  1. Sorry again, I must be out of my mind! I didn't even notice this was for K-1 Visas! Although I did see some CR-1 visas as well. Thanks for the info though Nich-Nick, I think I am just itching to get some answers. It's been almost a year since I got married, and I'm getting a little ancy to get my husband back.

On the bright side, I am well versed in visa applications in case I decide to get a job for USCIS or the NVC he he

    Thanks again.

  2. i called the nvc last week to see if they had at least received our aos and iv docs and the operator wasn't able to confirm if they had even received our stuff. We sent it to them on june 7th. is it worth calling an operator again to see if they have got our docs? avr says that they mailed us a packet on 18th may and doesn't say anthing else yet.

In my experience, they won't confirm they have received anything until they actually process the packets. Give it the

"20 business days" if you can, or just call back every day. As soon as they can say they have received them, you will also know they have processed the packets.

  3. Hi guys.

So sorry for the confusion of my last post. I have updated my profile so hopefully that helps. Little back story:

We did apply for a K-1 visa, and got married in August. We filed the AOS (Adjustment of Status) and also filed for an Advance Parole so my husband could go back to England in October for a wedding. We misunderstood the instructions and he went back before the AP was issued, so we had to start the process over with the I-130.

So, the I-130 was approved, and we went through all the normal steps including paying fees online and sending packtets to the NVC. Now the Embassy has the AOS (Affidavit of Support) and the Visa Packet, we are just waiting on my husband's medical, which is tomorrow. So for those of you that have had your packets sent to the Embassy, what happens now? I see that some of your have received your interview date before your medical, but we have been informed that my husband will not get an interview date until they receive and process his medical results. So I'm wondering if anyone has a timeline of when the interview date might be after his medical tomorrow. Also, I'm still really confused about packet 3 and 4, as we have already filled out all of those forms and sent all the required documents.

Again, sorry for the confusion. Hope this explanation helps.

  4. I was telling Philip that I was a Senior member.. oh yeah!

My husband and I filed our K-1 visa in February 2010, and we are now on our CR-1 visa. What does that make us? Double platinum maybe lol

His medical exam is scheduled for June 23, and the Embassy received all of his packets from NVC on June 7, so after the medical, hopefully we get an interview soon. I was hoping for July, but that is doubtful. We got married August 8, 2010 so I was really hoping he would be here by our anniversary, but not looking good.

How is everyone else's timeline going?

  5. Hi guys!

So a few questions I hope you all can answer.

We sent our AOS packet with income, tax, and support documents, and the Visa packet with birth certificate, police certificate, etc to the NVC. Our case was expedited so everything was sent to the Embassy. We waited a month but did not receive anything telling us what to do next, so I emailed the IV email address and received the following response:

"Your file was received from NVC on 07JUN, once we have received your cleared medical report from Knightsbridge Drs we will schedule your appt. You should call them on 0207 4867822 to arrange an appointment."

So my husband scheduled his medical for June 23. I am wondering if you know what happens after that. What is packet 3 and packet 4? What else could we possibly have to send them? They have all of our forms- the originals- so what else is left?

Any help you can offer would be great! Thanks.

  6. Hello all,

Was just wondering, did most of you receive your interview date before you scheduled your medical?

We had our case expedited in May, so it was sent directly to the Embassy in London for adjudication. Because of this, we can't call the NVC for interview dates or anything like that. We haven't received anything in the mail about what to do next, so finally I sent an email and got the famous "this email has been deleted" response. But a couple days later I got an email stating that the Embassy had to receive the cleared medical forms for husband before they could schedule an interview. It seems to me that having it expedited only made it take longer, since all of you already have your interview dates, and we don't have anything. We have his medical exam scheduled for June 23, but that was only out of dumb luck that I emailedd them, or else we would still be waiting for a packet from the Embassy that was never even sent!

    Any thoughts?

  7. For the DS-3032 all you have to do is have the beneficiary email the NVC and state who they want as the point of contact. I believe the email address is nvcinquiries@state.gov. They get the email almost immediately, and then they will add the IV payment onto payment the website. After you pay that, they will add the AOS payment onto the payment website. That only takes a total of 2-3 days. After that, you are set to send both your IV packet and AOS packet. Don't forget to print out the cover pages once the payment website has updated to paid.

Oh, also, it might be a good idea to call NVC and give them both the petitioner's and benficiary's email address.

    Good Luck!

  8. What?? I'm sorry you've already withdrawn the AOS, it limits your options pretty severely...no use crying over spilled milk. :( Just follow the CR-1 guide, I guess. Don't do the K-3, because it's a waste of time, and could possibly even delay your petition further. Good news with the CR-1 is you won't have to adjust again, he can come in as a green card holder.

Thank you to everyone who has commented, and for your support and suggestions. I mis-typed in my original posting. Ryan hasn't actually withdrawn his AOS application, we were just advised that we needed to do so before it got denied, as having it denied could potentially have negative effects on our I-130. We have been searching for a lawyer to help us with this, but it has been a nightmare to find someone who has even dealt with it. I guess living in Los Angeles, immigration lawyers aren't used to dealing with legal immigration.

So, if we haven't withdrawn the AOS application or sent in the I-130, is there something we can still do with the AOS? We were informed by someone on the USCIS info line that because Ryan left without biometrics we are basically screwed. Although, every time I call them, I get a different answer.

I was also wondering if anyone had any experience with expediting their I-130. I was wondering if, because we have already had the I-129f ane K1 visa approved, that maybe that is cause for expediting us. We have already had our financials checked, Ryan's medical and immunizations done, police report cleared, and interview done. Doesn't that count for anything?

If anyone has any information they can share, I am soooo grateful to accept it. Thanks again you guys, this forum has helped to keep me sane and at least keep me somewhat hopeful!

  9. Update- Ryan had to go back to England before he could do his biometrics, while his AOS was still pending. Soooo, unfortunately we had to withdraw his AOS and now we have to do an I-130 to bring him back. Does anyone have or has anyone heard any information on this process. We are pretty sad about the whole thing, as we have heard it is taking over 5 months just for the I-130, not to mention everything else after that. I am really confused on if we should do the K-3 as well. What to do, what to to?! Someone tell me!! Yucky!

  11. Shara, might I add the following details

Visa fee - you can use dollars or pounds equivalent, $350 from June 4th/previously $131 USD (cash or card OK)

Courier fee - to have your passport with visa sent back to you, 14.20 pounds payable with CARD ONLY (I think only Visa cards)

Wow! That is quite an increase! But, something else to add on to the wedding budget lol. I'll make sure I tell him to bring his Visa credit card. That thing is gonna catch on fire after he is finished using it for all of this stuff. We are still waiting for an interview date, but calling the DOS every day to check. Sooo annoyed at this three day weekend. Wedding invitations are going out next week, eeeek! I pray there is an actual wedding for people to attend.

Congrats to everyoe on their June interview date. What I wouldn't give to get one of those. Is anyone selling their spot? I'll take it ha ha!

  12. Hi Shari... you are thinking about the restriction that your Alien Beneficiary cannot receive "means tested benefits" for forty quarters after you have signed the Affidavit of Support.

Unemployment insurance is not a means tested benefit. Yes, you are allowed to collect the unemployment and it will not mess up your application unless you had actually lost your job. Then that is another matter. I think you said you have a joint sponsor and your income alone is sufficient so you are covered.

Claim the unemployment if you wish. (It does not to be added as income to your tax return you file next year for 2010 tax year.)

    Good luck.

    Thanks for the info!

  13. sooooo, i need some professional help lol this might be in a forum somewhere but i was hoping someone might have experienced this as well. I am a high school employee and my last day of work is next Friday. I qualify to receive unemployment until school starts again in August. I made enough on my past three tax returns to more than satisfy the poverty guidelines for support, and my dad is also co-sponsoring. However, my question is, will receiving unemployment benefits cause any problems with my fiance getting his visa? I know there is a rule out there somewhere about receiving government assistance, but I don't know what that is. I would like to get my unemployment if I can, BUT, it is not worth messing up the visa. Any info? Thanks!

  14. I know most people don't want to hear this but I'll have to say it anyway, it's soooo much easier to get a mini cab, especially if you want to make sure you are on time. You can totally arrange for one to pick you up at the tube station most convenient to you (depending on where you are coming from)and they can take you straight to the embassy. Anyway, just a suggestion.

  15. Hey guys!! We got our interview date as well, WAAAAAY quicker than we anticipated (thank goodness)!!! And it is also June 8th, but at 9 AM.

My fiance only put "pending visa issuance" for the travel and wedding dates. He sent back his forms on April 12th, and our interview date was assigned today, 16 days later! Crazy quick as far as I can tell!

I've been sharing the news all day with anyone who will listen!! Woooooooo!!!

Yay! Congratulations. Our petition should have reached the Embassy my now, so we're just waiting for packet 3 to come so we can send everything back and get an interview date. It's getting exciting!!
