  1. Hi it me agian :)

    Im starting to gather the phone records of me and my fiance´ from the time me and him started our relation ship.

    I have all cellphone records from the time him and I started out.

    But I just could print out the phone records for the past 90 day from my landline, so I called my phone company if they can send them to me again. Now this guy tells me, that they are oblogated by German law to delete all phone records after 90 days, for data security reasons.

    What kind of BS is that!!

    Well anyway, him and I also chat on yahoo, but Í cannot get those records because we are using IPhone. We talk some times over skype, I think I´ve some previous records there, but don´t feel so comfatable to show the chat converstaions.

    What should I do now?? This sucks big time!

    Do i´ve to bring the phonerecords of my fiance´as well to the interview or are mine enough?

    I am the benificiary.

    HELP PLEASE

    Ask your fiance if he can get his call records from whichever carrier he uses.

    I was in same situation.. i could get phone records for last 3 months only from my carrier.. but I took call records from my fiance's carrier.

  2. My K1 visa interview was yesterday and it was approved.

    Thanks to all VJ members's advice, it helped a lot.

    I am going to be with my fiance after long K1 petition journey(over a year).

    We had been through lot in our case. NVC did send our case back to USCIS two times for further review by USCIS, which took us so long.

    But trust me if you are honest with consular officer and your relationship evidence and financial support is good then you will get approved.

    Mumbai embassy people are very nice, professional.

    So all the best to everyone who is waiting.

  3. Hi Guys,

    I received Packet 4 and submitted documents to VFS Ahmedabad last week. Interview is going to be in Mumbai.

    Here is quick walk-through about documents needed to submit at VFS for Mumbai Consulate K1.

    1.) DS-230 Part-I

    2.) DS-156 (2 copies, attach photo on both copies on 1st page bottom right)

    3.) DS-156K

    3.) Medical Report - not the big X-Ray one (you need to carry X-Ray at interview)

    4.) Birth Certificate and its copy

    5.) Original Passport and its copy (They will give you back your original passport with a sticker on the back, and they advice not to remove the sticker, its for tracking purpose)

    6.) Affidavit of Support (I included I-134, paystub, employment letter, bank statements, tax returns for last 3 years, letter of intent and letter of support signed by my fiance)

    7.) 2 - 2x2 size photographs

    VFS people closely checked my each forms and pages.

    And once it was done they gave me the Packet-4 Appointment letter back with Receipt of Rs. 387 paid. and stamped AHMD on the Appointment Letter.

    They also adviced me what to take at the interview at Mumbai. She asked me to bring the following at the time of interview:

    1.) School Leaving Certificate

    2.) Proof Of Relationship

    3.) X-Ray report

    4.) Passport (All your passports - old and new)

    5.) VFS Receipt along with Appointment Letter

    6.) Bank Draft for 350$ in Indian Currency. (As of now its 47 Rs = 1$)

    Thats what VFS asked to bring at Mumbai but I am also going to carry original NOA1,NOA2,Letters to Senators and replies from them.

    I am also going to carry copies of all the forms submitted so far , copy of Affidavit of Support and other documents.

    Hopefully this helps someone.

  4. I have been through this twice.. two times NVC sent my case back to USCIS for review. On second time we got senetor's help, and it helped a lot.

    Usually it is some mistake or not enough information passed by USCIS to NVC so they send it back. Sometimes it is a red flag that NVC noticed and they want USCIS to review it.

    So basically your case is back in NOA1 stage. You will have to wait for few months to get your case reaffirmed or revoked. You can get senetor or congressman's help to get the info.

    And dont worry about your Petition expiration date. They will extend it once they reaffirm your case.

  5. Hi Guys,

    My fiance has filed K1 petition for me. I am guessing my interview will be sometime around Octorber '10 as per timeline. And my passport has expiration date of March '11. I think K1 visas are for 6 months validity. I have not been asked to renew my passport.

    But I am worried that should I renew it?

    Should I renew it without being asked? because the petition has copies of the current passport and if I renew it will it create any problem?

    Really need your advise guys.

  6. We contacted congressman/senator to look into it. We got reply from congressman.

    USCIS told them this:

    "the file was returned by NVC because of missing information. Without the review they are unable to find what is missing. (wth???)

    National File Tracking System indicates that A# file is requested from National Record Center(NRC).

    This case will not be terminated at this time since it has not made its way to a consulate for interview.

    The case will be reviewed again and whatever information is missing will be included and the approved petition will be returned to the NVC."

    Basically our case is not going to be expedite.

    What possibly would be missing information?

    Does NVC do background check on both petitioner and beneficiary?

    Share your views please.

  7. For the first time, from Octo '09 to Feb '10, was there a K-1 visa interview at a Consulate which resulted in a denial and the K-1 being sent back to USCIS??? I know you do not say that but I am just trying to make sure all the facts are present.

    Also, did the USC get a request to have Biometrics done?

    No there hasnt been an interview yet. Our case hasnt gone beyond NVC.

    And USC hasnt got request for Biometrics yet. Do they usually ask for it?

  8. NVC doesn't have much to do with approved K1 petitions. My understanding is that they do a quick background check on the petitioner. If nothing comes up, then they forward the petition to the US consulate in the beneficiary's country. A few days to a week is typical. When a K1 petition gets hung up at NVC it's usually because something came up in the background check. For example, if the petitioner had a criminal conviction it might slow things down at NVC.

    Hold off on hiring an attorney unless you get a notice of intent to deny from USCIS. Attorneys don't have any "special rights" with USCIS, unless maybe they happen to have a friend inside USCIS who is willing to feed them information. You have a better chance with your senator's office.

    Thanks for your response friend. I think NVC does background check on Beneficiary as well but I am not sure if I am right. I have read some documents on GOV websites and in most cases they return the case back to USCIS if they believe the petition should not have been approved. My only concern is why did NVC sent it back again.

    Can it be some mistake with USCIS that NVC catched and sent it back to USCIS?

    NVC said they sent it back on June 25 and USCIS has still not received it. I hope the later process doesnt take much time.

    I need more advise guys please. Share me your views.

    I think I have weirdest case here. We filed for K1 back in Oct'09. NVC sent our case back for review in Feb'10 and USCIS reaffirmed it in June'10 and sent it back to NVC. We just called NVC yesterday and they said the case is been sent back to USCIS again in June.

    I know not many people have such situations but any suggestion or advice will be helpful.

    We have contacted Senators to check on the case. hopefully we hear it back soon.

    Does anyone know if expedite can work in K1 visa? I wish USCIS dont take another 3 months to take decision again.

    Do you think hiring attorneys help in such situations? Do they have special rights to get in touch with USCIS and find out whats going on?

  10. Hi,

    My fiance has filed K1 I-129f petition for me.

    She recently received this mail

    "Current Status: This case has been received from the State Department with a request we review it.

    .... a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our custome..."

    She received NOA2 for approved petition like 20 days back and today she got above mail.

    Does anyone know what this mail means? What should we do?
