    I am not sure whether it is a right topic to discuss here. I read about K1 visa holder can apply for Social Security Card right after entering the USA and even before getting married (within the 90-day period). Then what about driving license? Can K1 visa holder apply for US driving license before getting married OR better to do so after married and have the green card?

    I am going to have my K1 visa interview soon. In form DS-156K, there is this "Evidence of Engagement to your Fiance(e)" which need to be attached to the form. My fiance & i DO NOT have an engagement party. So can i just attach the following:

    - engagement ring's receipt

    - our letter of intent of marriage in USA within 90days (followed VJ format)

    - we have a traditional wedding ceremony in my country (but we do not registered legally) - it's just for my family, relatives & friends cos it will b difficult for them to travel all the way from my country to USA in order to attend the legal one.

    All response will be highly appreciated.

  4. Hi all,

    My I-129f NOA1 package had been sent in mid June this year. From the processing time info, mine has not been processed yet. That's ok cos i know it will take time.

    My question is - while waiting for my NOA1 to be processed & then get my NOA2, is it ok for me to apply for my police reports which are required for the interview right? I lived in 3 different countries since the age of 16 & hence i would need police reports from these 3 countries & i know they will take me 2 mths to get them all. I am thinking if i am ALLOWED to do it now then it will save me time after i get my NOA2. I am just not sure whether the police reports MUST only be done after i get the NOA2 package. I belive the police reports should have dates on them. So will it be ok if the date of application and/or issue are BEFORE the NOA2 package received???

    Please, anyone who has gone thro' this, give me some idea & guide.

  5. My fiance is planning to visit US this summer. When he is in US, we plan to go thro and fill in I-129f together. I am not sure whether i can submit I-129f while he is still in the states, or it has to be submitted after he left?

    Q12 of I-129f form asked about whether the fiance is in US currently (or when the form is being filled in), for my case it will be YES. Is that technically ok?? Cos i am worried they will reject the application cos my fiance is in the US while the K1 application package is submitted.

    Is it better to submit the application package when fiance is NOT in USA??

    After the submission, he can still visit US for a month or two right?? Is it OK to tell the immigration officer (at the airport) that the K1 application package has been submitted and he visits me in the US for a short time while waiting for the application?? OR he SHOULD NOT mention the K1 application at all to the immigration???

  6. My fiance plans to visit me in US in a month time. When he is here, we plan to work on the I-129 and prepare whatever documents that are required together. We think it will be easier to work and discuss on the application together and face to face. What we are not sure is whether it's ok to send/submit the I-129 while my fiance is in the US? Or is it better to send the package after he leaves???

    Any opinion is highly appreciated.

  7. NEED IMMEDIATE HELP DESPERATELY cos TIME is RUNNING OUT for my Fiance!!!! :clock:

    I have applied for my american citizenship in early Dec09, went for fingerprint in early Jan10. Now waiting for interview and final approval. Expect to get the citizenship in May10.

    My fiance came to US in end Oct 2009 on B2 visa, only allow to stay 3 mths till end Jan 2010. Plan to overstay, and get married after i get my citizenship in May. Then file for I-130 and I-485 for her. Is that legally ok??

    If YES, questions are:

    1) my fiance could be overstaying for at least 6 mths before we get married and then file for her status change and green card. Will the overstaying issue for AT LEAST 6mths be forgiven by USCIS?

    2) Is there a time limit that my fiance can't be overstaying in order for her to get her application/status changed successfully??

    3) we're going to get married in US. Can we get the registration of marriage official in US since my fiance enters US on B2 and actually has overstaying by the time we get married in summer 2010?
