together fo many many years. For me, it's an adjustment of two women and also for those two adjusting to each other. I think thier adjustment will provide some comic relief ad drama at times but I could be wrong. In any case, I wont understand the fast track Ilocano conversation between them and my "Guy" house will probably be rearranged at least 5 times while I'm at work.....
