  1. The NVC does indeed give a deadline for petitions and they have an expiration date. This can be extended but as far as I know it can only be extended to one year maximum. I would escalate your query as others have said to try and confirm but at this point I would be making sure you met the requirements for a K visa petition in preparation to start again

    I was told multiple times by multiple agents that there is no expiration. Even on this last call he told me it is up to the embassy and as long as there is activity then it is extended. I mean when I give them the case number they find the file just fine. Do they keep those indefinitely? It would seem very unfair to makes us start over. I could see having to refile, but I would have to lose money and work to fly there (we're past the 2 years for the petition requirement). Then pay all those fees again... ect. ect...

    Maybe what's best is to have her set up an interview... I mean if they allow it then the petition is fine right?

  2. NVC gives a deadline of one year from the date of your approved petition to finish and complete your visa processing. Once this period expires, you have to do the process all over again; unless you have received a formal approval to extend your petition up to a certain future time.

    It is very easy to call on the phone, but there are situations when you need a hard copy from them so that you may use this to back up your claim. If I had been in your situation, I would have written them a formal letter so that you go past the "call center people" to either a manager or supervisor. At this point I would write a formal letter to the US Embassy holding your Visa, and also the NVC.

    So who would I address it to at the embassy?

  3. Okay first things first. Our petition is old. Lets just say we had a financial dry spell that was unexpected and now things look good to move forward.

    I received notice from Manilas embassy that they received my approved petition on May 19 2010, I have been in contact with the embassy many times to confirm the status of our petition, I have explained the situation and all has seemed okay. Until December of last year. That's when it seems there were some changes at the embassy, and instead of talking with someone at the embassy I get what I guess is a call center.

    IN January I requested the status of my petition but received a vague response. Something to the effect of. "Oh, yes sir. I see it here."

    "Is it still good? has it expired?" I ask

    "Let me check sir....... sir I am going to escalate this request."

    "What's escalate, is that bad?"

    "No sir, I am requesting a response to your question"

    "how long will that take?"

    "I am sorry, cannot estimate that"

    Anyhow.. no response. so 3 months later I try again..... Same thing happens.

    Then June I try again.... guess what? nothing... no answer just escalation again...

    Then I call again today (AUGUST)I ask the agent. "If it is expired do they tell us or only if they find it to be good?"

    "Oh, sir, they will tell us yes or no, but there is no reply as of now"

    SO AFTER 8 months... no reply.

    Am I at the mercy of this system?... can anyone do anything? Is it a matter of involving my congressman at this point?

    I just have no idea what to do.

  4. Better read the Guides and the K-1 Timeline again because you don't seem to understand the different steps in the process. There are documents you need to get together to send to her now before the interview and there are things she will need to do prior to the interview. Get moving.

    Oh I have read all that, and just was confused that there are several times things are "approved" I already have all the originals in a packet ready to go and the affidavit of support too. Anything else we need?

  5. I replied for a Request for Evidence (a missing g325A) last month and today I checked our status on the uscis site and it says:

    Post-Decision Activity

    On May 12, 2010, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    But she hasn't gone in for the interview at the Embassy there....and I never sent the originals to her... How can this be? It would be great if true but I'm thinking they made a mistake.

    Do they sometimes forgo the interview in light of evidence?? The only other answer is she handled the interview herself without telling me. I'll ask her later.. but its weird isn't it?

  6. If they don't reject upon reciept - they go through the list to make sure you have all required docs (not that their correct - just that they are in the package).

    However, I think you might be in trouble - I think the date USCIS goes by for the (2yr mark) is when they accept the petition (date it gets past the door) - if that date is after the 2 year mark, they will reject it (later, when they finally look at it in detail)

    Interesting case - I looked at some rejected cases on the USCIS site and saw some rejected when they were only a few days past the 2 yr mark - hope you made it in time.

    They signed for it on the 18th (20th was deadline) and I just saw they cashed the check, looks like they deposited it on the 19th, so i think thats a good sign right?

  7. I spoke with USCIS Customer service last week (feb 16) and the woman I spoke with told me I could send in my I-129F with all of the evidence except my fiance's signed papers and passport type photo.

    The reasoning behind this was Feb 20th was the 2 year point from the last time we saw eachother.

    I sent the packet complete with my G-325A and passporet pics, plus evidence of meeting and ongoing relationship.

    The woman at USCIS said that I could send just the I-129F and the Fee by themselves and that would "get my foot in the door" as far as the deadline on the Two year timelimit.

    Anyone else ever run into this?

    My Fiance is a Flight attendant and it just turned out that everything went wrong this last month with her being able to print out and send me all the forms.

    According the USCIS customer service lady I should be recieving a Request for information requiring the missing documents.

    Does that sound right?

    Also, as a side note. When will the CSC Cash my check for the fee??? Will they do that before they have the completed application or when they recieve the I-129F?
