  2. Hello everyone,

     

    Item #24 of Form DS-2029 requests filling out information in regards to the precise periods of time in the United States.  The sample that is available on the US Embassy in Japan web site mentions entering dates from the date one was born (if born in the United States).  I was born outside the US and later became a naturalized citizen (after being a green card holder for many years).  For individuals as myself, when should the starting date be from?  Should it be the date I became a naturalized citizen?

  4. Well, kiwirst got NOA date 12/03. So we kinda left their case... I'll put them for now... (he may want to move to December list though...)

    And checked unupdated cases and found Greg & Chun and honbako's Bio dates. So, updating for them... :)

  7. Hi!I've just found this group. I posted a question a while ago as a new topic, but let me post it again here as I believe there will be more people who know about the case in Japan in this group.

    Here is my question. I appologize in advance if the same or similar questions have been brought up here by someone else.

    I am Japanese living in Japan and my boyfriend is American living in the U.S. We are planning to get married in Japan in coming January. I would like to make sure that there is no problem for him to visit Japan with no visa and get married in Japan. He will be in Japan only for 12 days or so, and we will get married during his stay, then he will go back to the U.S and we will start CR-1 visa process.

    As reading the US Embassy website, I am pretty sure it is no problem, but I've seen some people say "American citizen who wants to get married to Japanese citizen has to live in Japan at least for 6 months" in their blog or something, which made me a little nervous.

    Does anyone know what the truth is? Any experience?

    Also I learned that there is a part to be filled out the American citizen's living address in Japan on the marriage license (Affidavit of Competency to Marry) form which need to get notalized by US embassy before going to the city hall. Does anyone know if he can leave the part blank?

    We are planing to go to the US embassy to get the form notalized as soon as they open in January, then I will translate it into Japanese, then we will go to the city hall of where I live to get married. We will get this process done within a few days during his stay in Japan.

    Since this will be the first step of the long process we will take to get a visa, I would like to make sure we are doing right.

    I will appreciate your advise.

  8. Does the USCIS usually contact you through the mail or email/phone if I sent in the G-1145? Also how do I get my case number so I can register on the USCIS site? Is that given with the NOA1?

    I believe they will use whatever method of contact you filled out on the from e-mail, phone, or possibly both. If you sent in your petition and paid with a personal check, you should be able to see the case number on the back of your check if you have an online banking account that allows you to view cashed checks. Otherwise, you will have to wait to receive the NOA1 in order to get the number.

    Hi there!

    It's pretty normal to feel nervous after mailing everything in. If there is something wrong, you'll generally hear back from them within two weeks, but I honestly wouldn't sweat it too much for now. The main thing is to just relax (as best as you can) and take it easy. :thumbs:

    No worries. I noticed that I had made a typo in my last message. Waiting for the NOA2 is the potential stressful part; the NOA1 usually arrives within a week or two after they've received and successfully processed the petition application.

    Just wanted to poke in here and say hi. I'll be starting the K-1 Visa journey here with in the next two weeks. My fiance is Japanese and I am American. If anyone has any tips related to the process with a Japanese feel free to share. :)

    Welcome aboard! The best advice I can give you at the moment is to make sure that you get all the pertinent information sooner than later. The process is generally straight forward, so I think you'll be all right. One thing to keep in mind is that once you've put the petition off into the mail and are waiting for the NOA1, the both of you should try to find things to keep your mind off of when the NOA1 will actually arrive. Otherwise the "wait" can turn out to be very stressful. It also doesn't hurt to visit each other during the process.

  12. Congratulations. Some people's cases were transfered to the CSC. This step usually forgoes an inerview and is meant to expedite the process, however some applicants have reported this process has taken them longer. It is good to see it worked fine for you.

    Thank you for the response! We had been expecting to have to do an interview the whole time, but it's a relief to know that this is no longer necessary. Congratulations to those who've gotten their green cards and best wishes to those who are still waiting to hear back. :thumbs:

    My wife got her green card in the mail today! I was really surprised because there was the expectation that it would take about 6 months and that there would be an interview before getting the card. It seems like others got their green cards in the same fashion. Anyone have any idea what happened to the interview part? It just seems too good to be true after all the waiting for the fiancee visa, etc. :)

  14. Speaking for the folks who applied in Dec & messed up the fee, packet with everything returned yesterday (& they had even tidied up the filing as well).

    New check for correct fee plus slipping in AP letter which was missed. Does anyone know what is best to put on the letter? Best to keep it formal or throw a bit of feelings into it? We have been invited to participate in my wife's close friend's wedding party in April next year, which is in Montreal. Do we need to say that or better to put more details in?

    Merry Christmas to all with their newly transported spouses/other halves etc!! =)

    It's probably better to keep things as formal and business-like as possible. My guess is that many of the agents who handle the processing are not directly responsible for the changes that get made and I'm sure receiving a pleasant letter would help them get through their day.

    We quietly just sent back the RFE'd documents with the proper amount on the check and thankfully received the NOA1 notice via text message today. It might be wise to mention about the AP letter that you added in. We noticed on our forms that they had printed some dates and numbers on it (probably to expedite the processing upon return).   15. Would be totally pointless and futile. They advertised the increases several months ago and it's been widely discussed on the boards. The only applications that qualified for the old fees had to be postmarked November 22nd.

    The rule of thumb is always always check on the USCIS website for the latest everything. The fee schedule made a note at the top that it was going up from November 23rd. It was easy to miss, if you're prone to skim reading but I've learnt the frustrating way, that you can't skim anything with this process. lol

    Ha ha ha. I thought I had read through everything in detail, but oh well. :lol: Things were so busy and hectic after the wedding with myriads of paperwork, etc. that that portion slipped through the cracks. :bonk: At least the documents with the right fee is on it's way again. :D

  16. Just a heads up to everyone. We received an RFE for our application. Apparently the filing fee was recently changed from $930 to $985 and the biometrics fee from $80 to $85. What's surprising is that the previous I-485 instructions were marked to expire on 12/31/2010 and the new one (with the updated fees) still expires on the same date this year.

    We first thought about calling to argue about the fee change, but just thought that paying the extra $60 is probably a lot less of a hassle and would allow the AOS process to smoothly continue. At least we're thankful that the RFE wasn't because of some missing documents or something more sinister. :blush:

    I'm currently working on the AOS for my wife and while looking at the Step-by-step guide located here: http://www.visajourney.com/content/k1k3aos and am a bit confused by:

    Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps)

    I looked through some various threads on the forums and couldn't ascertain exactly what is required.

    Does this mean I need to include a copy of all the pages of my wife's passport? I'm currently understand "entry stamps" to mean "entry stamps on passport to the countries she's visited" ... though this could simply mean "entry stamps into the United States."

  18. Thank you everyone for your replies. I'll stick with the IRS tax transcripts and get information from my employer. I'll have to dig out my tax return for 2007 and see what's listed line 22.

    In regards to the Foreign Earned Income Exclusion (for those who aren't familiar with it).

    If you are a U.S. citizen living abroad and earning an income from a non-U.S. company or entity, you are required to pay taxes on what you earn outside of the U.S.

    If you have proof of residence (usually more than one year) outside the U.S., then the Foreign Earned Income Exclusion allows one to avoid getting taxed twice if your income falls below the amount listed.

    Even if a U.S. citizen qualifies for the Foreign Earned Income Exclusion, the citizen is still required by law to file their income taxes ... you just don't have to pay any tax on what is earned.

    Fortunately, I did file my taxes while living outside the U.S. so no worries for me there. :whistle:

    I'm currently in the process of filling out the forms for AOS for my wife (married through K-1) and I came across something I'm not (yet) quite sure about.

    Question #25 of Part 6 of the I-864 from requires entering the Adjusted Gross Income for the last 3 tax years. For the 2007 tax year, my "Wages, Salaries, Tips, Etc" comes out to be $0.00 because I filed my taxes for that year because I was living outside of the U.S. at the time.

    The income I made at the time qualified for the Foreign Earned Income Exclusion and is listed elsewhere on the tax transcripts I received from the IRS.

    I thought that entering $0.00 for my total income that year would be odd, so I entered the amount I earned while living outside the U.S. Is this all right to do?

    Also, are the IRS tax transcripts I have sufficient enough to meet the requirements of the I-864? Or should I also include a letter of employment, payment stubs, and copies of my tax returns (the wording on the instructions is a bit confusing :blink: )?

  20. My wife is Japanese, We got her 10 year green card in 2006

    @ Akiko - My Wife travels on Her Japanese passport, She shows her Green card when re-entering the US. She has never had any problems.

    Right now she is trying to establish a credit history in the US. It seems no one will extend her a credit card under her own name.

    She has excellent credit in Japan. She always gets turned down here due to insufficient credit history.

    Any Ideas on how she can establish credit?

    She is already on a couple of my accounts as joint card holder, she is also on my mortgage and Auto Loan.

    Based on the way the credit system works, I believe your wife will have to get a secure starter credit card under her own name. The secured card might require some kind of co-signing on your parer to act as a guarantor in some fashion.
