  1. So I think I'm getting somewhat anxious. Seems like next time I'll hear something is going to be around july. Some of you who filed early on April already started hearing about interviews. I got an RFE for the I-485 about my medical examination and USCIS received the "missing" info on May 11. At my case status it says that my case has been transfered to national benefits center and that I should be hearing from them within 60 days.

    Seems like I won't get my ead or green card until july and even probably august. Any thoughts?

  2. So I got a RFE on April 27. They wanted me to send (again) the medical reports form. Instead of and USCIS address, the letter I got said I should sent additional evidence (i.e. medical form) to Department of Homeland Security po box. It's weird because I did sent the medical form in my initial application. I contacted my civil surgeon and I sent the form again last friday. However, I haven't received any notices or don't even knot if they got my additional evidence.

    I already went to the biometrics appointment though

    any similar stories?

  3. ok, this might be a strange question. I live in the USA with a J1 visa. My fiancee lives in a different state.

    We are thinking of getting married and file AOS. But is this possible without living together?

    My wife and I got married in March and my visa expires at the end of this month. We've been living in different states and filed early in April. She's moving in with me in june, and we mentioned that in our application. So far all our documents have been accepted, so it seems like for now for us being separated has not been an issue. We had a lease with both of our names though, so maybe that's good evidence for our case. Also we have family and friends sign affidavits for our application.

  4. What number did you call to? I've called several times to the 1-800 number provided, but only a machine responds. There's no option to try to talk with someone. How did you manage to get someone to talk to?

    From what I've been hearing, it usually takes at least 30 days after biometrics to receive the EAD and up to 90 days on a regular basis.

    I know that most people say it doesn't make sense to request an expedite because you won't get it, well i requested one today because I need to start working ASAP and i figured I didn't have anything to lose

    I spoke to someone at the USCIS customer service number and told them i was calling to Expedite my I-765 application.

    He asked me a lot of information such as, receipt number, A#, my name, DOB, address, phone number, alternate phone number, what basis am i filing the I-765 application.

    Then he asked me what was the reason for my expedite, I said selected 'severe financial loss to an individual'

    and he asked me for more info so I elaborated on my situation.

    He then asked me if I filed the application in April, yes I filed it April 8th.

    The conversation lasted 15 minutes, at the end he gave me a number to write down and said that the expedite request will be forwarded to the USCIS office for my area.

    So fingers crossed, I hope this speeds up my process.

  5. Hi, Yatsuraluso what happened after you visited the USCIS office last year? Did they advice you to accept the offer and start working before you received your EAD?

    Whed did your EAD arrive?

    I believe the 2 most important and basic things to have in life are health and work. All the rest should come from these 2. Well, Thank God I still have my health. Work should come one way or another. Nevertheless, it's sad when you're healthy and your life isn't in your control...

    I should take some of your advice into consideration. Really getting worried about the EAD receipt number thing though... The number is correct, it just isn't in their database records yet. Or ever was... I'm going to an infopass appointment tomorrow and try to sort this out.

  6. Hi, I think the best you can do is contact a lawyer. Ask to have a paid consultation with him/her. Then you can proceed with the paperwork without incurring the full lawyer's fees, unless you want to go that way. Best time to file is at least 60 days before his visa expires. I'm not sure what you can do once you file AND his visa expires. Best.

    I am new here, and have couple questions to clarify before we file AOS for my future husband.

    Me: USC

    Full time job in Northern VA since 2006

    Him: Currently on F-1 student visa

    Full time PhD student in Southern VA

    Entered U.S. in summer 2005

    F-1 visa expire in May 2010

    Expected graduation for PhD in December 2010

    We are planning to get married this year, and are trying to figure out the best time to file the AOS.

    Below are our questions:

    1. Confirm that he's eligible to stay on campus pursue studying after we file AOS.

    2. Since he'll lose his F-1 status after USCIS receive the application, does that mean he also lose his assistantship? Since technically he'll still be working for the professor during the application, do we just lose the three months (approximately 90 days) worth of assistantship?

    3. I am planning to change my name after we get married, should we file AOS after I get my passport/ driver licenses/ bank statement/ pay stub with the new name on the document?

    Is it okay to list my new name and old name on the application, and all supporting document still show my old name?

    4. Since we live apart (and most likely will last for a while after marriage), we may not have joint lease when we file AOS. Will Joint bank account statment be sufficient to prove co-mingling of financial resources?

    5. We're worried if we fail the interview, is there any way for him to go back to the F-1 visa to finish his study? There is a discussion that if AP/ EAD is used, then one has to leave the U.S. and reapply for F-1 visa. If AP/ EAD is not used, then one can go back to F-1 visa without leaving the U.S. Please confirm if it's true.
