Hello Aleful, Hope you had a good Easter, I am sorry that you're having to go through this all over again, but Good luck with everything.. I was born in Guyana, and came to the UK when I was 13 yrs old... been living here ever since, my mum remarried several yrs ago, as my dad had passed away when I was 7 yrs old, so she's living in Florida and my youngest sister is with her as she was under 21 when my mum moved there... I am hoping to join them sooner or later, by the grace of God. I am looking forward to it as I love it there, I visit every year, but also have a good life in the UK, have my friends here, and also my church which has become a big part of my life... I have friends in the USA too and they're in different states... I look forward to visiting them..

Hope you're all well...
Someone asked me a question and to be honest I could not answer it, the question is "If someone files a petition for a relative at what point are they entered on the waiting list for a Visa, is it when they got the approval or from the moment when USCIS receives the petition?
I think it is when USCIS receives the petition but not sure, so I thought I would ask some of you experts about this, since I am not clued up on all the processes and procedures.

I was raised here when I was a child, and for personal reasons I returned to Argentina, loosing my GC. I got married and divorced and then came back to US on a tourist visa. My whole family is here, parents, my brother and his family. I worked with a family friend as my boss in a Language School/Translation Agency.
Since I had lost residency status, we had to start all over again. I was able to adjust in country because of the 245i law in 2001, by paying a $1000 fine. I had to wait to get my GC to be able to go to college, and in 2008 I graduated with a Certificate in Translation. Currently I'm working full time in a Health Insurance Company. Also I'm hoping to move to Virginia next year.
Now I'm on the next step, naturalization. I have my fingerprints on April 2nd, then the interview. I haven't started studying the questions yet.

Good for you!!! What are you studying? Did it help you understand the process? Do your friends understand the process?
I am studying Bookkeeping level 1-3, and yes your info has helped, although my friend who is a USC, her mum had the interview and she's got through... so she'll be joining my friend in the US within a few wks. How about you what's your journey like? Apart from the 51/2 yrs wait??
I did do some reading on the NVC website too and I realized that there are a lot more criteria than I was aware of, like it depends on the country you're in, and the no of visa applications submitted from that country etc.

the dates are accurate. The age cut is the difference, under 21, a child of oa USC under 21 is an immediate relative with no waiting time.
a single child of a USC over 21, takes more than 6 years of waiting, married more than 8 years.
My mom is a USC and filed for me, single child over 21. My waiting time from filing the i130 to the interview 5 1/2 years because I had my interview in country due to the 245i law. When you are doing consular process, it takes longer. I filed in October '99 and I got my GC in January of '05
what you can do is go to the university or take some courses, study something that will be useful, you have a long time of waiting.
Thank you Aleful, I have started studying, I thought this forum was to inform the misinformed but some people I guess have chips on their shoulders, cause they are just being rude... I know that I am 3rd preference, but if they took the same time to read as they did to write, they would have realized that I was asking a question not relevant to my own situation but a general question.
I looked at the visa bulletin for visas April 2010, this states that they the cut off dates for 1st preference, is July 2004 and I know of people who were in that category and papers were filed within the last 9 months and they got through, My Question was only for understanding how this works, if the cut off dates are accurate, then how was it so quick for some? NOT FOR 3rd Preference or myself.

i, as a usc, can apply for my mother, a uk national. immediate visa number available, no waiting time.
my mother, as a usc, can apply for me, her over-21 unmarried son, an irish national, and must be put into a holding queue.
IMO, you fall in the later type.
You have further complication in that you were not married when she first filed for you, and now you are married.
Suggest you talk with that 'attorney' and ask him to educate you. Your mother has already paid for that, so it's up to you to take advantage of it.

Thanks again for the info.
I am aware that the waiting time could be several yrs, but what I was asking about is the visa bulletin, it states that they are now in may 2002, this is for 1st preference, I am aware that I am 3rd pref. but my sister got through within 6 months in 2006 and, someone I know a USC petitioned for their mum and they were had their interview and this was also less than 6 months yet the visa bulletin is saying that they are backdated...
I just wanted to understand, how anyone is able to read their dates when it's not accurate.
I believe that I will get through when God wants me to, I am a strong believer in HIS will and HIS time, but just wanted to educate myself with USCIS procedures, and understand their processes etc.

My mum has a lawyer representing us, so I am assuming that all paper work and payments go through him. He contacted her to say that he received the same letter, so I guess that the wait will be for NVC to receive the documents and confirm receipt of it. Followed by a request for the Affidavit of support, which my mum will be working with the lawyer to submit all asap. The only thing is I don't understand what is up with that Visa Bulletin, I know of people who applied after those dates stated and got through, so not sure what that's about? I mean someone I know started a process for their mum to join them in the USA and they had their interview yesterday, and only applied like 6 months ago....

It looks as if you have a very longggggg wait, I would suggest that you de-stress and carry on with your life there, because this is not going to be a quick and fast process. It looks to be around 7 more years of wait time.

Good news stage one is complete, I think... Official letter of approval received, I believe they've sent my details to NVC. My mum got the letter and it also states they will be getting in touch with the beneficiaries which is myself...
What's next?
I guess the wait for the Visa??

USCIS have updated their website, it appears that they are currently working on applications for married sons and daughter of US Citizens, dated 15th Oct 2008.
Does anyone know what this means for applications submitted before that date? Also I am embarrassed to say that I do not understand how to read the visa bulletin, it doesn't make sense to me, so any help would be most welcome.

Sounds like it has been adjudicated by Vermont and they have passed it on.
What does that mean?
I saw that according to processing times for the Vermont office they are currently processing Oct 2008. So has anyone know how long it is likely to be before I hear from them?

Also I have confirmation that my application is now at the Missouri service centre USCIS-NBC PO Box 648005. Lee's Summit, MO 64064... Not sure if this is good or not, but my application was submitted initially at the Vermont office... Any one has any comments, its welcome.

Ok I'm home.
I think these visa numbers will help you put things in perspective. Each category has a certain number of visas assigned to them each year. The number of applicants of course is larger than what is available and that is why such long wait for those in F3 category and a lot others. Example - permanent resident who gets married has to wait 5 years for their spouse to be able to come to the US on spousal visa.
FAMILY-SPONSORED PREFERENCES
First: Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.
Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.
Third: Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.
Fourth: Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.
Visa bulletin gets updated monthly and you can track what priority date they are working on now - that means people with that priority date are receiving notifications from NVC to submit paperwork, AOS I-864 and so on so they can get their interview and visa soon.

10 years is not such a bad wait time compared to those in Phillipines or Mexico who are in the same category - they have around 20 year wait.
Did you also look into the employment-based visas? If you work for an American company in Europe often times you're able to come to the States on L visa and work for them Stateside - I know it has a limit to it, but does bring you here even for couple of years. There's couple other categories like H1B, H2B...

Sorry, but F3 category gets a very limited number of visas each year and needless to say there are a lot more applicants than the visa numbers each year. Thus the wait.
I think you're the second one in 30 days that asked the same question. The other person was stanko76 whose application was approved on 12/23/09 after 5 years and he wasn't too happy when he found out he has to wait another 5 yrs for the visa number to be available to his priority date.
Thank you all for your input, but I am new to all of this and I am sorry to bug you all, but I just want to ask why do you think is takes so long for F3 category? How do they make their decision is it country based? like an allocated number of Visas are given to the UK every yr?
I have one relative here apart from my husband and toddler daughter, my sister who is also anxious to move out there....

You are in F3 category so it takes 5 years to get the approval of the petition. Nothing unusual that it is sent to a different office for storage until adjudication. When it is approved in Oct 2013 or earlier, you will then have another 5 year wait for the visa number to become available.

I suggest you have mum call the USCIS hotline, get a human, inquire about case status.
IMO, something is wonky - NBC ??? If you have a copy of the original I-130 and G-325A - check the beneficiary address - if it is NOT in UK, (ie - your address) then is possible the USA solicitor put down the wrong address for you (ie - perhaps your mother's address) and the USCIS ppl think you are located in the USA, so they forwarded it to the NBC - but - that's just a guess.
I signed the papers that the solicitor prepared, as I was visiting the US at the time, and on the I-130 petition my UK address was clearly printed on it. I do not the a copy of the Petition as it was done through the solicitor. My mum has not received the letter from NBC confirming that they are now dealing with the case neither has she received a letter to say that it was forwarded to the NBC... I had signed up with the USCIS website for updates with my receipt number. Should I wait until she receives a letter?

My mum filed a petition for My sister and I, we are both married and living in the UK (UK citizen), the application was submitted via a solicitor in the USA, and was sent to the Vermont processing office.. My mum received a receipt for the 5th Oct 2008. I recently got an email with case update:
Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN
Current Status: This case has been sent to another office for processing because it has jurisdiction over the case.
On January 5, 2010, we transferred this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to our NATIONAL BENEFITS CENTER location for processing because they now have jurisdiction over the case. We sent you a notice of this transfer. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.
I don't understand the US procedures, I know that the National Benefit Center does not disclose processing for I-130 which I assumed it's because they do not process those forms?? Has anyone had this? Do you know how long this process takes?
I viewed my receipt number on the check my case process and it's showing that it's being reviewed.
Would be grateful for some info.
