  1. I just noticed that our Advance Parole document was approved on Dec. 30th by looking up the case status on the USCIS website. I also noticed that the EAD card was in production. From the time that you receive your NOA concerning your AP approval how long does it take to receive the actual document that allows you to leave the country? Is there any way to get the document faster? My wife and I have a honeymoon cruise scheduled in 20 days, and I am a little nervous that the necessary documents won't arrive in time for her to leave the country.

  2. What is more important is the sponsor's income and that you won't become a public charge to the government, thus she needs to meet a minimum income requirement. She is allowed to have someone co-sponsor with her using their income also. She and her co-sponsor are in essence signing that they will be responsible in paying back any monies that you may collect from the government. Your money, from my understanding, is not important and will not help at all. They may look at your income as help, but I highly doubt it. You could leave the country with your money and they would have no recourse to get that money back. So that is probably why you need someone to sponsor you (or co-sponsor) here that is a citizen or permanet resident.

    They went over that with a fine-tooth comb at my interview, because they asked about my taxes from last year. I always file an extension, but I included the W2 from last year along with the year taxes prior to that. So proof of income is important. You also have to include support for resources of income that is included in the sponsor document. This includes a letter from your employer (which I included just in case) and a letter from the bank showing how much money you have and how long it has resided in the account.

    So I do think that receiving a large deposit within months of the interview may throw a red flag, and you will have to explain the source. My philosophy is it is always better to be safe than sorry.

  3. We had our interview on last week on July 19. The embassy documents state that the visa should be delivered within 4-6 business days on one document and 10 calendar days on another. Not to mention that we pay about $30 to Domesa for their horrible service after the visa approval. My novia has been calling since Wednesday, because we want to buy her tickets and get her here. They assured her that it would be in Friday or this morning on Saturday. Supposedly it was delivered to the Domesa office in Bogota on Wednesday, although I think it was there before that. Reasonably you would expect a package to get from Bogota to Medellin within a day. The lady informed her to call early this morning at 8am, because they open from 8-12 on Saturday. This is so she can go pick it up, and we can book our tickets. Guess what??? She has been calling since 8am, and no one is answering the phone.

    Has anyone had Domesa take so long to deliver a passport?

  4. You can skip the interview and the application will eventually expire. I don't think it will affect you in any way. If you are asked about it with another fiance, you will just be honest and explain what happened.

    I have been through a similar situation with my current fiance and another ex-fiance. They inquired to my spouse about my application and she responded honestly. I am completely honest with her.

    If you are concerned about doing everything correctly, then talk to your fiance regarding your concerns. If things are salvageable then work them out and postpone the interview. If you are not interested at all, then tell him and have him write a letter to cancel the process. You or him can send them an email with your names, case number, and birth dates and tell them that you have to cancel the interview.

  5. I am so sorry for your situation. Hopefully you and others can learn from your story. You have sacrificed deeply for someone that only thought within herself, and you ignored the many signs and tried to do I assume what you felt was the right thing by supporting her. The only thing you can really do is chalk it up as experience and move on to rebuilding your life. I would however try to contact immigration and make them aware of everything that happened and hope they will see her apparent fraud. You however had the opportunity the first time to allow the system to work and not to reward her by sending her back to her country.

    I would just try to do everything on your own including representing yourself legally in order to save the attorney expenses. What is done has been done. Focus on your kids, the remainder of your life, your job and just move on rebuilding day-by-day slowly. Everything happens for a reason and signs are always around us, but we are the ones responsible for listening to these messages and signs. You are now free of her. The pain will subside eventually. You just need to maintain the correct focus to repair your life emotionally and financially.

    I wish you the best. Maintain focus on your children and not other women unless they want to be a fully, committed portion of your life.

  6. I just went through an interview with my fiance in Bogota, Colombia. For skype just select all of your messages and copy them and then past them into notepad. It will contain everything including dates and times. There will also be the line that says a web call is coming in or going out. If you are using an IPhone, you can select all of your messages and email them to yourself.

    Me and my fiance practiced everyday leading up to her interview. They asked her about what my phone number was, but she told them that she didn't know. That is one question we weren't prepared for. She has only called me through skype or instant messenger and she told them that. I had pieces of emails, skype chats, IM chats, and google calls from each month from the date forward of my application.

    Just be patient, relaxed, and honest and everything will turn out fine. They just want to prove that you have a valid relationship and that it isn't fraud. They just scanned all of our pictures and information. The toughest part was the waiting for hours to be called...then waiting more then called again...and then waiting more. We arrived about 6:30 and we didn't leave until about Noon.

  7. I would definitely have the test done to see if he is indeed the father. I would also verify with him that this is a surprise. I just went through the process, and they will scrutinize him with questions. I wouldn't withdraw. If he is the father, I would just attend the interview with the backup documentation. I would explain what happened. If you get denied, then just re-file. They should give you an indication of why you were denied. I wouldn't withdraw because of this. Circumstances change all the time, but just make sure that you are totally honest.

  8. I totally understand your situation and frustration. Me and my novia had issues when she returned back to Colombia from Australia. She underwent a bunch of confusion and she was tired of waiting for the process. Sometimes yes they can be drama, but most of the time they just want to be assured that you will always be there for them when they have their days.

    I don't know how well you know your woman or women, but I would suggest just being supportive of her and reassure her of your intentions and that you will care for her and be there for her always.

  9. We are preparing for our visa interview on July 19th. I am going over the items within my folder for validation, and I realize that I do not have a copy of my original passport photo that I submitted with the original I-129F application. Is this a problem? Should I get another photo taken which will not match the original? I have a copy of the photo for my fiance. I just don't have one for me.

  10. Last month I saw that me and my fiance were scheduled for June 17 on the posted list. We still haven't received any documents since my NOA2 in March. We have made all of our travel plans, and I was planning to leave Tuesday. All the money has been spent. In preparing some last bits of paperwork, I checked the list and it said June Final. We were not on the list. Today I find out that her cousin received a letter a few days ago, and our appointment is now July 19. What can we do since we totally depended on their posted list from earlier in the month. The list from last month was posted late on May 20. Once I found out we began doing everything. We scheduled our medical examination for Wednesday of this week and paid all the fees at the Bank Helm. Now all of a sudden things have changed. I don't know what to do. I sent a letter to the embassy, but time is running out. Our application expires on July 1, 2011.

    I would appreciate any other suggestions of anyone that has encountered the same problems or could point us in the right direction to find a remedy to this problem.

  11. Sorry to hear about your situation, but I was in your exact position last year. If there is a possibility that this will work out, then I wouldn't do anything. The process will continue and basically be pending awaiting your action. If you are totally sure that it isn't going anywhere, then I would recommend canceling with the quickness.

    In my case I thought that it expired. After I began filing for my current fiancée, I realized that I could only file once within a 2-year period. What I did on my application was I sent them a withdrawal request for the first one along with the emails that showed that I had broke things off. I also included another letter asking for a waiver. I thought this would complicate my process and hold things up, but I had my application approval in like 19 days. We are human and we make mistakes. In my case I probably pulled the trigger too soon and broke off the relationship prematurely, but at the time I thought it was the right thing to do. I am happy I did, because I have someone that is more compatible with me.

  12. the woman at the embassy who talked to my wife said we need translations for all documents...why the heck is that? We didnt need them at the NVC stage (we didnt send any of our documents though), so why would we need them now at the US embassy in Colombia when all of her documents are in the official language of Colombia? This is the weirdest thing...now I have to spend more money and just hope they are done in time for her interview. You would think that all of the embassy staff would be able to understand Spanish...I just dont get it.

    Congratulations and good luck. I just received my NVC letter today. My fiance is completing her paperwork now. I about to send an email to see if they received our packet, but I am a little nervous that we will get an interview too quickly. I was planning and/or hoping for May, because I plan to attend the interview with her. I guess we will have to roll the dice!

  13. I am awaiting our case number from the NVC. I would assume it should be soon since tomorrow will be exactly two weeks from the receipt of the NOA2 letter. My fiancee has been preparing her list of documents in preparation. I have thought about sending our packet back priority mail instead of faxing. With faxing there is always that chance that they may not get it or it will be misplaced. I guess my question is how good is priority mail in Colombia? Should I just do like everyone else and fax it? I guess I have to get the case number first. :)

  14. When the relation terminated, I assumed that the petition would expire after the grace period. According to the approval notice the petition would have expired on 08/18/2010. I have also read in the K1 documentation that the application expires one year after it is filed, so I didn't think that I would have to communicate with any agency of my desire to not continue with the process.

    When I began looking into filing for my new fiancée, I am thinking it is a good idea to ensure that the process is truly canceled. I thought about either calling the embassy in Bogota or the USCIS Service Center or sending them a letter asking that the previous process be canceled. I guess my dilemma is which should I communicate with? My case was already sent to the Bogota embassy back in May 2010. I also thought about just including this letter asking for cancellation of the previous process in the new application along with a request for a waiver.

    I would appreciate any suggestions as what I should do and which route to take???

  15. I am in the process of filing for a K1 visa. I had a visa approved last year for another person, but the relationship terminated not too long after filing. I petition is expired. I am filing for a K1 visa for a different person. The instructions says that since I filed for a K1 visa within two years that was approved, I must apply for a waiver. It doesn't mention how to apply for a waiver or where to apply. Where do I find waiver forms for a K1 visa and where do I file these forms?

  16. I am considering filing for a K1 visa for my girlfriend that currently is living in Australia for the past two years. We have maintained contact for two years, but we have recently decided to take it to the next level. I will be spending two weeks in Australia in December. She has been studying English and she completes her diploma in January. She may continue with a Masters but no decision has been made yet. If she continued living in Australia, what impact would that have on trying to obtain a K1 visa to bring her here to marry? Would she have to go back to Colombia first? Could everything be handled in Australia or a Colombia embassy in Australia if there is one? Any advice would be appreciated.
