  1. Don't understand your question... Advance Parole has nothing to do with entering Thailand or India on your Canadian passport. It is only about re-entry to the USA. If as a Canadian citizen you need specific entry documents for those countries, advance parole does not or will ever change that.

moving thread to "Working/Travelling during immigration" forum

Do not leave US without getting a AP if you are on K-1. There are provisions to reissue a K-1 from US consulate in Canada, but it is at the discretion of the US consulate. K-1 is treated as a serious matter and consulates do not fool around with it. I do not clearly understand your travel plan. If you can elaborate a little bit, i can probably give some suggestions. To start with:

    1. Are you in US already?

    2. Update your timelines on the I129F approval, K-1 Visa issue/expiry date.

If you are in Canada and have not entered US with your K-1. Then you are free to go wherever you want from Canada with appropriate travel documents. If you are in US on K-1, then i strongly suggested to get married, apply for AOS, AP and EAD. If you are apply for these in CSC, then you should have AP in a few weeks. Some of my friends have got it, hence i am saying.

    Hope it helps....

  2. You can call up your US Consulate to see if they would do the reissuance of K-1 Visa or not.

If yes, the US consulate officer would advise what to do next.

You mentioned that "US Embassy suggested that the only option is to restart the K-1 Application.", then they probably won't do the reissuance of K1-Visa.

The reissuance of K-1 Visa is really up to each individual US Consulate.

Hooray! We secured an appointment with the US consulate. Your info was very helpful. I also requested our district congressman's help, which also helped.

    Thank You.

  3. I entered US on 24th Dec 2009 on K1 Visa. Due to work emergency, I have to leave US before getting married, on 18th Jan 2010. It was really unfortunate because we didn't know if I can still enter back US on K1 visa again. OR we need to restart the K1 I-129F petition again.

After searching forums online, managed to get the information about reissuance of K-1 Visa.

    9 FAM 41.81 N6.3 Reissuance of K-1 Visa

    (TL:VISA-2; 08-30-1987)

If a K-1 visa, valid for a single entry and a 6-month period, has already been

used for admission into the United States and the alien fiancé(e) has

returned abroad prior to the marriage, the consular officer may issue a new

K visa, provided that the period of validity does not exceed the 90th day

after the date of initial admission of the alien on the original K visa and

provided also that the petitioner and beneficiary still intend and are free to

marry. The alien’s return to the United States and marriage to the petitioner

must take place within 90 days from the date of the original admission into

the United States in K status.

I applied for the reissuance of K-1 Visa at my country Singapore US Consulate. Before that I have to resubmit all the forms and documents based on the K1 visa checklist again => I-134 Affidavit of Support, New Police Record and New Medical Report. All these documents preparation and schedule new interview date take about a month.

Freaking nervous attending the interview US Consulate, expecting the worst, (yes, I have to pay the K1 visa fee again).

However, after much intense questioning, US Consulate officer agreed to re-issue me K1 Visa.

Based on the rule of Reissuance of K-1 Visa: My Fiance and I have to get married within 90 days from my original admission into US (24th Dec 2009), meaning get married before 23th March 2010, which we did.

The reissuance of K-1 Visa is really up to each individual US Consulate and the time to schedule the K1 visa interview again (must be within the initial 90 days from the first admission into US, and enough time to travel back to US to get married).

Hope the info will help you.

Oh! Great. Thanks a bunch for sharing. This is a lifeline. We are still in the window of 90 days. How did you initiate your communication with the consulate?

  4. Hi All,

My fiance had to return to attend a family emergency. Our wedding is less than a month away. I checked with USCIS about our options to get her back to US. They recommended to check with the local US consulate. I read in few FAQs that a consular officer can revalidate the visa if the petition is not expired and we still have a chance to marry within in the 90 day before the visa expiry. I was just checking to see if any one out there had similar experiences. Please share. Thanks!

  5. Why is there no packet 3 in chennai? Does that apply for delhi to. I just got my file approved today by NVC and file is being forwarded to Embassy. I wonder if we will have packet 3? How far out are the interview dates generally ( 2 - 3 weeks ) i read online some where its 2 -3 months?

There is packet 3. The representative at the consulate may not know the actual process for K-1. We received the Packet 3 on 3/13/10. The consulate says as of now the interviews will be within 2 to 3 weeks after returning packet 3.

    Thanks

  6. Hey Guys,

This sounds very weird. But it is true. I just can't believe it.

After NOA1 on Nov 23rd and a touch on Dec 1st, there was no activity on my case. Today i have checked the USCIS status site to see if i get lucky today. But there was no update. :crying:

After my evening run, i picked up my mail and found a letter from NVC stating that they have received my approved petition and the case will be sent to the consulate in a week. :wow:

As of now i feel like i am on the moon! Let me know if any one is in the same boat.

I am booking my flight now! Can't wait to see my love.

    Thanks

    Update:

Today i finally got a mail from USCIS saying the case was approved and NOA2 is on the way. On the other side of the consulate has received the petition and they are about to send the interview notice which will happen in two to three weeks. No packet 3 in chennai.

    Thanks

  8. Hi Guys,

As i still wait for NOA2, I have the following question :

We got engaged, then i got my US citizenship and then right away applied for I129F petition. Is there any one in similar situation? I got NOA1 on Nov 23rd and a touch on Dec 1st 2009. There after my file is in the dungeon, I guess.

    Thanks!

Congratulations to all of you who got there approvals this week!

Others, Let's look forward for another week of massive approvals. The Igor's List on the VJ site for Nov 2009 filers has dropped from 39 to 22 since i joined this site. :-).

  9. Hello All,

My day one on this page. I was searching quite a bit for the past few days to find a blog that has good folks like you all sharing some meaningful information.

    Here is my timeline:

I129F Received at CSC on Nov 23rd 2009.

I797C NOA on the Same Day.

    Touch 1 on Dec 1st 2009 - Initial Review.

Since then i am checking the USCIS page quite a few times in a day. Any one with similar dates have received any updates from CSC?

    Thanks and Good Luck!
