  1. I don't know how you missed some of the hostile replies JayKay... and I DID include in the first post those things.

Please look at the quote from the first post, I will put in bold the very question you asked that I already had addressed before you 'read' it:

    1. EVIDENCE OF GOOD FAITH MARRIAGE

      1. The CPR filed a form I-751 to our office. The CPR provided some evidence of marital bona fides. However, the documentation submitted is insufficient because joint residency documentation does not establish a joint residency from the date of adjustment to present and joint taxes and bank statements alone do not fulfill the burden of proof of joint finances.

Sadly it seems as if VisaJourney is littered with 'internet trolls' now. Glad it helped me this far but the undue stress involved with peoples lose tongues is too much. I hope moderators weed out these bad apples for future users.

  2. I will keep this reply short as it appears people do not want to take the time to read (or perhaps English isn't their primary language? I suppose that's a good excuse.)

For those of you who didn't understand my first post, I will answer your questions:

We already had sent in a copy of our lease, two affidavits, and joint bank account and joint tax return information. They said this was not enough.

I have since sent in documentation for our joint credit card and her employment information showing she listing her address as ours four months after crossing the border. This is all the extra documentation we have. No joint insurance (we don't have insurance atm) etc.

    --

Also Ryna - they were NOT in fact asking for the immigrants GC (Obviously they're the ones who sent us the GC to begin with, why would they want a copy of something they produced?) They very clearly stated they wanted a license or state ID. I have since found out that an expired license is not valid as state ID, so we got her a state ID and sent a copy of that, along with my driver's license.

  3. Hey all! We have received an RFE for our Removal of Conditions we sent in last September. Her two year anniversary date was around the 8th of December, 2013. This means she arrived stateside in 2011 on this date. The RFE outlines the following two categories:

    1. IDENTITY DOCUMENT

      1. Submit copies of the conditional permanent resident (CPR) and spouse's driver's licenses.

She does not have a driver's license yet, however she does have a learner's permit that was issued on 5-16-2012. It was not updated and says it expires on 5-16-2013. Will this still act as a valid form of ID. E.G. Has the “learner's permit” portion “expired” or is the whole thing no longer valid? To my understanding it should still act as an ID card after this date so it should be fine?

First, lets discuss the joint residency. I did not realize I could add her to an already existing lease for our apartment, thus when the lease was up we THEN went ahead and renewed it with both of our names. This was of course not immediately after she entered the states. However – the photo IDs (her learner's permit and my driver's licenses) both do show our current address with the dates of 5-16-2012 and mine of 12-06-2011. This is the ONLY evidence we have of her being with me in the same household, however it doesn't reflect the first five months. =S

Secondly, regarding the joint finances, we really DON'T have much to show. The only thing I can think of is we opened a credit card account where she is an authorized user under my name. If we send in photocopies of our credit cards with the same account number and date of 10/2012 this is about all we have. I wonder if this would be sufficient?

Furthermore it describes further examples of evidence of a good faith marriage. However, none apply!

    • We have not had any kids.

    • We have not signed any mortgage agreements, deeds, or other instruments affecting the title to real estate ownership of assets or property.

    • We have not purchased any vehicles and the vehicle we do have is in my name from before I met her.

    • We do not have life insurance, medical insurance, nor is she on my vehicle insurance as she does not have a full driver's license – only a learners permit – and my insurance company said they would not put her on until she got one.

    • We have not purchased anything with loans – no car loans, no home improvement loans, no business loans, etc.

    • We sent our rental agreements already but apparently that wasn't good enough! Haha.

    • We do not have joint utility bills as they were in my name already before she moved in. (If we were to move I could see adding her but the thought never even crossed our minds to add her otherwise.)

    • No military Basic Allowance for Quarters as I am not in the military.

    • Any other documentation which shows that the marriage was not entered to circumvent U.S. Immigration laws – we sent in two affidavits of support, phone records, joint bank records and joint tax returns.

So, TL;DR – They need our photo ids, hers is 'expired' as it was a learners permit good for one year. It shows a date of five months after she crossed the border with our current address on both ids. Our evidence of good faith marriage was not good enough, the ONLY thing we have to send in is a credit card statement opened in October of 2012 (nearly a year after she got her) where she is an authorized user so we were thinking of photocopying those and sending them in. (They have the same account number, and reflect our names.) We have no other 'supporting documentation' as shown above this.

    What do you folks think?

  4. So we're going for our interview next week... From reading on the courier services website they mail her passport back to her right?

What does she use for ID?! (If they do in fact take her passport from her.)

All she has for ID is her passport.

    • Will she be able to fly back home without any id?
    • How do we pick up the packet that's sent via DHL. They require a waybill and official id... but the ID is IN the packet!?

And before you suggest... no she doesn't have a license or ID card. The only photo ID she has is her passport.

  5. Ok so, being afraid I missed something I would like to ask if I messed up anything by slightly modifying step 5 in this link:

    http://montreal.usconsulate.gov/content/visas/pdfs/HowtoRegisterforDHLCourierServicesENG.pdf

I clicked "register for courier services" instead of "Schedule an appointment"

Also for step 6 I selected "Perm Immigrate to US Ready To Schedule" (I believe)

Any input on that? The damn link for this information from the PDF we were referenced to didn't work for the consulate page! It had the right link to this page though:

    http://usvisa-info.com/en-CA/selfservice/ss_country_welcome

I got an idea and googled the site and found the rest of it luckily but I'm afraid I may have already screwed stuff up? lol

  6. Hey guys 'n gals!

Got back up and running and got all the paperwork put in etc for the NVC IV packet and after a few days on Sept 22nd we recieved this email:

    Dear Sir/Madam:

All documentation necessary to complete the National Visa Center's processing of your case has been received. As soon as an interview date has been scheduled, the applicant, petitioner and attorney (if applicable) will be notified.

The applicant should NOT make any travel arrangements, sell property, or give up employment until the US Embassy or Consulate General has issued a visa.

The US Embassy or Consulate General may require additional documentation at the time of the interview.

    Regards,

    NVC Document Review Team

It's been about 10 days, but I can still log into this site:

    https://ceac.state.gov/IV/Login.aspx?signout=true

Is that the place I check for the SIF? If so, I can still sign in! Is it normal it takes about 2 weeks after they send an email like this?

Just getting impatient perhaps, but everythings finally moving again and it's all I can think about! hehe

Also, anyone have any ideas when our interview will be in Montreal? I'm thinking maybe November??

  7. Ugh, this sucks seeing all of you going for september! =( Congrats though! hehe

We're still waiting to get the passport for her so we can fill out the DS-260 and send in the IV packet... ###### taking forever! =(

I haven't seen her in 9 months now... we were hoping to go on a trip to Montreal while we were up for her interview! =( =( Ugh, only a couple more months before we get to go to the interview...

Also sucks because I was ahead of the NVC delay... everything was going so great! =S

I get so depressed and just want to stay home and sleep until we can be together, I have no desire to do anything =S

At least something I may be excited to look forward to: Once you guys got case complete at NVC, how long did it take for the interview date to be scheduled?

  8. Hopefully someone going through the IR-1/CR-1 process in Canada right now can chime in and give you an idea of how long you will wait.

Oy! You scared the poopie out of me! hehe

Looking through some recent timelines (thanks for that idea!) it looks like NOA2 to Interview Date is anywhere from 3-5 months... which is about what I was expecting. We got NOA2 in June so we figured about Oct / November... if anyone's lurking this, chime in! Does that sound realistic?

  9. Montreal books 3-4 months out and you can't book an interview until you're given the green light.

Holy #######! Don't tell me that... that's nearly as long as it took just to get through the whole paperwork process!

But seriously, after we get the IV packet and all that jazz sent out... and everything's complete at the NVC... I should expect 3-4 months (plus perhaps a month so 4-5 months) until she actually has her interview!?!?!?

  10. Well she's still a Canadian citizen and resident. yes, we're in the midst of our cr1... we need a form of id in her married name for her passport application... so I was hoping someone who had a simple name change would be able to chime in and say if it really DID take 4 weeks to simply change the name and reprint a card. we need to send a copy of the carecard in with her passport application.... this is our last step before she gets her interview date and its a punch in the face its going to potentially take a month extra!

canada passports suck! why cant we just send in our marriage certificate... but no they need something in her married name. i dont see the difference!

  11. Hey Saylin! Question for ya:

I'm on the payment portal - I paid the AOS Fee, submitted my I-864 and filled out the Choice of Agent form. (Choice of Agent/DS-261 was filled out on the 11th).

So, for the past... oh 3 or 4 days now... I see next to "IV Application Processing Fees" it reads "Pay" as a blue hyperlink. When I click on it all I see is the 88 dollars I've already paid for the AOS fee, and the place (I'm assuming) the IV packet fee will be present is blank! No name, etc below the bold words "Applicant's Name" etc. Ultimately, no 404 fee!

I've called off and on... and all I get is "Why are you trying to pay before you get a bill?"

To which I ask: Why am I getting the option to "Pay" before I get a bill then?! It used to have "Not Paid" in blue, but not a hyperlink... it's only changed a few days ago! =S

Any experience with the process past the DS-261? It's already been 5 business days as of today and still I can't pay! =S

    (As reference: http://i128.photobucket.com/albums/p174/smurf47/Immigration/Payment%20portal%20screenshots/IVscreenshot.jpg )

  12. Well called the NVC, lady nicely explained to me that they JUST got my choice of agent form yesterday and to give it 1-3 days for that site to update. When I explained to her why I was calling (being able to click on Pay Now but nothing seeming to change) she didn't seem to care much, but did elicit a "Humm.." lol. Either way its weird as I already received an email stating I am her "agent" but... whatever =P I guess I'll give it a few more days! =D

  13. this VERY same thing happened to me. You need to make SURE that it's a return ticket. It should be for a period less than you are planning to stay. A couple weeks would be best. You will absolutely be denied, especially if you can show no source of funds back in Canada and no job. I was denied entry. Took years before i stopped being questioned at customs. Spend the money...you won't regret it.

    btw...I'm now a naturalized citizen...many years later.

Going from Canada to the USA - yes definitely have a return ticket... same thing happened to us.

Visa versa though I'm not too sure...
