Yes and the country that it is coming from has to be part of the Hague Convention....not all countries are. I know for a fact the philippines is not part of the Hague Convention.
From the same document I mentioned earlier: "If the document originates in a country that is not part to the Convention, applicants should have the documents certified by the foreign authority that issued it."

IRS office is open on saturday? anyway, what about copy of her passport? I was told without that u cant do anything. Its stated even on IRS site copy of passport required
First of, calm down. We're all in the same boat here. No need to question my words, I've got no reason to lie. Matter of fact, some IRS offices are open one some satrudays. And if you're quoting IRS website, you should quote it right. Passport copy certified with apostille stamp is fine, read it here:

US Certified copies ! And how u gonna do that without passport in the hand? Remember its IRS asking for it, not immigration, IRS will not accept certefied copies made in foreign country.
That is not true. I'm holding "Instructions for Form W-7" issued in January of 2010 in my hands, and on Page 2 it says "You can submit copies of original documents if you do any of the following.... Have copies notarized by a foreign notary. However, foreign notaries are only acceptable as outlined by the Hague Convention." This means it needs to be stamped with "apostille" mark.

Thanks people, very helpful!
Just another quick questions, when creating a barcode for DS-3032 are dashes supposed to be included in receipt number?

So I went to IRS office today and was told that filling married and jointly is way to go. Just add W7 form to your 1040 and mail it out. The catch is that both W7 and 1040 need to be signed by your spouse, and that might be hard for some people. And yeah, you can't use any software and have to do your taxes on paper.
-
Where does it say that you need original passport? That's nonsense. Certified copies accompanied by apostille stamp are fine.
-
I was in the IRS office today. Married filling jointly is way to go, but spouse needs to sing the return as well, and form W7 also signed by the spouse needs to be attached to return form.
-
This is what I understood so far: Basically, we should do taxes as married filling jointly like every other normal couple, attach W7 form and that's it. ITIN is just for future reference and probably won't be needed ever again.
I'm going to visit IRS office today and ask about it. I'll let you guys know what they said.

I just received notification that I-130 for my wife is approved, and she should get NVC package next. I was going through I-130 guide on the frontpage, and I see that this package consists of several forms to be filled out by both of us. How does this work now? Do I fill out my forms (affidavit of support, tax returns, and whatever else is needed) and send it to my wife, and then she includes it with her forms? Or how this works from now on?
Also, I was wondering if any further evidence of our marriage will be asked for, or this is all over with I-130 approval? Is she going to need to submit any evidence with NVC package, or maybe take some to her interview once it comes that far?
I appreciate your responses and your help. Thanks!

Ok, hopefully I can help you to understand this.
If you file 'married filing jointly', you attach a filled out W7 to the front of your filled out 1040. Don't forget to have your spouse sign the W7 and the 1040, their signature is required and your signature is required only on the 1040. You then mail it to a special address. The IRS will assign a number and then mail it off to another department to finish with the 1040. During tax season, it then can take 8-10 weeks to get your refund.
If you file 'married filing separately', you do NOT need an ITIN. You just have to write in 'NR' or 'NRA' (for Non-Resident Alien) in the SSN field on the 1040 when it asks for your spouse's information. Also, the spouse doesn't need to sign anything, you just need to sign the 1040.
In both cases, you'll have to fill it out by hand.
I had an hour long discussion with an IRS agent all about this on Wednesday.
Thanks! I still don't understand the purpose of ITIN number, and why it's saying that I'll get it in 6-8 weeks. Also, what if she's not able to sign these documents since she's obviously not in the US?

Does anyone fully understand how this ITIN stuff works? Obviously, I'm in the same boat as many of you and wondering WTH do I do? Seems like the best way is to fill as married and include W7 form with the return. Now, I don't fully understand if this is all it takes? IRS website is confusing saying that "If you qualify for an ITIN and your application is complete, you will receive a letter from the IRS assigning your tax identification number, usually within six weeks." So what do I do with this number when I get it? Tax return should be already submitted with W7 form which is the application for ITIN. I'm totally confused.

You filed as married, filing jointly. In that case you will need to include Form W7 with your tax return. You will need your wife's passport copies (usually certified copies.) And you must file your taxes via paper. IRS will assign and ITIN for your wife and proceed as normal.
Could you please explain a bit more about how this works? From what you wrote it seems supersimple, just sending tax return to different address and attaching form W7. Now, I'm confused with IRS website where it says that it "takes about 6-8 weeks to get ITIN number" and I don't understand why and what for do I need this number when my taxes are already sent out with W7 form??

I kinda wanted to do that, and I went to Walgreens where I usually get my passport photos to ask if I can bring digital copy of a passport style photo and have them print, and they said no. Do you know if any other store would do this?
-
I'm ready to send I-130 for my wife, but I'm confused with photo dimensions. I-130 instruction guide states that "dimensions of full frontal facial image should be about 1 inch from the chin to top of the hair" but this specification http://travel.state.gov/pdf/Photo%20Guide%2010-01-04.pdf asks for 2" x 2" picture. My wife and I got passport style photos (or so we thought) in Bosnia, but these are about 2" x 1.5" and frontal image is 1" chin to hair, as asked for in the instruction guide for I-130. I don't know what to do now... Do I have valid photos or not? do I send these photos, or do I have her take new photos and have them mail to me which could take 10-15 days
Anyone had similar experience?
Thanks!!!

Pozdrav svima.

2. Dokazi o validnosti braka: Koliko se dokaza salje u ovom "prvom" krugu. Ja cu imati dvije izjave prijatelja, a razmisljam sta bih jos mogao dodati, s obzirom da i nemamo previse onih dokaza koji su navedeni (bankovni racun, zajednicka adresa, i slicno) jer smo se tek vjencali. Ima li kakvih prijedloga? Ponavljam, tek predajem prvi paket za I-130.
Hvala najljepsa svima!

I believe the OP was referring to his wife's lack of an "A" number, in which case NONE would be an acceptable response.
I actually left that field bank when filling in my forms but that was before I disocvered VJ! ( Luckily it went though without any RFEs. )
That's correct. She's got nothing, I have US passport and Certificate of Naturalization with A number shown.
Thanks!

I got married recently and I'm starting to fill out I-130 and related forms. My wife doesn't have any of the USA documents as she never visited prior to our marriage. I got couple of questions some of you might hopefully answer.
1. On form G-325A, what is the file number I'm supposed to enter on the top right corner? If this is Alien Registration Number my wife doesn't have it as she was never associated with the USA, and I don't have one either (at least it's not shown anywhere in my passport). Do I just put "none" for both?
2. Since we just got married 2 weeks ago, we don't have pretty much any of the listed examples of Bonifide Marriage yet, and most likely I will have to go with sworn affidavits. Any help on how these work? I've got couple friends who can write these testimonials, but where do I take these to make them "sworn to" and legally acceptable?
Thanks for your answers.

I am a novice here, and I apologize if this matter was discussed earlier. My girlfriend and I are considering options for bringing her to USA and it came down to either K1 or K3 visa. Now we have to decide between the two and don't really know which way to go. I was wondering what are pros and cons of each? Would it be easier to marry now and bring her as my wife, or maybe start procedure for K1 and get married once she arrives? What would you recommend and why?
Thanks for all your responses.
