  1. Id say stay out of it. If she wanted help she would ask for it. In these cases the victim does one of two things, either they run for their life and take any help they can get or become an enabler for the abuser. I think we understand by your description the choices she has made. Offer her help if she needs it and then walk away.

  2. I can't believe I am saying this but I went to the final adjustment of status interview this monday past and was finally approved for my husbands and step sons AOS. The officer was so super nice and agreeable and he only asked my husband one question, what was the date of our marriage and it was only to tell him that he is getting his permanent greencard. : D I can't begin to express the relief you feel when they approve you and stamp that passport. Its like fireworks are going off...lol

    So as desperate as I was for this day to come its is finally almost here and of course. I am becoming unnerved. Wondering if I have everything they are asking for, if I don't have enough. If I should bring a translator or let them provide my husband one. I am just all over the place. I need some sound advice and have a few questions that hopefully you guys can help me with.

    I am bringing the following of proof that we haev a valid relationship.

    1. marriage cert of course

    2. bank account statements with both our names to the current address, no checkbook because I never had it remade when I added his name since I rarely if ever write checks.

    3. pictures of us(not that many since we spent so much time taking pics of the baby or one or the other with the baby and the pics of when we got married are blurry thanks to my sister but we have at least half an album)

    4. accidental life insurance policy for myself and my husband

    5. paperwork from my job showing he is on my medical and dental insurance.

    6. Vehicle insurance policy with both our names on the letter.

    7. birth cert of our son both the dominican b/c and the american born abroad consular one naming me mom and my husband dad.

    8. notarized letter from my aunt saying we and the children live with her in her place.

    9. Proof of 2 vacations we took together during our marriage showing us both as reserved and checked in to the rooms with corresponding pictures of course. Passport stamps concurrent that we have traveled together back to Dominican Republic.

    I dont think I have much more to add but im really hoping that its enough considering I really don't have much more to add in the way of proof. Please guys any suggestions for the interview. He really cant speak much english, should I bring my cousin to the interview to translate for him? Should we bring the 2 year old toddler to the interview as he is technically proof of our bonified marriage?

    Doing an AOs and the priority dat is a month and half behind my file date and I just recieved a letter from the MSC stating that my case is still pending and im waiting on an appointment date so to contact them back only if I have not recieved any notice in the next 90 days. I mean like really 3 months. Especially after they know they have given appointment dates to people who files months behind me. This system is absolute garbage. I thought this govermnet was by the people for the people. Seems more like the only attend to themselves.

  5. It sounds like you were approved, then the GC was lost in the mail. So you say you filed for a replacement card after that. That process can take several months. Who told you exactly that the email was an error?

    The emial was an error came from the officer at the infopass appointment. But then that was also the person who told me that no one who comes on a marriage visa ever gets a approval without interview. With that being said, he said things that made no sense. That my husband shouldnt travel even if he had advances parole, etc etc.

    I called the same day in the evening to the National Service Center and I was told that it was approved and since its been over 30 days that we should file for a replacement due to loss in part of USCIS.

    Replacement cards are 6 months or more for processing.

    I am also concerned with a second detail. If teh case is that we are approved. And the replacement can take up to 6 months, why has the joint application filed which is for my step son not been touched at all. Isnt that a joint approval if it was a joint application?

    I am posting this once again in hopes that others in the same or similar situation can shed some light on this. So I married my husband, brought him and his son on k3/k4 visas. Apply for AOS in Sept 30th, 2010. Did Biometrics for both, received EAD and AP in early January for both and then everything comes to a grinding halt. When I go to the field office on a INFOPASS appointment. I am told it can take another 2 years before we even have an interview or get approved. After leaving very upset mind you, I got over it and put it out of my mind because that's just something I cant control. So then, on April 19th, I recieve an e-mail saying this:

    Card/ Document Production

    On April 19, 2011 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

    This step applies to applications that result in an applicant receiving a card (such as a "green card") or other document (such as a naturalization certificate, employment authorization document, travel document, or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

    If you do not receive your document, please contact our National Customer Service Center at 1-800-375-5283.

    You can register for automatic case status updates by email and text message by creating an account.

    To create an electronic inquiry for N-400 and I-90 applications beyond the posted processing times, click e-Request .

    So, basically when you look at the timeline on the USCIS.gov site, all the dots on the line are empty except the card/production dot. We had NO interview after coming into the US, although we had one at the consulate in Dominican Republic, we received no welcome letter, no nothing. Its been 94 days and 67 business days and is now July 22nd, so way more than a calendar month has come and gone and nothing has come in the mail except the letters stating we have changed address to our new address and my husbands letter confirming change of address has a hand written note on the bottom with some sort of stamp in red saying approved on 4/19/2011. The actual GC has not arrived at the new or old address (my mother still lives at the old address). My step-sons has has no progress whatsoever even though my husbands says card production, my step-sons says no touch since Oct 2010 till this date. Has this happened to anyone else before or is it currently happening to anyone? Any responses will be greatly appreciated guys. The last person who responded to the post said they called and were told that no decision has been made in their case and that they are pending interview when they already had the interview a few months ago. I had no interview in difference from this person here in the States at all. I went to an info pass appointment and was told by the person that it was a mistake and we should be scheduled for an interview soon. I then called the national service center and the individual told me I was approved and that since its been past 30 days that I need to file for a replacement and told me what to mark to ensure that I don't need to pay for it. I filed that document end of May and last touch was June 5th, 2011 and still no response on that either way. Currently the field office handling our case is already processing for people who applied on Oct 19th, 2010 as of April 30th, 2011. I'm growing more and more scared that my husbands green card will not come in the mail and then we'll be stuck like so many other posts I read this evening waiting for years. I have set up another info pass appointment for the 26th of June to address this issue and hopefully get some clarification, until then I would appreciate feedback.Anyone in the same situation right now or a similar situation where they filed in Sept 2010 and have yet to have closure on their case? My husbands GC was approved supposedly April 19th, 2011 and my stepsons hasn't been touched since OCT 2010, we filed Sept 30th, 2010 and the NYc field office is way past our filing date as per USCIS.gov. Still no card till this date and no real news as to why it has not arrived. I filed for a replacement in May and that has not been touched since June 5th, 2011 but I keep getting mixed messages from the info pass appointments and the service number. That the approval was an error and that we should get an interview "soon" and that it wasn't an error and we should file for a replacement. I don't know what else to do either. Making another info pass appointment for the 26th of this month to see if we can get some definite answers.

  9. I filed Sept 30th, 2010 and the NYC field office is processing way past my filling date. My case status on the I-485 says card in production and till this date I have yet to receive a card or appointment or anything. I filed for a replacement card and the last touch was June 5th, 2011. This is all considering something actually did get approved. My step-sons case was filed concurrently and I am showing no touch since OCT 2010. I mean.. They obviously can care less about how they handle the cases.

  10. Mines has been sitting on the Card/ Production Dot since April 19th of this year. And still no card. I filed an I-90 but for all I know the Card Production was a mistake and we were not approved without interview. I keep getting mixed info about what I should do. Based on the file date I don;t see whats taking them so long and they havent even touched my step-sons AOS and I-130 since OCtober 2010. I wish you a speedy LPR. I hope something happens for me and my husband soon too.

  11. I've read on here numerous people suggesting that if you don't receive your NOA2 by the estimated time, you should "call your service center" and ask to speak to a "Tier 2" person. However, I cannot find anywhere online a direct phone number to the Vermont Service Center to try this. Any help? Does anyone have a valid phone number to speak to an actual human in Vermont?

    While we are right in our expected time window for receiving our NOA2 just now, I cannot help but get a little nervous when the timeline shows several people from Mexico who had applied after us have already received their NOA2. I hope we were not passed over.

    There is no calling the Service Centers directly.. only emailing them. The Vermont service center e-mail is vsc.ncscfollowup@dhs.gov

    When you were told to call the service center people may mean calling the national service center at 1-800-375-5283.

  12. My opinion is that you should have sent the AOS package for your wifes daughter and the I-130 for her daughter inside the same package as one piece. You have to get permission just the same with her for bringing a family member from abroad, so your wife's I-129f is enough to bring her in but the i-130 is what actually gives her consent from USCIS to reside in the United States legally and eventually get her greencard as well. Because you did the AOS package for your wife seperately, you will have to pay full price for your stepchild as well, as you did not submit her AOS together from what I gather in your timeline. If you bring her in as a K2 visa you will have to pay the fees for the visa for the child and then the AOS and the I-130 when she comes into the states seperately as opposed to just the AOS and I-130 now so she can enter as a greencard holder, with all this being said it all depends on what you guys plans are. When I went to my k3/k4 visa interview at the consulate in Dominican Republic, they asked to see the letter of consent to travel out of the country for my step son. Now, just to keep you informed, a letter saying that you and your wife can travel with her daughter may not be enough if she is coming in on a k2 visa or a actual residency. Your wife may have to get sole custody of her daughter from a court as my husband had to do with his son prior to being allowed to travel on K visas or on GC. Customs did not clear my husband to take the child out of the country when he tried to show them a consent of travel until I pulled out that court order and they took a photocopy of it. Fortunately I made my husband get sole custody before booking his and his sons flights to the US. I would recommend you get both to be safe and you take it to the visa interview if you are going that route, lest you run the risk of being denied because you dont have the consent to remove the child from the country with the intent to reside perminently in the US.

  13. I submitted the I-130, I485, I765 on May 5, 2011 by Express mail. And they received on May 6, 2011. It has been 21 days. I haven't heard anything from them. I also submitted G - 1145 for both of phone & email but never received any message from them. I called USCIS today and they said it's only 21 days. I should wait. Is that normal? And also i paid for all of those fees by Money order. I don't know when they cashed the money and i've no clue what's going on with my case.

    From what I've been reading lately they seem to be taking approximately 30 days or sometimes more before they acknowledge reciept of your package. Have a little patience. This is apparently now the norm and you should have your notices of action in no time. : )

    1. It is ENTIRELY possible to get a GC without an interview. I did and so did hundreds of other people (though I am a K1 it should be the same for K3 if you filed in a timely manner). It's only when adjusting from a non-family visa that you're guaranteed an interview

    and on this point, the guy said completely the opposite at the infopass appointment. That only work GC or asylum GC are the ones that can move foward without an interview.

    Now I'm wondering if this guy is capable of messing my process up. Cause he was talking about return mail or something while he was reading and then changed the subject completely and asked when my husband came into the country and why we took 7 months to file the AOS and then he asked me if we have kids together and I said yes and he advised me I should bring the birth certificate to the interview that I dont have becasue they never sent me an interview paper..

    I am like moving up the wall with this one. :(

    4. Bullshit. You would get an interview letter, not the "document production" email. The ONLY option is it could be an error and someone clicked the wrong box.

    Wow. I would have asked to speak to a supervisor. So much ####### you were told :S Hope it gets sorted soon!

    Oh believe me you. I sat there with a smile on my face saying this guy must have lost his mind. I made another info pass appointment for next week at the NYC office instead where our case would in turn be going if we were to interview. Hopefully someone more knowledgeble will see us there and be able to actually point us in the right direction. I have also e-mailed the headquarters to get an email for the MSC so I can inquire personally on what all this means. Since its been over a month, I highly doubt that the GC is coming, but with that being said I would love to know whats going on anyhow.

  16. First of all thank you to all who have responded. I appreciate your feedback. I went this morning to the infopass appointment at teh Garden City Field Office and was basically told that (one) its is almost impossible for a person coming in on a visa to not get an interview and get approved and just sent a green card. (two) that the e-mail they sent us could have been for another card, not neccesarily the greencard, when we have had both the EAD and AP since January and the reciept number attached to the e-mail was for the AOS not the other two documents (three) that apprently it hinders your chances at a GC if a person travels on thier Advanced Parole and with the K3/K4 visa unexpired : / (four) that we have been "approved" for an interview but not for an interview date yet : / and (fifth)that an "e-mail" was being sent ( this is the officer sending it who we were speaking with) to the MSC to find out if the appointment date will be coming soon. Of course we recieved no copy of this e-mail or even a confirmation number, and of course he did not take our e-mail to foward us this important response. I mean. What is really going on here? I am at a loss. the guys was even a little surprised when we told him we have yet to get an interview date. Its been since Sept 30th when we filed and since early January since we did everything else and nothing has happened except for this change which the guy is saying it a erroneus e-mail or ment for something else. I am trully disappointed in this system and its flaws.

  17. I actually managed an appointment for tommorow morning at the Garden City Field office at 0750am. So, when im getting out of work my husband will meet me here and I borrowed my bosses car so we can go. I would like to get some actual clarification asap. The sooner they can inform me of whats going on the better. And if we are approved I can at least get a stamp there because we are traveling to Dominican Republic to see my husbands surgeon next week and I dont want to have issues with TSA when we come back if they see that he is a greencard holder in the system and he doesnt even have a stamp to show for it.
