    I just may add ,yes there is no divorce here but you can file recognition of foreign divorce .

    Unfortunately, I am actually still married to him under Philippine law. I divorced him in the US, and it was granted. Since there is no divorce in the Philippines, I am still legally married to him in the Philippines, since we did not file for annulment. Anyone who is, or had the same case a mine would know, that annulment is such a big issue here, with all the hypocrisy. With the divorce, we have joint custody.

    With regards to the affidavit, I have just talked to someone here on VJ who recently had the interview with her daughter, and she did not have the consent. I am awaiting news from her re: her departure and at the POE.

    I know prayers and a positive attitude is not enough, but that's all I have at the moment.

    I am thinking, if the father comes to the airport and my son cannot board, I will wait till he turns 18. We would have to redo the medical, but i would have 3 days leeway between his 18th birthday and the expiration of his visa for him to come over to US.

    Any thoughts...?

  3. hi sis thank u!... yes un sa akin din one paper lang single and married name ko ay AKA ko.. un isa kong nbi kc sis discrepancy ko un sa long Maria ko (BC) at short Ma. ko sa school records, MC, at my son's BC un kasi ang napasulat eh... kaya dlawa un NBI ko na merong AKA..

    and BTW they didnt look or ask for my affidavit name of discrepancy... :star:

  4. Japan doesn't allow dual citizenship except in cases where you obtain it by birth when another parent is a citizen of another country. By 22 your child will need to chose whether she keeps it, or gives it up. She won't be allowed to keep Japanese citizenship if she keeps PI. If she becomes a USC then she forfeits Japanese citizenship anyway but PI allows dual so she won't lose that.     The US doesn't care how you enter on your K1 (I assume your daughter has a K2). You could fly all around the world for all they care, it's just that entry into the US that matters.

  5. If I understand you correctly, you are asking if it is OK for you, a PI citizen, to enter the US on a K-1 visa from a flight originating from Japan, rather than from a flight originating from the PI?

    I'm virtually certain that should be fine. The K-1 allows you to enter the US - it places no restrictions [that I am aware of] on where you are flying from. CBP won't particularly care that you're coming from Japan rather than from the PI, and even if they do ask, you have a perfectly reasonable explanation - visiting your daughter before you get locked into the US for a few months.

    Sounds fine to me.

    Hi,thanks for the reply. Originating from Philippines then will stay for a couple of weeks in Japan before flying to US. I am not visiting my daughter ,she is with me all the way.

  6. We're on the same boat . My fiance have only one I-34 for me because he said my daughter's name was already tdeclared there but i read your post and just want to be sure i asked him to have another one for my daughter smile.gif

  7. The answer is country specific. The Philippines is unique in many ways regarding this. First, please clarify the circumstances, as there is no divorce in the Philippines. Were you married to the child's father when the daughter was born? Do you have full custody?

    @pushbrk thanks for the time ,yes there is no divorce in the Pihilippines ,i got divorce in Japan and i filed petition of recognition of divorce in the court here in Phiippines which was granted so i have no problem in that thing.Yes i was married when i have my child and i have the full custody since we divorce .

    First just wanna say thank you all VJ's ,this site really helps a lot :)

    I am divorce for almost 5 years and i have a 13 yr.old daughter from my ex husband . We just got our NOA2, now preparing for the next step. My question is do i need an authorization letter from my ex husband for my daughter to join with me K2. We have no communication since then and i raised my child with out him in the picture .Any inputs is gladly appreciated,thanks you so much :)

  9. ay sis, i looked for Aichi-ken police headquarters pero wala naman specific na namention na docs na kailangan. they have a phone number though that you can call if you want, perhaps they could tell you specifically what to do. here is the number :052-951-1611

    in my case i have to show them my passport and original letter from US Embassy in Tokyo with my name and case number. they copied the pages of my passport and the letter. mas mabuti siguro if you submit the NVC letter (it will have your MNL case #). kung sa manila ka naman nakatira i think it will be easy to apply. pero sis 2-3 months ata according to Japan Immigration.

    Hi sis,thanks for the info and effort :) Will do it here in Pinas. I just thought if i have the copy of NOA2 alone i can get that request papers so we can do it soon coz the processing time is 40-45 days another waiting game ;)

  10. We are still waiting for our NOA2 but i have a question hope anyone can help or share something. I live in Japan for several years so its one of the requirements in USEM .. the Japan Police Clearance. My queastion is ... is copy of NOA2 enough to bring to USEM to get a "Request Letter for a Japan Police Clearance" or needed NVC letter too? Thanks in advance :) Goodluck to all of us ...
