  1. In our county in, Georgia, the marriage certificate does not change your married name. The marriage certificate lists your maiden name and shows that you married your husband. HOWEVER - when you obtained your marriage license (prior to marriage), the license requires you to specifiy the name you want to use after you are married. When you are officially married, your name changes to the one you listed on the marriage license. My wife specified that she wanted to use her dads last name as her middle name, and my name as her surname.

    Everything was fine in that her Social Security card was issued in that name; her military dependant ID card was issued, TRICARE ID card, and EAD were issued without problem. The problem started at the AOS interview when the official refused the recognize the name change. I told her again and again that the clerk of the court certifying the name change on the marriage license was in fact a court order.

    Anyway the Green Card was issued with the wrong name (birth certificate middle name). We immediatly sent it back with all the supporting documentation outlining our position, and insisted on a no fee change. About eight weeks later a corrected Green Card showed up in the mail with the correct name.

    Omgsh!! Thank you so much for writing me back!!! Is there anyway i can send you a massage with my e-mail and you could send me a copy of the documents you send to immigration and where you send to. Of course you can hide all your personal information, case number, etc. I would just like to have an idea of how to write the letter to immigration and not have to go through any more problems. Please, this would be such a great help. It's been so fustrated since i left that interview room and having to the court, and trying to get as much information possible to do this. I feel so relief that this worked for you and i hope this can work for me. please I would really appreciated. Thank you so muchhh!!! :D

  2. It sounds like the court is telling you information on how to change your name through the courts, not through marriage.

    If you already used your marriage certificate to get your SSN and ID in your husband's name, then make an infopass appointment and take your social security card, ID and a copy of your certified marriage certificate and tell them no court order is needed to change your last name to your husband's after marriage in North Carolina, and there is no reason to go through changing your name through the courts to get your legal married name on your green card.

    I already showed them my ss and I.D when i had my interview. I mean my EAD also has my husbands last name just like it is on my marriage certificate. The officer just wont do it with the green card unless i have a court order. It's very confusing.

  3. What state are you living in and what state did you marry in?

    It sounds like you didn't complete your marriage certificate in the manner for your state that gave an automatic name change. There are 3 kinds of marriage certificates in the US:

    1. Mentions both married AND maiden name. (Name can only be changed to what is written on marriage licence)

    2. Mentions only maiden name (can be changed to husbands surname or variation thereof.. like hyphenation)

    3. Mentions only MARRIED name (can only be changed to this name)

    I personally have #1 and listed my husbands surname as my own. Some states only have one place to mark your name and make you write and sign the NEW name if that's the name you want.

    I live in North Carolina and I got married in North Carolina.

    I had no idea about the whole marriage certificates. My marriage certificate has my old last name as my middle name and my husbands last name.

    ex: if in my birth certificate my name was Paula Andrea Martines Torres

    I put name new name on my marriage certificate as Paula Martines and my husbands last name.

    However, the officer said i need to keep my middle name as my middle name is on my birth certificate and just change my old last name to my new one.

    I however, would like to get rid of my middle name and use the first last name as my new middle name since its my parents last name and use my husbands last name as my last name but it looks like im not allowed to do that unless i have a court order.

    The interview was easy except for the part that i didnt know i had to get additonal vaccines after entering the country. Therefore, i had to find a surgeon that was willing to the additonal vaccines at the last minute. So i went to the interview, left and came back to the uscis office. It turned out i didnt need any additional vaccines but they still wanted to have a report from the surgeon to make sure. So I had to pay $30 dollars so for the surgeons signature on my vaccines. Anyway, it was approved but then i had an additional problem with my name. When my husband and I got married I change my name and put my old last name as my middle name and took my husbands name as my last name. Therefore, the officer told me i couldn't do that even though i had it like that on my marriage certificate. He said i would have to keep my middle name and use my husbands last name and thats how he issued me my green card. He said they only way i could change it would be by getting a court order allowing me to do so. So now i have all my documents with the name that is on my marriage certificate, a passport with my maiden name and i green card with a different name! it's insane. In order to get the court order approval i have to provide fingerprints, state criminal records and national criminal records (which the national criminal records alone can take up to 2 months) Im very stress out

  5. When i went to my interview for my green card the immigration officer told me i couldn't change my old last name and put it as my middle name. He said i would have to keep my middle name then my husbands last name on the green card even thougt, I have my first last name as my middle name and my husbands name as my last name on my marriage certificate and all my other documents I.D and credit cards, etc. The officer told me that they only way to legaly change my name would be by getting a court order saying it was ok for me to do so and it's a pain in the ####(excuse my language). You need to get fingerprints, state criminal records, and national criminal records. national criminal records it self take up to 2 months. After that I would have to file an I-90 and pay the fees to have the name change. It's very fustrated and Idk what to do it's really stressing me out. Should i just keep the name they are giving me on the green card and change all of my other documents and change my name back to how i have it on my marriage certificate when i apply for citizenship?

    Please if you can give me any kind of advise it would be great!

  6. So I had my AOS interview yesterday in Raleigh, nc. And the offerer told me I count get my green card under my married name since I didn't have an order by the court saying its legal and ok for me to do so. I told I was using his same since we got married and he said I couldn't. So now I have a gc with one name, SS and I.D. With another and passport with other. I went to the court house this morning and told me I have to get background checks and fingerprints done plus pay 120 dollars to do so and it can take up weeks!!

    I'm nervous that when I go apply for my new SS I would get it with my maiden name since I would have to get a new lisence, credit cards and insurance card, etc.

    Has anybody gone through this before? Any information would help. please!!!

  7. Hello All,

    We send our Waiver application to Atlanta back in November of 2010. We got our senator involved in our case to help us find out where are application was and to find out the status. We got a noticed from the senator on March 1rs saying that our application had been approved :D

    However, we have not received an approval noticed?! How long does this usually take?

    The senator called the NVC office to see when the application would be send to the embassy and to our surprise it was send las week :D

    Im afraid to re-schedule a new interview without and approval noticed! should i re-schedule a new interview and take the noticed the senator gave us? or can we get in contact with the NVC and request an approval noticed?

    Any advice would be great! Thanks in Advance

  8. Hello Everyone

    My fiance just send my I-212 to Atlanta on Tuesday. Does anyone know how long this process usually takes? I read the its suppost to take about 4 months but from reading at some forums it looks like it takes a while. Is there any way to get the process moving any faster?

    I also heard about the Info pass you can get and go get some information. My fiance would like to get one so he can go and get information on our application but we are not sure how to start this pass. Has anybody done this before?

    Any help will be appriciated

  9. Did you send the forms by mail or email? Maybe it just got lots in the mail and they never got it. You can always call the embassy and ask if they have received your forms. That happened to me. I had send them and i call the embassy about a week later to see if they got it and they said they had never received anything. They told me the best way to send it was an email. I emailed them the forms and i got an email back for confirmation the next day. After you send the forms, You will have your interview about 6 to 8 weeks later.

    I have seen some cases where some members send DS3032 email right after finding out the NVC Case #. It appears after they recieved their NO2 approval by email and within 3 days or so they were able to get the case number from NVC phone and right after they send out DS3032 email.

    Hey im really confuse at the Moment. My aunt a USA citizen applied for my dad under a I-130 petition in 2004. We were deported from the USA in August, 2009. However, the petition got approved November, 2009. Since we moved out of the country, we dont longer have the same address. Im worried that my parents are not gonig to get any of the information they should get from either the NVC office or the Embassy. Since im the only one that speaks english in the family im trying to do my best to help them out with the process. I left the states under age at the time so i dont have the 10 year bar. Im moving back to the states with my fiance this month and i really wanted to be able to leave them with answers before i left and some forms fill out for them to be able to use when the time comes. So i have several questions

    1. I noticed that forms DS-3032 and DS-2032 are being mentioned. What is the difference between both of this forms?

    2. Also, since we are not in the states anymore do we still have to pay for the AOS fee? I read on one of the Forums that you dont have to pay for it if you are outside of The USA. Is that true?

    3.Does each of the applicants mentioned in the petition has to pay the IV fee? Or Should we only pay for the Dad since the petition is under his name?

    4. Also, how do we know if forms DS-230 needs to be send to the NVC office or the Embassy?

Big mistake you did buying a passport, its a felony, menas is very bad situation you are. yes, you will need a waiver, because now you are ineligible for a visa, what I know is you have to go to the embassy in your country and ask for a waiver, the consul will tell you if you can apply and give you the papars to do it.

    Do you know if they give it out on a specific day and if it has any cost.

  12. Thanks to GOD, Our Journey is about to end. We are about to close this long chapter in our lives. After a deportation back in 2006, the IR1 Visa for my wife and IR2 visa for our 2 year old baby was approved on Sept 22, 2010.

    I was helped by GOD in many ways. However, there's something I will never forget: GOD used someone here on visa journey to make all this happen: bocajr27, member of visa journey, not only he guided us throughout this difficult process, he gave us HOPE.

    Hey,

    Im empress that your waiver after being deported was approved so fast. We were also deported last year but im going back to the states next month with no problems since i left the states under age. However, My dads sister filled out a relative petition for him and it got approved on nov of last year. Do you think he would need a waiver to go back to the states? Was it hard to fill out the waiver or did you need help from a lawyer.

    Any advice would be great.

  13. for a brothers petition it takes about 10 to 15 years. The USICS are just now approving applications from 01 DEC 01. But for parents the process its a lit faster. I believe is about 2 to 4 years and brother that are under age would be able to fly with them. Also, Make sure that when he fills out the petiton for a bother that has a family to include them in the application. Otherwise, they would have to do a different process which it would be more time and money.

  14. Im not sure how long its the waiting period in jamaica between each package. However, if you have already send forms DS-230 part 1 and DS-2100 to the embassy and they told you they got it thn you are good. You should still try to download package 3 online so you can know all the documents you need to have to take to the interview. Dont worry about recieving a package 3. You already send them the forms and thats what really matters. Many people dont recieved package 3. However, you should call the embassy so you can get your case number and request a package 3 if you feel like you need it. After you send the forms you will recieve a package 4 where indicates when it your interview. You will need that letter to pay for your visa interview fee and get your medical exams done. In Colombia, it takes about 2 months to get your interview after the embassy has recieved your forms.
