I see what you mean... My J1 expired in Jan/09... I applyed for the extencion on Nov/08... I was Denied on March 25th 09, but they only sent me the notice on Apr 24th 09... I left on mAy 16th 09... They can say I overstayed around 4 months in the USA.

I'm just worryed because I never meant to overstay. I did everything right, the way I was supposed to...

I just hope they give me the chance to show all the documents and prove everything.

I actually applyed for the B2 visa in November 2008 and my J1 expired in Jan.2009.

My visa was denied on March 25th. But I only really received the letter on April 25th. So I bought the tickets and left the country as soon as I could. I left the country on May 16th. So that means was illegal in the conuntry for 3 weeks. Nothing close to 180 days.

So should respond yes, but it will still be fine right?

my interview was schedule for a K1 visa already I'm filling out the forms and I have doubts.

I've lived in the US for 2 years with a J1 visa. After that I applyed there for a change of status for a B2 (visitor for pleasures), after my a few months I received a letter saying my visa was denied and that I had to leave the country in 30 days. The problem was that my visa was denied on March 25 2009, they sent the letter for the wrong address and then just sent me the letter again to the right address one month later on April 24th. I last the Country on May 16th.

Now I'm filling out the forms and there is a question on DS-156 that say "Have you ever violated the terms of a U.S. visa,or been unlawfully present in, or deported from, the United States?"

I don't know if I should check yes or no... Because do they consider the day the issued my visa denial or the day I received the letter?

I have prove that they only sent me the letter one month later. I have prove that I left the country only 3 weeks after I received the letter...

I'm really worried about that...

Do they give us options of dates? Or they just say when we have to be there?
