i just decided to write her tonight ..i file vawa on october 2008 and i never heard any thing from VSC NO RFE im in my 2nd prima facie i just dont now what to do

its been so long im tired of watting its been 15 month now i send letter to the senteor and still nothing my case is outsid the processing time and still nothing

what should i do .. do you guys thing that somthing wrong with my case

You should talk to a lawyer or just go and set up an info pass or just call .

I'm sorry you are going through this. The only evidence that matters to immigration is evidence from police Take the camera and tell them about the abuse and the fact that he's stalking you. The problems are marital because you have not submitted evidence of abuse(you haven't went to police to let them know of what happened to you). The evidence from cops is what matters not what tapes you show to an immigration officer(that is not their jurisdiction-immigration doesn't handle domestic violence issues). As far as immigration, I don't know what advice to give you since you are in deportation but this is what I would do if I were you:

-I would buy a ticket back to Romania and leave this nightmare behind

or

-I would hire a lawyer, though I don't know if he can help much

go to vawa fourm and read thier post ....dont panic relax and what type RFE the send you , good faith or abus most poeple get RFEand NOID and they terned around so jus relax and see what you need to do seek an immigration attorney

i did went to a doctor mental doctor to evaluate me and encourage me to follow sesions because i m still affected even if i try to hide it .

they also said that the tape its a prove that he was controling all my steps so i guess i have to use it .

on oct of 2008, i arrived here in US and got married with my soon to be xhusband of dec 2008, same yr i flew here in US..

on may of last year, he was arrested of domestic violence and imprisonment..

he did abused me in so many ways too...

it was my friend called the police, I got most help..

I live in the shelter for 3mons before i was able to start get back my feet..

I got my AED June of 2009 and right away found a job..

he did withdraw the petition somewhere last year when he found out that I am working..

I got probono's atty's and on the proccess of working both my immigration papers and my divorce..

but it sucks for nothing happend yet!

I am super duper stressed out right now due to my AED will expires May of this year and with that, I am out of status again and can't work anymore!

I am totally lost by now..

I have all the evidence(my immigration atty has it now) and all the pics and my soon to be ex-husband pledid guilty of the case against him..

I would suggest, go to court and ask a protection order..

my soon to be ex-husband can't go near me for if he does, he will be back in jail..

find WIC or other shelters that can help you, the best way for you is to be in the shelter as of the moment and they can help you out with your case...

I did get help from those institution and am under VAWA..

you can also ask help from CATHOLIC CHARITIES in your area... they can help you find a probono immigration atty..

google it so that you can find where is it in your area.. also WIC shelter, or other agencies.. they are much connected to one another to the other..

Lawyer, lawyer, lawyer. No one on this site can advise you (or should advise you) in such a situation. If you cannot afford one, check with Catholic Charities in your area. They should be able to help for little to no cost.

I have filed for an I 360 ON DEC 2008 GOT THE PRIMA FACIE FOR 180 DAYS AND I VE NEVER EXTEND IT

ON FEB 2009 I GOT MY WORK AUTORIZATION ALSO FOR A YEAR .

I ALSO SUBMIT THE PAPERS FOR GREEN CARD I485 AND I GOT ALL THE RECEIPTS.

nOW AFTER A YEAR THEY ASKING ME FOR MORE EVIDENCE ( FEB 7 2010) AND THEY SAID THAT MY ISSUES ARE MARITAL PROBLEMS NOT ABUSE . I HAVE AFFID. FROM ALL MY FRIEND WHAT I TOLD THEM AND 1 FRIEND WITNESS BUT NOT EYE WITNESS SOME THINGS THAT HAPPEND BETWEEN ME AND HIM .

AT THIS POINT I M DESPERATE AND THE ONLY THING THAT I HAVE IS A VIDEO WITCH I FOUND AND COPY WHEN I WAS IN HIS HOUSE AND ITS A VIDEO WITH ME I WAS FOLLOWED AND THERE IS A DATE AND TIME ON IT AND DURING THE VIDEO .

Good evening and sorry about your situation and congrats on you new engagement. I don't see any problems getting approved for your new I-130 petition for alien relative spouse, however, be sure you may have problems at the AOS interview, as it would look suspicious on USCIS point of view. It is up to you to convince USCIS that your marriage is genuine and bona-fide. You will have to gather as much evidence as possible to prove the validity of your marriage and show that it was not entered for the sole purpose of gaining any immigration benefit. Be prepared for a tough interview, also you and your soon to be spouse should prepare to be interviewed separately, meaning every answer you and your spouse give "MUST" match up. If you can get through this, there's no reason to get an attorney. I wish you all the best.
