If we were in that situation, would ask the USCIS, since it's their law that we must carry a green card wherever we go, how can we do that if we have to send it back to you and wait six months?

With that crazy I-751 thingy, had to carry an expired green card with the one year extension notice, neither was good without the other.

Thank you all. I think I'll submit an I-90 first. Next I'll attache at the naturalization file a copy of the I-90 form aand the postal receipt and an explanation why I sent back the Green card? Do you think this would work?

I applied for conditional Green card in 2005 and I received the approval in 2006. On that card said "Resident since: 08/03/2006" I still have a copy of that green Card and the original of the approval letter (I-797, Notice of Action, Welcome to the United States of America) with Notice date 08/04/2006.

I applied for "Removing Conditions on Residency" in 2008 and I received my new Permanent Card in 2009. On my new card says "Resident since 04/20/2009. "

Is this a mistake?

Shouldn’t be "resident since 08/03/2006" the date I became conditional permanent resident based on my marriage with an American Citizen?

Would be a problem with my Naturalization file due to the date ( 04/20/2009) on my new Permanent Resident card?

I think almost all that you said here is wrong...

Part 1 is the daughter name ( she is the one who need conditional removed)

Part 2 . Yes, need to be checked 2 b and have a separate document where you will exapain why the dauther is filing a separate I 751 petition.

Part 3 is again the daugher

Part 4 is you the sponsor means the US citizen ( I AM NOT SURE HERE THAT IS WHY I NEED MYSELF AN ADVICE)

Part 5 is the daughter who just file N/A if she doesn't have her own children.

Part 6 is just your daughter signature if she is able to sign.

Part 7 Must filled out only if the daugher is just a little girl who can not file by her self this form and will be you or your wife.

I am still hopping there is somebody here who can tell us if this is corect or not. I really aprecite if someone can help us!

Thank you all for trying to help but I would like to be sure how I must file the separate I 751 for form my daughter. I can not aford to send the file wrong in September because she will travel in Romania in December and she will be back in January when the conditional card is expired. She is filing separate because :

1. She is almost 22 years old;

2 She applied and received her conditional green card 1 year later than me.

My husband visited me in Romania in 2004 and we used Adrian Accommodation.

We were so impressed by their professionalism. Also they can provide transportation from/to airport. More than that when we left the apartment (we rented for 2-3 days) my husband forgot his wallet in the closed...we came back and the cleaning lady returned us the wallet immediately with no hesitation and any problems. My daugher is a K2 and she achieved permanent resident status more than 90 days after the my K1 ( she fallow me in USA after 1 year) , so she will file her own I-751. I would apreciate if somebody can help me to undestand how she should file out "Part 4 Information about the spouse or parent through whom you gain your conditional residence"

The parent through whom she gained her conditional residence is my husband , the US citizen and her step father or me K1 visa and her mother? Which name should be there mine or her step father, the US citizen?

Also at "Part 6" the only signature should be there is my daugher's signature, is that right?

Eu ca sa merg la ambasada trebuie sa iau avionul.... Am trimis prin posta la Tallahasee sa mi se puna apostila pe procura si certificatul de casatorie si mi s-a intors plicul inapoi ca cica nu il au in baza de date pe notarul care mi-a certificat imputernicirea si traducerile...Notarul e de la banca mea !!!???? Am printat alte procuri si bineinteles traducerea certificatului de casatorie, m-am dus iar la banca si am cerut alt notar sa mi le certifice si le-am trimis din nou in Tallahasee la apostilare. She can apply for SSN after 2 weeks here in Florida. Next you need to get married in order to appply for AOS. Is better to apply for AOS after you move but if she wants to work she will need work permit. Let you fiance know I'll be happy to assist her whenever she needs because we speak the same...language.

Well...I just did...and they told me to send the appointment notice back and request to change the location. That means it takes a while till they'll send me back a new appointment. So...I'm going to change my vacation from Orlando to Jax than to change something in my immigration process....I just told my husband and he thinks in the same way. So as I said: Don't worry! In Jacksonville, Fl not in Orlando, Fl as all the app. in all those years...My 3rd aniversary vacation was planed in Orlando just to be there for an eventual app. The appointment is exactely in the middle of my vacation but not in the right place. All our biometric and all the interviews had been in Orlando....untill now...It's so frustating, and Jacksonville is so far away to my home town and, of course,Orlando.

I am Romanian and I went through a divorce and I hope I'll help you a little bit.

Where is her son right now? With her or with his father? If she will divorce the judge will give her the son (Romanian law is protecting the mother usually) not him but the son need to live with her. After divorce you should apply for K1 and K2 visa but the son needs the father consent to fallow her in US if the son is less than 18 years old.

She can divorce without return in Romania and for that she will hire a lawyer to represent her. You can find online a lawyer company in Romania that can take care of her divorce. Also the lawyer can find a way to get his consent to let the son following her. There must be something that he care of, if he is an alcoholic maybe he care more for having money for alcohol than her and her son, maybe if she will sign that she do not need any alimony or she don’t need anything else ( house, car, money) in change for his consent. Be carefull, ask the lawyer if there is a general consent not just for letting the son go to Italy.

My GC is valid until August 2008 and my passport will expire on February 2009. Do you think they will stamp my passport if it's not valid 1 year or more? I have no chance to renew my passport so fast because I just find out that I need to register my marriage in Romania in order to get a new passport so all the process will take at least 7-8 months. Also in order to renew my passport I need a valid GC…..

What about I-797 (NOA, stating that green card has been extended for 1 more year)? TSC is still sending this one or the only option is an appointment to get the stamp in passport?

Does anybody have a clue what should I do?

I am so sorry for this so I'll do my best to help you out.

Open: www.uscis.gov

Click on "Immigration Form" (second option on top of page)

Scroll down until you will find the Form I- 751 and click on " Petition to Remove the Conditions of Residence"

Scroll down and click on " Download I-751 (1119KB PDF) " .

On top of the page of I-751 Form you will find as first option " Save a copy". Click on " " Save a copy" and a new window will show up. On top is " Save In" and you should chose " Desktop", after that click "Save" on the bottom of this window. In this moment the form is downloaded in your computer and you can fill it out in the computer or you can print it and after that fill it out by hand.

When you print the page on the bottom of the first page should be a Barcode. If this will not show up that means you need to print this page on a better printer.
