  1. I have googled this a hundred times (well too many too count anyways). My wife's 2 year green card is set to expire in December 2012 and I am really hoping to go travel in July for approximately 3-4 weeks and come back to the United States.

Do I have to waste money to get her a travel document (I-131) even though it is only valid for the duration of her 2 year green card?

Can she just travel out of the country with me for 3-4 weeks and come back to the United States and reenter with her 2 year green card? (All the googled resources I have found said "Yes", she can reenter with a green card.)

I do not intend to file for her green card renewal until October when she is eligible 90 days out.

We have a child, so it should be pretty obvious that we are committed too.

P.S. She is going back to laos with me and has a valid passport.

  2. When I was a student at at university, I was unemployed and I submitted affidavits of support on behalf of my Mom and Dad and they had great jobs. The US Embassy in Laos still demanded that I meet the poverty threshold.

Poverty threshold in the United States for 2 people is pretty lenient too, at a mere $19,000 at 100% if you are in the military.

Everyone else has to go to like 125%-150%.

Don't be surprised if you get denied. Lucky for me our case was just dragged out pending "requirements for proof of finanical support", mostly from myself.

  3. On July 1, 2010, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

We filed the I-485 along with the I-131 and I-765 (work and travel permit) on June 1, 2010.

We have received both the work and travel permits.

We received the notice on July 1 for I-485, citing it was sent to California service center. I have searched throughout the forums about the CSC, and it appears that this is where most of the "auto-approved" I-485s go. However, it is now October 2 and the status on the I-485 has still not changed since July. I believe the case is still at CSC.

What could be going on with the I-485 right now?

    Thank You,

    Adam

  4. I sincerely hope you do not proceed with your abortion, but rather be pleased that you have been blessed. Many families from third world countries make do with less food and money than what we have and earn in the United States. If you think you really have it bad and not have the resources to raise a child, think again. There are many resources out there that can help you plan your delivery. If you really need it, you can get WIC (food stamps), have your hubby volunteer at a food pantry (get a ration every week/month).

  5. There are some Lao people out there with secondary wives. Though it may be uncommon, you can sometimes find such families in Laos and Thailand.

You really do not think about the consequences here. You could potentially have your brother-in-law, ARRESTED, thereby destroying your sister's future and her kids future. If your sister is an actual accomplice in this supposed fraud you call it (I don't see any fraud), then she too will be jailed or fined.

I don't know the laws on bigamy, but you need to fully accept the fact that this is indeed Lao culture and is culturally acceptable. Even my Lao wife (fiancee) expressed to me the question if I was going to have a second wife. Weird......

If you are okay with helping your sister footing the jail time and fines for fraud, you should proceed with your decision.

No (means New Opportunities) means you did the right thing, I then I highly commend your lack of effort in supporting your family.

Yes (means Your life ends here) would mean you are going to cause irreparable and permanent damage to people you care about. I hope I am not too late in getting this news across. Otherwise, I hope you see your brother in law and sister out of jail in 5 years. You should start the adoption process for your sister's kids before they are stuffed into foster parenting.

  6. I am going on my third AOS forum post today. Thank you and sorry for the space I am taking up.

Suppose I file my I-485 and later on my wife (K-1 Visa) can't speak any English and receives a green card interview. I am able to speak her language fluently and very well.

Would she and I be separated?

Will they have someone able to translate for her?

There were some stories of green cards being approved without a green card interview on VJ Forums (weird).

What will happen in my scenario? Thanks

Also, is it appropriate for my wife to volunteer hours for a local food pantry? She will not get paid at all, but she would be able to bring back a small supply of food each month. Thanks

  7. I'm sorry I really don't know where this post should really go but...

My spouse's A# as cited on her K1 visa goes like this:

    'A# 12 345 678'

It only has eight digits. When I try to input this eight digit number into the PDF file I-485 and a lot of other forms, it automatically fixes it for you like this in a 9 digit number:

    '012-345-678'

I am extremely annoyed. I don't wish the extra zero that shows up in the A# to make that big difference in another person in screwing my spouse's AOS packet over. Is it appropriate that my AOS number appears in my USCIS forms in the nine digit format.

    Thanks.

  8. Is it appropriate for my spouse to work as a babysitter without an employment authorization document and receive money on the side?

(EAD is so expensive! :innocent: )

I have read one VJ post about someone using a social security number other than their own. Definitely a no no and I am aware of the consequences. But babysitting just seems so innocent, and you don't get taxed for it.

    Thanks

  9. IMPORTANT:

If the Petitioner (US citizen who puts forth the K-1 Visa application) does not earn an income that is equal to or greater than 125% of the US Census designated 'Poverty Threshold' for two persons, approximately, $14,570 for two people w/o children under the age of 65. At 125% of poverty threshold, one will need to make $18212 USD. If your loved one did not make this amount or greater for 2009 taxes, or until he/she makes this much money you will get turned down!

    Sources:

    1. Me, I was in college and a foreign embassy required evidence of a means to support the beneficiary (my fiancee). I had to wait until I finished college until I began making income. It took me three years to bring my fiancee over. I was a US military member, so I only needed to meet 100% of the poverty threshold which was AWESOME!!!!!

  10. VERMONT

I wanted to drop a line for Immigration Medical Exams of the Northeast, run by Vivian Esparza, M. D. located near Burlington, Vermont. Convenient for people near the St. Albans USCIS. My wife came on a K-1 Visa and had a DS-3025 vaccination supplement that cited "Shots Completed", but I didn't want to risk the MMR #2 missing and not having an I-693, to be RFE'd in the long run. I paid $85 altogether for the vaccine and the transcription, and it was well worth the sacrifice. The vaccines are reasonably priced and are relatively far cheaper than a walk in immunization clinic.

    City/ Town: Burlington

    State: Vermont

Date of Service: 16 April 2010

CS Name: Vivian Esparza, M. D

    CS Tel. no: (802) 238-7059

    Cost: $25 (Transcription) + $60 (#2 MMR Vaccine) = $85

Vaccine Transcription only available: (DON'T KNOW, but if you are missing 1-2 vaccines, this is the best place to go)

Turnaround time: I called at 9 A.M. and received a call back at 6 P.M. She is a very busy person seeing people on a regular basis as I observed other people entering. I got an appointment set for a week.

  11. My wife is on a K-1 visa, and the I-485 instructions cite

    8. Fiance (e)s

If you are a K-1 fiancee or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancee visa, you only need to submit a vaccination supplement, not the entire medical report. You may include the vaccination supplement with your Form I-485.

Am I in the clear and so I can just submit her I-485 with vaccination supplement?

  12. This civil surgeon who is willing to assist my wife with her I-693 has reviewed her DS-3025 vaccine supplement and has determined that she is good to go for vaccines. I have googled some prices, and even compared among the Mumps, Measles, Rubella vaccines that my military medical unit purchases. It is stupid that only USCIS approved doctors can do these tests.

My wife's DS-3025(vaccination supplement) shows that her MMR is "COMPLETE". Also, the civil surgeon has said that all shots are complete, and has claims that now my wife will require a titer or another dose for proof of immunization.

How much should I expect to pay? I estimate each dose should only be around $10-15. What is the maximum amount I should pay to include her services and the I-693 paperwork? She also says the MMR titer will also be about the same price. I don't want to walk into her clinic and have to pay $200 for a single dose of MMR.

I think she just wants to make a small cut, but I think I may be willing to make the sacrifice to get this paperwork done.

    Thank You,

    Adam

    P.S.

I am situated in the Burlington,Vermont area and don't have health insurance for my spouse or myself.

    Adam,

If I am remembering correctly, your wife entered on a K-1 visa. If this is correct, and according to her vaccination record, she will only require testing to prove immunity for measles, mumps, rubella; or she can have another dose of this vaccine (MMR). The cost is similar and we can discuss this further at the appointment. All the other requirements seem to be complete. I could see you a week from tomorrow, April 16 at 9am. Let me know if you could make this appointment time.

  13. My fiancee left Vientiane, Laos on April 12, and had layovers in Bangkok (1 Hour) and Beijing (12 hours) before arriving to JFK.

All she had was a letter citing "Dear Sir/Mam, Please help direct me to my flight" and I also typed out the itinerary on the same page in a table format with bold letters.

My fiancee is Laotian, and Lao and Thai language are pretty much the same so she fared well in Bangkok during her one hour layover. However, according to my fiancee's experience: "Beijing was huge, a Finnish guy I was with didn't even know where to go but he helped me".

Lastly, the sign that I made for her that I repeatedly expressed her for use..... she did not use the sign at all.

In worst case scenario, allow for sufficient layover time in regions where fiance/fiancee is not familiar with language. The best thing he/she can do is just wave the flight itinerary to an airport employee and someone will point in the right direction.

My fiancee had someone else fill out her custom forms for her before arriving at JFK. I was waiting at the arrivals and I was so frustrated from the wait that I walked away to order pizza and took a bathroom break. When I came back to resume waiting for her to come through the open doors to the United States like all the other people do (i missed that moment).............. she snuck behind me with a big luggage cart .

Like I said.... just allow sufficient layover time to find help...

  14. The cost of AOS (I-485) is $1010 (this includes biometrics).

That fee includes two optional benefits: I-765 (Employment Authorization) and I-131 (Travel Document) that you can use while the greencard is being processed. Once you get the GC, these will no longer be needed.

Here is the step-by-step GUIDE: http://www.visajourney.com/forums/index.ph...mp;page=k1k3aos

If I choose not to have her receive "Employment Authorization" and "Travel Document", do I still have to pay that $1010? Or a lower fee?

    Wow.....
