  2. Just to give everyone an update...if interested. The explanation letter apparently worked as we got a notification that our case was completed at NVC on Oct 18, more than 2 months after we sent in our DS230- :(. Now we have to wait for the interview to be scheduled, for which supposedly missed the scheduling window for November (first two weeks of the previous month - grrr). I wonder if this will be brought up again at the interview....I still don't understand why on our case completion letter the "Country of Chargeability" is still stating Libya....As I understand, this has no effect on spousal immigrant visas, so I'm going to ignore it. It still is bothersome though....thoughts?

    yes i was aware of the instructions posted there (they were also mailed to me in the RFE checklist response letter)...but the trouble is I don't know which government authority needs to say that it is unobtainable? The Libyan birth records? How would I even attempt to approach an institution of which country I'm not a citizen of? Even if I could, through my country's consulate/embassy, it seems like a very long, drawn out process which could possibly take months...why can't they just accept an official birth certificate that is issued by the country of nationality...they obviously verified my birth at the time and are issuing an official document saying so - why is more than that needed...it seems funny that secondary evidence such as a parent's affidavit would hold more weight than an official government issued birth certificate...

  4. Category: Police Clearance Certificates (PCC)

    My stupid RFE was:

    for the Police Clearance Certificate (PCC) of my wife's country of nationality in which she hasn't lived in since 2002. We only sent her current residence country's PCC which apparently wasn't enough.

    I guess I misunderstood the very confusing (and badly written) instructions posted here: http://travel.state.gov/visa/immigrants/info/info_3195.html#police

    Lesson learned:

    Get a PCC from any country in which you've lived for more than 12 months after the age of 16 and especially of the country of your nationality if you lived in it for more than 6 months after the age of 16 even if you haven't lived there in years. Makes sense?

  5. You may or may not have noticed that you inadvertently replied to a post made on April 10, a post that is nearly 4 months old.

    It should be quite clear to you that 'timelines' reported are only accurate in the 'time that they are posted.' NVC, just like USCIS, goes through 'slow and quick' phases.

    sachinky, i've searched all over....how can one find what the current estimates are for RFE processing? I sent our RFE on September 15th, 2010..the AVR says they received it on September 20th and to allow 6-8 weeks. Tomorrow will be the 10th business day from September 15, so I guess we are still in the "slow" phase that you mention. thanks for your help.

  6. We found a copy of the Libyan birth certificate and we only knew it was a birth certificate b/c his mom wrote copia di certificato di nascita in the upper right hand corner! So I guess we'll get the letter or any record available from Italian consulate in Tripoli. Then onto the PCC for Maldives - Maldives says that hubby will not register in the system since he has been Italian resident, never of Maldives, so maybe they'll give him another letter and our RFE's will all be addressed with silly letters from around the world!??

    Hello RPS, I was just wondering if you could tell me more about your experience of getting the original Libyan birth certificate from the Italian consulate in Tripoli. How long did it take? We are in a very similar situation as well. My wife was only born in Libya and is not a Libyan citizen. Her parents were there due to work at the time. She only lived there until 2 months old and was registered with the Serbian embassy and since has always recieved a Serbian birth certificate from the ministry of foreign affairs. However, we got an RFE about a month ago from NVC requesting a Libyan birth certificate?!?...we've since put in a request with the Serbian embassy in Libya, but they say it takes months to get the original birth certificate from the Libyan governemnt....we are hoping there is a way this can be expedited...any tips? Please elaborate....thank you very much for your help!

    We recently submitted DS-230 with all the required documents. NVC replied saying that the Birth Certificate I submitted was not an original. I was born in Libya to Serbian parents (Serbia is my native country) and they registered my birth at the Embassy of Serbia in Tripoli, Libya. Since then my Birth Certificate has always been issued by the Ministry of Foreign Affairs in Serbia. I cannot obtain a birth certificate from Libya as I am not a Libyan citizen. Is there anyone else in a similar situation? Would a letter of explanation be sufficient since I have already submitted the only original birth certificate that I have?

    I would be very grateful if you could post your comments and suggestions.

  8. thank you everyone for the insight and input. i am very grateful for it.

    ultimately, i am hoping that they will be able to tell the country of my wife's residence just by looking at the current address that I provided on the petition and additionally once we receive NOA1&2 and NVC takes over the case we will make sure to point out to them our situation.

    now comes the true test of patience. waiting for the petition approval.....we will use the time wisely to gather up all of the docs necessary for NVC process.

  9. I-130 form, block 22. RIGHT SIDE of the form.

    Oh no! please don't tell me this is the only place to indicate that? I already sent the I-130 petition with an N/A indicated on both fields under line 22 as I dismissed this line thinking it does not apply to us since she does not live in the US and I thought she was eligible for AOS.

    But now reading it over again I'm kicking myself for not including the info anyway and letting them dismiss it if they felt it was not applicable. Oh man. not a good start!

    Any tips on making pre-emptive corrections to an already sent form?

  10. I've been scouring the VisaJourney forums for this topic and have come up empty. Not to mention coming up empty on any FAQs or help pages on the USCIS and NVC websites regarding our situation.

    I am US Citizen and have recently gotten married to my foreign national wife in her home country while we were both there visiting family. The twist is that she does not live/reside in her home country. Due to her work she lives in another country. I just recently started the process by filing the I-130 petition here in the US, but in looking ahead and preparing for the remainder of the process we were wondering which embassy/consulate (her home country's or current residence's) will be handling her case and eventually calling her for the interview etc.

    From what I can tell, all of the documentation required for the interview will have to be collected by us, so it doesn't seem like it would matter in which country she resides. As long as that embassy receives our complete DS-3032, DS-230 and I-864 packages which contain all of the pertinent information regarding her it seems like this circumstance should not compromise our chances.

    Any insight or shared experiences will be very much appreciated.
