  1. zainab786 once you have the green card you should not use public benefits because it will work against you when you will file for citizenship. Until the individual receive the green card Vawa filers can use public benefits without any problem,but once you have the green card you should be able to provide for yourself without using government funds for that. The Uscis can consider you a public charge and may not allow you to reenter in the USA when you are returning from a trip abroad or denying your Citizenship.In case of emergency after receiving the green card I do not recommend that you get any benefits more than six months at all. The State or Government might grant you benefits, but despite that you will have a big problem in the future. If you have children your children can use food stamps and medicaid without problem BUT NOT CASH ASSISTANCE, and YOU should not apply for any public benefits after receiving the green card or you will face serious consequences regarding your citizenship or reentering in the Usa after a trip abroad as i said before.

    Oh really so the benefits thing would cause me a problem.. I guess I am not applying for it than! thank you so much for letting me know.

  2. Public benefit is anything the welfare office provide but with vawa it varies from state to state. I see that u got approved in 2010 when was your interveiw cause from wat am seeing it took 2 yrs from your approval to get green card not including time you waited for approval.

    Just want to know your timeline

    Oh well.. actually i applied vawa from foreign country in 2010 which was approved in 2011 and applied IB1 visa on approved vawa; had visa interview and got immigrant visa with permanent residence status in 2012 and been few days since i am here. will be going to make social security in few days, so was wondering if I am eligible for benefits, If yes what are they?

  3. Did u get you green card yet. I don't know for vawa applicants if they can get benefits immediately but the "regular person" who has a green card can only get benefits after 5 years of having a green card and you have to attend the job program and they help you find a job. If you had a citizen child you would get it for that child they would take your income and everything into consideration (or no income) and help you find a job if you didn 't have one because you are eligible to work.

    I have to wonder if vawa applicants can get benefits immediately after getting a green card then that means that person can get benefits indefinitely unless they go above the poverty line for their family size. I highly doubt that but I can be wrong just a thought.

    In my vawa approval notice, its written that I can apply for public benefits; now wondering what public benefits they were referring to? My green card is in process and I am expecting it in mail anytime soon. I know a regular person has to wait but my question is focused on vawa approvals.

I am in Chicago area, looking for a domestic violence shelter from 2nd week of Nov, I tried calling to some shelters but they say they have no space available now and I should call them later, I am so afraid if I wont get a shelter till 2nd week where in the world I will be staying at. Anyone can tell me a shelter where I can go like walk-in type? I have VAWA approved but no place to live in, no idea about how and what benefits I can get on approved VAWA, dont have no job, no money and separated wants to file divorce. Completely blank what to do. Any advise will be appreciated.

  5. Congrats.IB-1 means you're a VAWA petitioner abroad.Your I-360 was adjudicated by USCIS then US Consulate or even USCIS adjudicators for I-485 CAN'T RE-

    ADJUDICATE AGAIN.It means they can't question the decision of I-360 approval or ask questions relative the abuse suffered, one of the memorandum from Vawa Unit states about that.Of coure they can ask basic questions such as when did the violence happen? when did you leave your husband....but not details of the abuse.Just in case bring with you something about the abuse.

    The US Consulate however will ask you to see proof of your bonafide marriage.Bring with you copy of tax return, utilities bills in name of both, pictures, lease in name of both ETC...

    Thank you so much, I will be taking some abuse evidence just in case if they ask, and bonafide marriage proves!

    Visajourney helped me alot in the most difficult procedure of filing vawa from another country and getting it approved!

    A bit history of my case for a clear picture..

    My I-360 VAWA was approved few months back; I applied it from outside US. Later, my file was mistakenly sent to National Record center which was pulled out by the help of a senator. Received case number, paid fees and sent DS-230 forms just yesterday! My approval notice and cover sheet says that my visa category is IB-1. I can understand that it is a self petition battered spouse category. I am now expecting NVC to complete the case and assign me the interview date. Now the question is

    As its VAWA approved, will I need to show embassy CO prove of abuse again? Will they ask queries about the abusive relationship? What questions and documents I should bring to US embassy in my country? I know they ask about work and all for fiance and marriage but as an abused separated spouse of USC what I should expect from interviewer's when it is IB-1 visa? I heard abuse discussing is not generally allowed in AOS interview, It would be same here for visa thing or no? My pro bono attorney told me that I would get an LPR status and green card in mail in one month after this visa as my VAWA has been approved but no idea about IB-1 visa interview?

  8. Filed VAWA on 24th November 2010 received fees waive notice on 29th November 2010 since than my case hasn't been touched. Its been more than 4 months. Can I call or email requesting them to look at my case? If yes than what's the telephone number or email ID?

    I am no longer in US and filed VAWA from foreign, though abused occurred in US.

  9. Daniell.. Thanks for reply, Yes I abandoned my status, I read all the post but did not get an answer how to contact court house or take some action against divorce without an attorney, I called up at the court and they refused to talk over legal matters.

    @Can thread managers lock my one thread, both threads are kind of confusing when read together although posted after months back.

    Yes, I have lost my status, Its not about vacation or anything, Again thanks to his threatens, frauds and tricks. I don't want to be married because of green card or anything.. I want my property back as I have said in my post, My documents are more important to me than my money and jewelries he has in his custody,of course I want to try at least get those things back,

    @Scott and mhay, I read about the laws in IL, and it says the same thing that it is necessary to serve the papers, I am also not sure now what trick he has done to file for divorce But after everything all I can do is to order the copies from internet? That is why I am concerned that I can at least inform the court that he has my property and delay my divorce till I get back there on other visa and do something about it?

  11. I have been posting threads of legal queries about immigration and stuff, this time its a bit different though, its about divorce.

    When I am here in my country, my husband has filed for divorce without my information and he has been hiding it since 4 months, my hearing date has been passed as I did not have any info regarding divorce which I found out from my county's court after visiting their website and calling them on doubt.

    I don't know if he could file it behind my back without informing? Is not serving the divorce papers Okay with the law? I still know nothing about the grounds and settlement issues obviously he must have not file it in my favor, He has taken over my everything, every asset, every money and every document. I am in another country with expired visa.

    I cant afford an attorney, also searching pro bono would take time but his hearing is in June.

    What are the options for me? I contacted county they said they cant give a legal advise. In that case, what can be done? At least to delay the process or something?

    Yes, I heard that they are processing cases fast now, and also completing previous cases, I am not getting the point why your case has no updates, I have no idea how organized VSC is but just a thought that Is it possible that your file has been misplaced or documents are lost? and that is why they can't say anything on your case??

    Have you tried sending emails to VSC? Did you contact senator? Did you get prima facie or any document that they have received your file? I am sorry if I am asking some stupid questions :o!! But can't you send them all the things again??

Thanks Ben, you also don't worry I am sure things will get better soon, and you Inshallah will hear a good news from VSC, I have searched pdf's documents regarding proves, I don't have all of them you said but I have managed to get one or two from every category, You did not answer me my one query and that is what do my friends and family write in their statement? They need to provide their contact details only or any identification prove? Do they need to notarize it too?

    Do I need psychiatrist evaluation or statement will be fine? I have no background criminal records, so its showing empty in my case except for the divorce thing.

    You have waited for so long, Allah does everything for valid reason.

  14. Thank you so much for your help ben, I really appreciate it! I have started gathering documentation and Inshallah soon will be submitting it, I was only concerned about divorce that as I am here, my husband can put any charge on me and I won't be able to answer.

    I don't have tapes but emails, and than how I would be able to provide police certificate of US? I am not there, neither I lived for 6 months or over.

    What does affidavit look like? what things are mention friend's and family affidavit? I do have medical reports where I was in US and also after attempting to kill, he threw me here because he was afraid of law and did not want to pay the support.

    You said I can say what I am feeling rite now, I am blank, lost, and feeling that my life is over. I really have no one in the world, I thought that I would be having family but damn whatever I had, he has taken over and I am proved to be a fool.

    Anyways, thanks for support, I will file vawa soon but my visa was expired, AOS was filed but I was expecting an interview call, I am sure he has canceled his sponsorship.

  15. seperation doesn't have to be 6 months or so but marriage and divorce should ave some time in between. And u said u rnot in US ,how come i did not understand. when did u get married and why divorce in us then

    Oh.. I was in US 3 months back, got married there in US and than my husband sent me here threateningly and fraudulently. As my marriage took place in US my divorce is filed in US by my husband but it was hidden to me til I visit my county's website.
