Hello Everyone,
I am a US Citizen and Married to a Canadian Citizen. My Wife has a US Green Card from Last 5 years and Canadian Passport. However After Marriage both of us moved to Canada. Both of us are filing Tax Return every year. We both have a bank account also in US. We have one child also born in Canada, however he Is also a US Citizen by CBRA. Is there a way to apply for a US Citizenship for my wife by not meeting the residency requirement? Or Does she need to stay in US for 18 months out of 3 years to meet the residency requirement?

I got a conformation from the US Consulate General Toronto saying "You may transmit US Citizenship to your child if child is born to US. Citizen Parentand you have lived in the U.S. for 5 Years at any given time. It is irrelevant on what status you had as long as you were physically residing in the US and you will have to provide document in support of your claim"

Thank you all for your response. It really helps a lot. I really appreciate everyone for their response and finding out the solution. I am happy that i can get the citizenship for the baby as i have stayed in US for total of 13 yrs including PR and as a US Citizen.

My main purpose of getting child an Citizenship is for the future purposes. If he would like to go to US for further study or job or if he would like to stay in US and settle down than he can easily do so.
Even if i stay in canada, i do a consultancy job in USA and i do file a tax return every year in USA. Does that help getting the 5 years line or help getting a Citizenship?

I Came to US in 2000 and now i am US Citizen from End of 2009. However I have moved to Canada in 2013 Visitor Visa and Still living in Canada. I have received the Canadian PR Card also. My Wife is a Canadian Citizen and She also has the Permanent Resident Card of US. We have given birth to baby in October 2016 in Canada. Can you please let me know if my child can get the US Citizenship or not? As I have not stayed in US for 5 years as a US Citizen. If not what is the other way to get Child US Citizenship.

Finally got NVC Acceptance Email after 15 days. So Looks like NVC is working on July 11th Email right now

Hello,
I have send an email last week to NVCElectronic@State.gov with Petitioner's and Beneficiary's Name, DOB and Email address and also lawyers' information. I did put OPTIN MTLXXXXXXXXXX case number on subject line. However I have not heard anything from NVC Electronic to see if I got accepted to NVCElectronic Processing or not. My wife's consulate is in Montreal Canada.
I have paid AOS and IV Fees online and it shows paid. I have also filled out DS260 online just need to hit sign and submit. Also I-864 is ready to scan and send it to NVCElectronic, if they accept the electronic processing for me.
Can anyone let me know how long does it take for NVCElectronic to respond back? Or is there anything I should do to expedite it?

damn the next appoitment was July 11th. and i don't think my case was trasnferred to local office. i think it was still with NBC

Yes I did call USCIS and talked to IO. They did open up the service request and said wait till July 9th. Does that mean My case will be transfered to NVC by than?

How do you contact Congressman and Senator? I am from california. How would they help expedite the case?

Call USCIS and have them create a service request for your file. I am waiting from 91 days and still NVC have not received the file. They open the service request for me and said in two weeks, file will be with NVC.

I have been waiting for 89 days and still no NVC Case #. USCIS told me to wait for 90 days before they can do something, which will be tomorrow.

Hello All.
I received NOA2 approval notice on March 28th, with the Notice Date March 25, 2013. I Called NVC many times and ask for the NVC case number, but they have not received my case yet. They ask me to scan my approval notice and send to NVC inquiry to find out where the case it.
I sent an email to NVC Inquriry. See below:
"Hello Sir/Madam,
I have received the I-130 approval notice, and would like to know what
is my NVC case number. Please find attached I-130 approval notice for
your reference.
Petitioner Name: XXXPetitioner Date of Birth: XXX
Applicant Name: XXX
Applicant Date of Birth: XXX
Please reply back per your earliest.
Thanks"NVC's Response was following:
"Dear Sir/Madam:
The National Visa Center (NVC) received your inquiry regarding the

The correspondence submitted is currently under review. An appropriate

Serco Inc, Support Contractor"Has anyone else seen that kind of reply? What does that reply mean? Do they have the case number and will send the appropriate documents to me? or Are they still looking for my case in their system? how long should i wait till i receive more response from NVC?

What are these dates in your timelines? Are they correct?

I-130 NOA1 : 2009-12-07
I-130 Approved : 2010-02-22
NVC Received : 2010-02-25
Hi Deep,
Those are different date for different I130.. That I 130 has been approved.
Here is the current time line for the I130 for my wife
I130 Sent - January 31st 2013
I130 NOA1 - February 5th, 2013

The theory is that this is the notice you get when your I-130 petition has been approved by your local field office, and the "appellate body" they've shipped it off to is NBC. Basically your field office approved your petition and sent it off to NBC for the final word. NBC is where the official NOA2s are given out. Congrats!

I would really appreciate your help on this. Today when i check on USCIS website following message shows up for I130 file for my wife:
"On March 25, 2013, we mailed you a notice that we certified our approval of this case and sent it to the appropriate appellate body for review. They will notify you directly when they make a final decision. If you move while this case is pending, follow the instructions provided in the notice and use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to be addressed either during an interview or by asking the applicant/petitioner to submit additional information or documentation. USCIS reviews the applicant's/petitioner's criminal history, determines if there are national security concerns that need to be addressed, and reviews the application/petition for fraud indicators.
If you have filed an I-485, I-589, I-751, N-400, I-90, I-821, I-131 or I-765, you can expect to receive an appointment notice to appear at an Application Support Center to have your fingerprints and/or photographs taken. The timing of your appointment is determined by the number of applicants ahead of you that also need a biometric appointment. Could you plz let me know if my case has been approved or not? If not, how long does appellate body take to make the final decision?

ya i got a RFE from NVC on August 5th (it took them 7 weeks to review the paperwork) regarding Birth Certificate.. Now i probably have to wait another 6 to 8 weeks i guess.

I just called them to see if my sons case is completed after sending back the RFE which they have had for 2 weeks now and was told they or back logged..call back in 6 weeks Because they need to review it before they can tell me the status.. the girl said they got double the amount of application and are behind.
I guess all we can do is wait wait and wait... Waiting time is killing me.. its been 6 week already

Yes Both of us are living here for 5 years. She is Canadian Citizen so she is allowed to take the health care system. She has traveled to US with Green Card back and forth and sometime more than 1 year and the officer did not say anything about loosing the PR Status.
