    I think it now harder for me to petition her - if still posssible. On the Notice given to her at the airport, she was in violation of Section 212 a 6 C i and 212 a 7 A i I. I did not pay attention to these sections until now. Upon further readings and inquiries (free lawyer consultation over the phone), under this section she is permanently inadmissable, not just the 5 year ban. The waiver I201 does not apply for the same reason some of you stated (a child cannot file for a parent).

    I will still file I-130 which likely be approved but she may not be able to get a visa. I am hoping that there might be some loophole or an expert who can help us overcome this.

    Please keep on your comments. All information are appreciated.

    My heart is breaking. We were literally counting days and nights for my citizenship and for her 5-year ban....

  2. In 2007, my mother was removed from US (A2A or "Airport to Airport" removal) on Feb 2007 due to a prior overstay while she was holding a B1/B2 visa. The penalty was a 5-year ban in the US. Based on that, she is banned from Feb 2007 thru Feb 2012.

    I am now a US citizen and filing for I-130. I put in the form that she has been Removed from the USA. Is this going to affect the approval of I-130? Do you think USCIS will wait for the 5-year ban completion before approving I-130? I know I-130 is only to establish relationship. I think it will be I-485 that may be we will have a little bit of a difficult time.

    Or should I just answer NO to the question "Has your relative been under immigration proceedings" on I-130? I do not know if she has technically been under immigration proceeding, she was sent back from SFO airport. And then elaborate on that on I-485 filing?

    Please advise.

  3. I am about to file an I-130 for my mother who is in the Philippines. She has been using my father's last name but they are not legally married. Her current and previous passports, voter's id, bank account, etc are using my father's last name. Back in the old days, she had a marriage certificate obtained from a local city hall but was never registered in the national database. My father is legally married to someone else. I am using my father's last name too.

    So, my question is, when I filed a petition, should I file it using her 'maiden' name? or if use her 'married' name, is it required to submit an authenticated marriage certificate when filing either I-130 or I-485?

  4. I was interviewed on May 18th and was given a paper that I passed the interview and it is recommended for approval. I know that this is a standard process. But does anyone know if someone get actually denied or subject to more interviews when it gets to IO supervisor for final approval? I am anxiously waiting for the oath letter.

    The reason why I asked is that I got my green card under the 245i Life Act. At that time, there was a lot of gray areas and it took me awhile before I was approved for greencard. But I already passed that stage but still wondering if that will haunt me on this citizenship application.

    The IO said the he does not see any problems but his supervisor may have further questions.

    I am from the Philippines and we do the same thing. When women get married, the middle name is replaced by the father's last name. I have done quite a few research on this. What will happen is that your wife will have a 'special' oath taking (forgot what it is called, i'll find out) for people who have name changes. This can drag the oath taking from 6 months to a year - as what I heard.

    But it was surprsing that the IO does not understand the name changes. Maybe only few does it in your state. In CA, specifically in San Diego, there are lots of Filipinos, so the IOs are very familiar.

    And why does the IO care about W2s? wierd....

  6. To anyone who has N400 interview experience at San Diego office, were you scheduled for the oath during the interview or you have to wait for the oath letter in the mail?

    My interview is on May 18th and the next oath taking is May 26th, and then next is June 29th. I am hoping I can be at the May 26th oath since I am planning to be out of the country by mid-June for 2 months (which I will postpone if I dont get the oath by May).

    Right now I have the GC as Lisa Marie Jackson. I want to change it to Lisa Marie Presley-Jackson. (And btw, that was an excellent analogy from you!) And oops, i was just told by someone that it will be better if I dont use hyphen like Lisa Marie Presley Jackson - so legally either way I can use Presley or Jackson independently in any legal documents .

    So, I think based on what you said that if IO tells me I need judicial oath for the name I want, I can tell him, forget about my request, I will use my GC name. RIght now, for me, it is important to get the Naturalization Cert than my preference on name. And I will just deal with it after the fact...

  8. thanks rebelheart! I feel like i don't want to do the name change and rather get my oath taking asap. And then, deal with it via the court or judicial oath on a later time. The only difference we have is that what I have in my GC is: First name, Middle name (in BC which was my mother's unmarried last name, not my father's), Married Name. So, I think in USCIS' perspective this is what they want based on your experience.

    What I put on name change is: First Name, Middle Name (again same as BC which was my mother's unmarried last name, not my father's), Last name is: Father's last name- Married name (so I am hyphenating my maiden name to the married name)

    So, given the fact that I have the "correct name" in GC, can I still retract my name change request during the interview? I wanted to take the oath asap!

    (By the way, a USCIS officer (a Pinoy) told me I could have used my maiden name (i.e. my father's last name) as my middle name when he saw my GC. This was when I got an info pass for something else and showed him my GC for identification - it was just his comment. Maybe it is widely known and accepted here in San Diego because there is a lot of Pinoys and USCIS here is used to getting / approving middle name as your maiden name)

  9. I requested a name change on N400 by hyphenating my maiden name to my married name (my greencard is on my married name only). Now, I am hearing that name change delays oath-taking. I really really wanted to get US passport by mid-June due to a business travel (it is easier to travel on US passport). My interview is on May 18th (San Diego) and it looks like the oath-taking in San Diego is once every month. This will probably put me on mid-June oath taking. However, I am worried that because of the name change, it may delay me to July or August oath taking.

    2 questions:

    1. Can I still retract the name change during the interview? In the hopes that I will have my oath taking faster?

    2. If I retract my name change request, and get my naturalization certificate on the original name, how can I later change it? Is the process costly and take longer time?

  11. I received I-797C, NOA dated February 5, 2010. The "Receipt" field was blank. I thought there will be a number here, so you can check the status online. The other fields were filled in: Notice date (2/5/10); Case type (N-400); USCIS A# (Axxxxxx); Application Number (NBCxxxxx); Received date: 2/1/10; Priority date: 2/4/10.

    I filed the package at Phoenix lockbox...The check has been cashed.... I have not received any biometrics appointment papers yet..

    Does anyone have a Receipt number on their NOA?

  13. Hi KulayBlue,

    Your parents are lucky to have tourist visas and they can visit you while waiting for the AOS.

    Do you have any idea how long the whole process takes before they get the LPR status? I just filed my N400 and I can't wait to be USC so I can file a I-130 petition for my mother. Unfortunately, she does not have a tourist visa - and it is very hard to get one in PI.

    you know what v33k means...or do you?

    ejb knows that she did the right thing by volunteering to depart, but is just anxious and wants to be sure that it won't be an issue any more with her N400 application.

    just a yes or no, and an explanation like v33k's, that's all she needs :)

  16. My N400 application was received on Feb 4th, 2010. Ten years ago, I was granted voluntary departure for overstay on non-immigrant visa. I complied and left the country. I married my USC husband after my voluntary departure, we are married for 10 years next month and have 3 kids. I got my GC under the LIFE Act provision on March 2007. Will my voluntary departure affect the "Good Moral Character" determination on N400 application? Can I be possibly denied N400 due to voluntary departure? I disclosed the VD on the N400.
