  1. Just a guess, but are you a government employee or a contractor? I believe there are special rules in place for government employees who are working overseas on orders. Otherwise just pull the visa and reapply in a few years when you're both ready to move to the US.

    I am a contractor, I guess Im going to talk to her come up with the "worst case scenario, just so we can be prepared.

  2. Just when I thought it was all over, I was hit with a whammy! I currently work in the middle east and my fiance is currently in Bulgaria. I was scheduled to be back in the US in Aug, and then she would arrive in Sept. A few days ago my employer told me that they may need me to relocate to Germany. This would have been great news last year before I sent the visa off as she doesnt need one to come to Germany. If I do move to Germany, how would the visa situation work? I was told that once she comes to the US, she cannot leave for a few months... is that true? Or if she never enters the US, how hard would it be to reapply for the visa 2-3 years from now?

  3. SO I went to the NVC and read this:

    USCIS Sent My Immigrant Visa Petition to the NVC. Now What Happens?

    If your Priority Date meets the most recent Qualifying Date, the NVC will:

    Invoice you for your visa application fees

    Collect your visa application and supporting documentation

    Hold your visa petition until an interview can be scheduled with a consular officer at a U.S. Embassy or U.S. Consulate General abroad.

    If your Priority Date DOES NOT meet the most recent Qualifying Date, the NVC will notify you and hold your petition until your Priority Date meets the most recent Qualifying Date. The Department of State updates the Qualifying Dates on a monthly basis.

    What are the fees that they are going to collect and what is the "Priority Date"?

    For some reason my packet was sent back by military postal system due to an error on the address. Oh well it gives my one more time to check everything again, so this is what have:

    1-129F

    Divorce Decree/ Divorce Cert

    G-325A (hers and mine) /Fiancé Letter of Intent

    Passport/Birth Cert

    1 passport photo for both of us

    Pictures to prove the relationship

    Check

  5. You simply use the actual facts as to your "residence". Clearly, you do not live in Hawaii. Your "residence" needs to be where you can expect to receive mail. File accordingly.

    My residence is in Hawaii, I pay Hawaii State Tax, I vote in Hawaii, but I am doing work for my company overseas, so I moved out of my apt. Now I know I can just file at the VT center but when I return to Hawaii but my paperwork was submitted in VT instead of CA, I just want to know if that will cause problems.

  6. So I called USCIS and they were no help, the women sounded like she was reading from a card piece of paper. The question I ask her was that "I am currently living in Hawaii but my mail is going to TN due to me being overseas temporay, where do I file?" She ask me what address did I put on the form, I told her the TN address because I do not have an address in Hawaii since I move out of my apt. So she told me to send it to the VT Center. Then I ask her when I get back to Hawaii, is there going to be a problem since my paperwork was sent to the VT center, her reply was "I dont have that type of information." She didnt bother asking anyone. Sigh...
