  1. we just had interview and this is our second case we haveee been file K3 2009 and we got revoke then on July 5 we file IR1cus we have been married for more than 3yrs and we had interview today the strange part that the officer asked few question about my wife then its said that our case is illegel cus there is K3 and CR1 matched up togther the officer said that is not right ihave been asked her if its not right then why USCIS approved it she said idont know that why ineed to send the case back to USCIS and she have been give me 221g selection 221(g) and selection 212(a)(6)©(1) plz any one have any idea what we can do now its have been more than 3yrs of married now and if the case back to USCIS it will take long time there is any advice can help us and my wife is here with me and she get appointment online to go to the consulate so she can try to understand whats going on any one can help ill be happy to get ur advice guys

  2. Hello every one we have our interview date and I have a few questions of all the folks who can help.

    This is our second case and we finally have our interview date. The NVC sent the letter of what to bring and there is nothing on there about proofs such as chat, phone history and such as this. Did any of you bring things that was not requested to the interview?? Also our interview is set for 8 am is this a bad thing?? Most was saying it will be in the afternoon. Does this have any bearing on our case?

    Also I am wanting to buy my husbands ticket now along with my own because I wanted to be there in the time of the interview, that is the reason for my questions if they issue the visa the same day so we can be sure to leave together. It will be a better price for the ticket also to buy it now.

    Also I have not been back for just under a year now because my work would not let me leave when we wanted in which was in December and then we got approval in February so we waited to see about the interview date. Is that going to make a problem that i havent beent there for a year by the time of the interview??? But I have aleready been 4 times in three yrs.

    Plz if you can help I would appreciate it. I have all these questions running in my head and anxiety because we want our life to finally start together not apart. This is killing us little by little literally!!!!!!!!

  3. Sorry, I'm a little confused. I was trying to find your timeline so I could get a better understanding of where you are in the process and what your background story is. Is this already somewhere on the site, or could you please share? I know there are tons of people on here who'd love to help!

    Are you wanting to know our timeline from the first case we filed or this time on our second case? I am also confused. I feel very hopeless.

  4. Ok here was my first post: This is our second time to do this whole process and it is making me insane!!!!! I have filed the I-130 received NOA1 July 5, 2011 hardcopy. I have called the USCIS to see if it has been touched and they said they dont know what I am talking about when I asked if the case has been touched. I have checked our status in the web site and it still says the same thing. I asked the senators office and they cant tell me any thing yet because they said I am not out of the processing time yet. I am ready to hurt some one seriously. Can any one tell me how you get this information?

    Also I am in good old Indiana the state of Republicans that dont want to help you because they take lip service and tell you the same thing the USCIS tells you. Can any one give me info on how to find some one that will help me? What other offices can i go to or call. I need help PLEASE!!!!!!

    Now the update : Since the time of this first post I have contacted the senators office again and called the USCIS the first effort on the part of the senator was to make again an inquiry and told me that the case was waiting ajduication. Well I knew that much. I called the USCIS with the pretense of finding out why I never recieved a document they said they had sent back in september. When talking to the represenative she only had the same info so I asked to speak to a Immigration officer. They put in a request and a woman called me and said the docutment was only an address change confirmation and could not be resent but called to tell me what had happened and what the document was. But said we should be hearing some thing soon on our case( HA!!!!! Like that happened) So I called the senators office again and pushed to find some thing out. She made another inquiry and while waiting her to answer me I called the USCIS again and this time pushed straight for an immigration officer. This time I was told the case was in transit to an officer. Then the senator doesnt contact me so I contacted them again and said the case is with an officer now. I have been back and forthe like this with senator and USCIS and now the congressman since December 5 2011 (and to make a long story short cause believe me there is more) The last report was from the senator and said since this is our second case the old case had to be recalled to the officer so they could match the old one with the new one. We are next week at 7 months of waiting for an approval. PLEASE is there any thing else I can do to help our case get finished. We are so sick of being apart from one another this is killing us.

  5. Filed our I-130 and received our NOA1 July 5, 2011 and then on Sept. 19, 2011 I received this email

    Then on Sept. 20, 2011 I called the USCIS and they said that is correct and I checked the website and it said the same thing. I posted in Visa Journey and was told it was probably a mistake. So I contacted the Senator and they said it was mistake. I waited and still have not received any docutment. I have had the Senators office trying to help me and they made a phone call and said that the I-130 is in process and then I did a request to the Senators office and the USCIS sent an email back saying that they appologize that they are past the processing time and that they are trying to make this as fast as possible and sorry for any inconvience this has caused us.

    So then I call the USCIS again today December 20, 2011 and they are still saying that this is correct and I had them put in a service request to find out where this docutment is. They said they will be sending a new one that it is probably lost or something of this nature. I then asked to speak to a supervisor, in which i was under the impression that they know more but she told me alot of the same thing but added that maybe the case has gone to the NVC in this time. I asked if that is true they would be able to pull up our case and she said yes. So then I called the Visa office in Washington and they directed me to the NVC with the correct phone number. I then called the NVC and they did not have our case she did input the case number twice.

    So my big question is what is next we are here in limbo with no real answers dieing fromt he pain of being kept apart all the time and no one knows where our case acutally is. We have been married 2 yrs. and 9 months and this is our second time for the process and we are heart broken.

    PLZ I need any ones help to know what to do so we can finally be together and actually start our family before we die from the pain of this paper work and red tape.

  7. More on our case too. Also i have contacted senators, congressman and they will make inquiries on my behalf but the last time I called the liason tells me in a strong tone "Well maybe you will just need to sacrifice and go there and live for 6 months so they will believe your marriage is real." I said ok i would love to do that but how am I to keep a job, and a residence, and be his sponser if I go there and live? What is she thinking when I am the only one that is the sponser.

    I need more advice folks. I appreciate any thing. I need to move this case is there any way to speed this up??? We are living in hell apart. This is to much to put people through.

  8. Dear VJ family. We are on our second time around with this whole process. First one ended in revoke saying marriage is fraud. We have now been married 2 yr and 5 months and our petition for the I-130 is in the USCIS. Please if you can give me any advice on how to make the process any faster and any info to not fall into the same mess again. Senators, congressman, and two lawyers that were from legal aid said OH you need a lawyer. I didnt find that did me any good the first time around cause she just took our money and sat on her butt. I did all the fighting for us after I had to fire her. We are dying from this seperation and not being able to start our lives here in US. To tell you everything I did the first time would end up being a book. But please if you can help us I would so greatly appreciate it.

    I did front load my petition this time. And also I have been there 4 times and we are still fighting to have our dreams.

  9. It can take up to 18 months after denial before the USCIS contacts you about the matter. Forget what happened, and do what's necessary to start over by a different route, as suggested. Good luck.

    If the age difference is large enough (let's say 40 years, as sometimes it is) it may still be difficult to obtain the visa. You don't share how long you had known each other before marrying; a short courtship could be a negative.

    As to the religious issue, I suspect it only leads the consulate to look more closely at the kinds of people he is involved with -- to be sure there is no evidence of Muslim extremism among his friends, family, and associates.

    my husband and i knew one another 6 months before i went to get married. I was able to stay two weeks.

    also we only have 24 yr difference. Look at our page our pic is there. When you see us we look about the same age because I look very young for my age. Also for his religon everything came back good the lawyer said and that our case looked very good according to these kind of concerns.

    I am looking to all the options at this point. We may have to start again with cr1 visa.

  10. The I-129F is used for the K-3, not the I-130 (which is used for the Cr-1). So where is your I-130? Have you submitted the DS-230 and the I-864 for NVC yet?

    the I-129 and the I-130 are used for the K-3 visa because that is what the lawyer made us do. And I have both of these. Also the I-130 says it expires December 26,2009 but by it still being used in the K-3 visa and we are awaiting the papers to return to the USCIS they said that it stays active. I need to know if I can use this I-130 for the cr1 or it is void once its removed from the connection to the K-3 visa. No we have not submitted any other papers because we are trying to find out what our best option is now at this point.

    I aplogize i had said K-1 visa in my first response to you it is yes a K-3 visa.

  11. At what stage is your I-130 at? Have you done anything with the I-130 or is it still sitting at NVC?

    If you want to pursue the I-130 then I suggest you call NVC and find out what you need to do to move forward with the I-130. However, the reasons for the denial at the K-3 will need to be overcome. What did the denial letter exactly say? If they think your marriage is for immigration, then I suggest you begin collecting additional evidence of your relationship.

    we didnt even get the letter yet. The papers arent even back to USCIS and its been a month. The I-130 was approved and used in the K-1 visa. If his papers are still in the consulate can this I-130 be used to initiate another interview? And one the proof we had every kind of proof you could ask for. The officer said we just brought all this proof so we could make him give us a visa. He didnt even look at our proofs. He only looked at the papers that were sent from the lawyer for the interview. My husband had 6 different books of chat emails phone calls,and then another book of proof of letters cards, packets i sent, reciepts, we had 2 albums of pics of wedding and places we traveled and family. I dont know what else this man could ask for.

  12. Hello and I hope you can help me. We used K3 visa from suggestion of lawyer and look what we got. HA! I was told to give it up on the K3 and file cr1. Jawad had 2 interviews and i was questioned too. This was on December 1 and December 10 for the interviews. They said he married me for papers and used law 221g. Also his papers arent back to USCIS yet. I called the NVC and asked if i could use his I-130 if the papers are still in the consulate to get hiim another interview. She said she cant tell me that and I need to ask a lawyer. Also she said she could not call the consulate for me I will have to. The consulate had emailed me a month ago and said his papers went back on December 17, but they arent here. I am thinking that it will take longer to appeal the K3 visa than it will to file and get the cr1 visa. Is this true?????? Also can i use the I-130 i already have or do i start over. We are new to VJ and need all the help we can get. Especially after being lied to by the lawyer that was supposed to help us. She was just for the money.

    Please any info will be appreciated so much.

  13. We filed K3 visa got all approvals interview set. Go to interview December 1,2009 and i was also questioned same day. Denied. Second interview December 10,2009 also denied. Consulate emailed me after i ask about Jawads papers said they were sent back December 17. Papers are not in USCIS. I have had the senator assistant check with NVC and USCIS the papers are not there. They are telling us just to wait. Plz can any one help us to make this fast and what suggestions do you have for us. We truely believe we were denied because of age difference. Have fired the lawyer because she would not do any thing at all but wanted more money. Plz we are lost and need your help. We just want to be together.

    (Plz read our story of what happen below for all details.)

    We used K3 visa suggested by the lawyer I hired. So not knowing anything of this I started the process. All seemed to be going well. We filed the I-130 and had approvel fast. As soon as we had notice they recieved we sent the I-129 and had approval fast. Then was a small problem in confusion on sponser but i made enough to be his sponser. Attorney gave me much problem of this but we finally work past this. We send the papers and while we was wait Jawad gets a letter from the consulate of his appointment for his interview. The attorney was shocked because she kept telling me that it wasnt even approved yet through the visa center. We find that for Morocco we dont have to do that. The interview is set and i didnt have to pay the $477.00 to file. Why if an immigration lawyer for 18 years was she shocked by this. This made me start to be afraid of my own lawyer. At this time we have already waited 7 months for the process.

    Finally the day comes for interview and I have flown to Morocco to be with Jawad. December 1, 2009. Now the wait for process is 9 months. Jawad arrives early for his interview and I wait in the cafe. He was made to wait until last and then the officer finally calls him up. Jawad said the officer seemed to be nice. He asked him many questions of course of our relationship and of my life here and children my x. He asked of my work asked for many dates of birthdays of children and when I started work. Jawad had all proofs that the consulate asked for and of course all the papers the lawyer prepared. They officer made Jawad sit down then in the middle of his interview and kept watching him. I geuss trying to make him afraid. But we know one another so much this didnt bother him at all. So the officer called him up again and continued to question him. After 45 min of questions he had Jawad come and get me from the cafe. I was so happy thinking we were getting his visa. Now this officer when he saw us come in together his face changed he was mad. He could not prove his point cause he wanted me to be some old woman and I am not. We walked in smiling and arm in arm. He told Jawad he had to go out so he could ask me questions. He starts by saying,"These young men they bring all these proofs and they marry with an older woman and think we are going to give them a visa. Do you understand what I am saying to you!!" I said," I understand what you are trying to say and this is not the situation!" He then starts to ask me questions of Jawad and what we have in common and of his family and where they live and where they were born and I am answering all questions fine. But when I do he keeps cutting me off. Then in the middle of the interview he clicks off the mic and asks his fellow employee where do they want to go for lunch. How rude I can hear every thing he is saying. And I am an American in the American Embassy questioned by and American officer. What is this????? He clicks the mic back on and asks a few more questions and cutting me off when i try and anwer. Then says well we may give him a visa we may do a second interview we dont know. Just go back if you need to go back. Come to find out that he had made sure to ask Jawad when I would go back and asked me the same thing. So I had and idea of what was to happen next.

    I was right we wait and they call Jawad and set his second interview for the day after i was supposed to fly back. So I changed my ticket and stayed. Interview December 10,2009 Again Jawad is there early and again they make him wait until last. And the first question out of this officers mouth was," Well did you wife go back?" Jawad said no she waits me in the cafe. This officer was mad. He said WELL HOW MUCH DID THAT COST HER!!!!!!!!!

    How is this any of business!!! So he asks Jawad the same questions again. Also he keeps interupting the questions with lets go to money. Jawad answered all this fine becasue we know all of one another. This officer said 4 times during interview lets go back to money. Then one of these times he said What if you find your wife lied for you about money? Jawad said My wife doesnt lie for me we love one another so much and she tells me all she has. Then the officer said to Jawad Well what do you want me to do for you today. Jawad said Give me a visa so I can go live with my wife. The officer said No I dont think so. He said a lot of large words and Jawad said One minute I want to understand what you are saying. You are saying that I lie and I just marry my wife for papers. The officer said Yes that is what I am saying. He denied his visa again and gave him a paper folded in his passport and sent him out the door.

    When Jawad and I get back we see he has given us the wrong paper it has some one else name on it and the wrong visa. We emailed this to the lawyer and had to go back the next day. I went to the Embassy and I said this is the wrong papers and there has been some mistake and I want my husbands visa granted. The Morrocan man said he will speak with his suppervisor. He comes back with a paper this same just changed the name and visa. I said i want an explanation of what part of the law is being used to deny my husbands visa. He says I cant explain that for you. I said then I want to talk to this officer. He leaves and comes back and says he says he already denied the visa and the papers are already go back he cant explain for you. Again how they treat people in the American Embassy in Morocco. And this officer used his opion to deny a visa and is trying to use law 221g for his reason.

    I came back to US December 13 and we have contacted the lawyer and Consulate and all we have as an answer is Oh you just have to wait. The papers are not in the NVC or USCIS and i want to do some thing now if I can i dont want to wait more. The lawyer said at last phone call that we have to wait and then file an appeal after we get what the denial says. I dont believe this because as soon as i questioned her of how long and how much money this is going to take she didnt want to answer any more quesitons and then asked for more money even though she is not doing any thing with the case at this time. So I let her go and have another lawyer ready to take over. But i want to know if we can do some thing now and may be his papers are still in the consulate. They have lied and done this to others we know.

    PLEASE WE NEED YOUR HELP!!!!!!!!!!!!!!!!! WE ARE NEEDING TO BE TOGETHER TO LIVE OUR LIFE NOT WAIT MORE!!!!!!WE WERE MARRIED MARCH 9,2009
