  1. Hello,

    My grandfather has an interview next month. I remember me (the co-sponsor) and my grandmother (petitioner)both filled out a copy to NVC as a part of the AOS packet.

    Do we need to send my grandfather a new batch of I-864? Don't they already have copies of these when we first submitted it to NVC?

    I'm a bit confused and could use some clarification.

    My grandmother is in the process of sending her DS230 packet. She has the following documents being mailed to NVC:

    DS 230 Cover Letter with Barcode

    1. Completed DS-230

    2. Passport Boigraphic page copy

    3. Birth Certificate (not original ....certified is OK)

    4. Police Clerance Certificate from Local police station(Original_

    5. NBI Clearance

    6. 2x Passport size pictures(2X2 size...write name and case number behind pictures)

    Her previous spouse has died thus voiding their marriage, the question is do we also need to send a copy of the death certificate for the prior marriage? I remember sending that with her I-130, not sure if we need to send it again.

  3. I would like to be a co sponsor for a peitition for my Grandfather.

    On the first page of the I864A under the "Who may be considered a household member of this form" it states:

    "A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent or sibling"

    Technically, if my understanding is correct I don't fall under any of those categories because I'm the petitioner's grandson, though we both live at the same residence.

    Can my grandmother use my income as a joint sponsor in this case?

    I hope y'all would use a bit more patient with my questions. I tried to to look for answers by using the search button but came out empty handed.

    My grandmother just received her Case # from NVC, I understand that we can just e-mail NVC the Choice of Agent form, is their email NVCINQUIRY@state.gov current?

    I'm also going to be the sponsor for her husband (my grandfather), does this mean I have to file a seperate I864? Thank you all.

  5. Good to know maraming Filipino dito. May question lang ako, sana mabigyan nyo nang linaw ito. Yung lola ko po naka receive na nang approval notice sa USCIS. Nabasa ko po na it may take 3-4 months bago maprocess nang NVC yung case nang lolo ko. At this point, dapat po ba maghintay lang kami nang letter sa mail? or dapat po tawagan namin ang NVC para mag provide nang e-mail para sa choice of agent and affidavit of support letters?

    Mayroon po bang step by step link para sa process nang NVC? thank you very much po and god bless! :thumbs:

  6. Long story short, my grandmother filed a petition for her spouse in 2009 as Permanent Resident. She filed for a US citizen this month and hopefully gets approved ASAP.

    Once she becomes a US citizen, how do we proceed in updating her spouse case with USCIS? Do we just call them and advise that she is now a US Citizen?

    Also, how long does it take before cases filed in Spetember 2009 are approved? Is USCIS still going by the 3-5 yr timeframe?

    Any help is appreciated. Thank you.

  7. You can go to the court house where your grandmother was married and request a copy of the marriage certificate. I am sure they will be able to look her up by name.

    In the Philippines, marriages performed during the 50's are hard to pull out since the conversion of digital and electronic filing.

    Sure she can remember the approximate year of that marriage, USCIS does not require proof of a previous marriage. But certainly wants proof that marriage was legally terminated, either with the divorce papers or in her case, a death certificate.

    Had no problem in remembering the date of my previous marriage, that was a day of infamy. Does she have children of that previous marriage? Woman are normally good at remembering dates based on other things that happened in that same time frame.

    Unfortunately she does not remember. She has a condition of forgetting things at this stage. She knows the Month but that is all. I really dont want to put falsifying information there just for the sake of filling out the blanks.

    Good thing however is that she has an original and certified copy of her previous husband's death certificate,

    AS the man is deceased and not going to be party to any immigration process rough dates are probably fine. If you are already attaching an extra sheet, simply make it one of the items with additional info. Then state that your grandmother has no written record but they were married for ( about) X years and the best date per her memory is xxxx - yyyy

    I was thinking of just doing this when all other options are exhausted (which in this case is limited to begin with). I'll just write a letter on her behlaf and have her signed it advising that she does not really remember the exact date of her previous marriage.

  8. The dilemma here is that my grandmother does not remember her previous husbands date of marriage. He passed away August of 1975, on page 5 of the N400 form, there was a question asking for her former spouse's date of marriage. Do we put N/A and provide a letter or just type deceased and hope USCIS picks up on the fact that she's 74 y/o and her previous husband has passed away 35 yrs ago.

    Pls advise. Thank you.

  9. My grandmother has hit the 5 year mark last month to be elegible for naturalization. But she was out of the country for a total of 5 months during that time. That being the case, do we subtract that from her residence of 5 yrs and wait till she accumulates those 5 months back, or can she apply now since she has a total of 30 months of residence in the country?

    Any help is appreciated. Thanks.

  10. My wife's interview was approved!

    It took less than 5 minutes for the CO to advise her Visa was approved. The wait is finally over. Thanks for all the wonderful people here at VJ. You guys are like family. I love how each and member looks out for the best interest of the other. I know I have'nt been very active lately, but I lurk from time to time and its so gratifying to see how everyone with different creed, race or religion all unite as one in this board. The wait sometimes can be really frustrating but its very rewarding at the end. Im praying for those remaining hopefuls to have an easy process as well. God is truly great.

    Screener asked her two questions, very friendly.

    What does your husband does for a living?

    What do you do for a living?

    CO was also very nice and friendly.

    When is your B-Day?

    Your petitioners name?

    When did you got married?

    Looked at a few pictures, and thats it.

    She brought a boat load of paperworks and not even one was asked. Her CO said everything was filed perfectly, so Im guessing I did something right at the USCIS and NVC stage, thanks to you guys of course. Now, im off to find some airplane tickets for me and the wifey. =)

  11. I'm sending an updated one. Even if nothing had changed, I was still planning on sending a new one, just in case. Husby has printed out new DS-230s as well, since the form changed. One is listing his residence since birth, like the one we sent to NVC, and one is listing it since age 16. I'd say send a new one. If you send it today, maybe you can choose a less expensive, but slower postal option.

    Edit: I'm an idiot. 5/14 is not 6/14 like I was thinking. So nix the part about sending it slow. Overnight that baby! It's worth heading off a potential 221g document request.

    True. Ill Fedex this baby tomorrow. Can't take any risks.

  12. Until know you haven't received any appointment letter yet? Though the NVC told us to call them 2nd week of april for the scheduling but it surprised us we got it that quick..

    Might depend on the country but i hope you'll have yours soon, i know how it feels we'd been there too.

    This is what im talking about lol. I dont care what they say, I will be calling them next week to see if we have an interview date ready for us. :whistle:

    Returns/W-2s/1099s are fine for 2009.

  13. I thought I'd add to this sachi, if you don't mind. I'm sure there are some in the same position as me - I don't want to file yet because I'll owe without being able to file jointly with my wife and if I use the W-7 form for an ITIN it has to be snail mailed + they require as many documents as NVC does!! I was worried about not having my return for Merlaine to take with her to her interview so I called my tax guy. If you are due a refund, you DO NOT have to file before the April 15th deadline. You can file at any time and will even be paid interest on the money you're owed. At his suggestion, I drafted a letter explaining why I was going to wait to file and attached copies of my W-2's. I can't believe that 3 years of transcripts and that letter w/W-2's wouldn't suffice :) I guess I'll find out in May (oh god I hope) :unsure:

    Per the US Embassy's instruction in Manila's:

    "Additionally, petitioners (or joint sponsors, if needed) filing an I-864 AOS are required to submit ONLY ONE YEAR'S TAX RETURN, THE MOST RECENT AVAILABLE AS OF THE DATE THE SUBMITTED I-864 AOS WAS SIGNED (this is a change from the previous requirement of submitting tax returns from the three most recent tax years)"

    You just need the most recent ITR. I was going to send the past 3 yars to my wife, but after reading that, ill just send my ITR for 2009 (packet that was prepared by our local H&R) along with transcripts for 2008,2007 and 2006.

  14. Well, I called NVC yesterday and was advised that they are going to start scheduling interviews for May next week. I was told to check back around April 15 or 16 for an e-mail confirming my wife's interview date. I honestly dont think I can wait that long, so ill give them a call next week again just for the heck of it.

    Our embassy is in Manila, Philippines. So if there's anyone out there that has a scheduled interview for the month of May, please chime in.
