I was worried yesterday when I looked at my status in USCIS website because they changed the order of my greencard from july 2 to july 8, so we decided not to book any flight going to my country. We just don't know what are these immigration people are thinking unless we got the actual card. Today, I got a NOA addressed to me stating taht my permanent resident card is approved and they will send the card within 3 weeks.

  2. the only thing about it, we already submitted everything except for the polygraph and planning to schedule an infopass after 30 days coz my case is already 30 days old counting from the day we submitted it..

    tel_raider: yoiu can schedule your infopass after 30 days. coz it's already days old since you sent the last mail, so its a total of 60 days. schedule it like the between 62nd-65th day.

  3. we almost got everything that you submitted, which we already submitted..my noid is just asking for the treatment as a sex offender for the psychologist..and which we already submitted it..do i still need a polygraph test??i asked our lawyer and he said we don't need it...pls help..

    I noticed that NOID are asking for different evidences. Like Tel_raider, he was just for treatment as a sex offender and mine was asking for evidence that my husband is not threat on me and evidence that our marriage is real. So, I think, AWA filers, you just have to have your on judgement on what are the possible documents you want to provide in your NOID based on what they ask in your NOID. This is just my opinion.

    Here are the lists of evidence that we sent for our NOID (letter of Intent to Deny):

    1. A letter from my husband, describing his relationship with me, and his crime a few years ago.

    2. A letter from me, describing my relationship with him, and stating my knowledge of his crime shortly after we first met.

    3. Letters from family and friends, including:

    a. My father-in-law;

    b. My husband's step mother;

    c. My mother-in-law;

    d. My mother;

    e. My older brother;

    f. My younger sister sister-in-law;

    g. Our good friend of 4 years.

    h. Our good friend of 4 years.

    i. My husband's good friend of 4 years.

    j. My husband's good friend of 17 years.

    4. Bank statements showing that I was made a joint account holder of my husband's checking account shortly after our marriage.

    5. A bill pay summary indicating that my husband (fiance) paid for my health insurance.

    6. An insurance statement showing that my name matches the account number on the bill pay summary.

    7. Photos of my husband and I with dates and descriptions written on back.

    8. E-mails indicating our affection toward each other.

    9. A DVD of the surprise engagement party at which my husband proposed to me.

    10. The e-mails used to organize the surprise engagement.

    11. A letter from US probation officer, indicating that my husband successfully completed his 3 year probation.

    12. Polygraph test results showing no deception on 3 relevant questions from my husband. (paid $250)

    13. Letters from County Sheriff’s Office and US probation officer, indicating that my husband is not registered at the highest sex offender level.

    14. A letter from the treatment center, indicating that my husband attended treatment for 3 years.

    15. A certificate of completion of an 8-week cognitive skills course held by my probation officer.

    I know it's alot of evidence but we make sure that we provide all the evidence that we have in hand and ask help from friends and family. It's almost 10 months since we filed for my Adjustment of status and we had an interview on July 1. Look at my profile and you can read there from the start to approval of my case. I am not really familiar with K-1 application.

  6. I am not sure if I understand you correctly? You mean you are not gonna appeal the i-130 and just wait to go to your removal proceeding hearing resuled from the i-485 denial? If you don't at least appeal the i-130 first, the immigration judge at the removal proceedings will not have any ground to re-open the case because there will be no status change on the denied i-130. However if you file an appeal first for the denied i-130, then when you go to your removal proceeding hearing, you can show the judge that your spouse's peitition is being appealed therefore the judge hopefully could suspend your removal (or deportation or voluntary departure). If I have misunderstood you, please clarify. I am so sorry to hear another denial.....

    Sorry to hear that you were denied. When I heard about AWA in late 2009, I went to this site and saw your situation first. I was a little bit scared and my husband and I thought of leaving the US and live in my home country and start our lives there if worst things happen on my application. I research anything about AWA and went for infopass appointment to ask for our status coz in the uscis.gov site, it is not updated. I'm happy that we did infopass coz USCIS never stopped in reviewing our case. 60 days after we sent our NOID evidence, we received our notice for an interview. We already had our infopass appointment on the 63rd day from the time we sent our NOID evidence but we cancelled it coz we receive the Notice for an interview. We had our interview and it was really short interview, IO didn't ask anything about my husband's case, he just ask for joint accounts and that's it. We left the immigration office with lots of questions in our mind as the IO didn't say anything if we are approved or denied. This weekend and it's also holiday, no changes in my status in uscis.gov but this morning, I look it up again and it says, "ordered new card". This afternoon, i received in the mail the Notice of Action for I=130 addressed to my husband and it sayd that he is approved and is able to petition his wife. It takes us 10 months since we filed the adjustment of status.

    We had sleepless nights thinking about our application. But now, we are happy that we are approved. I hope, you won't lose hope and fight for your family to be together whatever happens. Godbless always.

    Document production or Oath Ceremony

    On July 2, 2010, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

    This step applies to applications that result in an applicant receiving a card (such as a green card) or other document (such as a naturalization certificate, refugee travel documents or advance parole). Applications will be in this step from the time the order to produce the card/document is given until the card/document is produced and mailed to the applicant. You can expect to receive your card/document within 30 days of the approval of your application.

  8. Had an interview today but IO didn't gave us definite answer if I am approved or not. The only hope we are holding are the words he said,"Everything looks fine (with a smile), just wait for 30-60 days for the decision". He didn't talk about the AWA, he just ask for our joint assets. We are hoping for the best at this time.

  9. That is the rub - everything I have read about D/S is that only an IJ can determine if you were out of status, and if you didn't go before one, you are not.

    Now granted, if you do not go to school, and get reported, as you mentioned, then the IJ would have a case to determine you violated your status, but until you get that hearing, your not out of status.

    Sorry for the late reply and thank you for the informations. I am just a little bit confused. Here is my situation: I changed my status from J1 to F1 (D/S) and was approved but I didn't went to school for personal reason. I called the school before I need to start school and the counselor said, it's fine and they will refund my tuition coz i told them the reason why I can't go to school and they understand it. I don't have any idea if they report me or not. S that counted as out of status? or i need to ask the school if they report me or not? A year after that (July 2009), I got married and applied for AOS, got my EAD and AP but not greencard. I am still waiting for my GC.

    I talked to one of the VJ member who's wife overstayed here in the US on a J1 visa. Applied for AOS and got her EAD and AP and travelled to Ukraine with just AP. He said that they don't have any problems in the POE, IO just get his wife's passport and AP and gave another I-94 and stamped it with Parolled in the US.

    Any opinions? I would really appreciate it. Thank you

  10. You involve a congressman if the case is past the regular adjudication time - I don't know what that time is for AOS - 6 months? If nothing happens with your AOS you contact your congressman to look into the case for you.

    Check with school to see if you were reported or not. Any absence longer than couple of weeks is reported. This may affect your case if AOS is still not adjudicated and you're using AP after a long out-of-status period. Definitely check this all with infopass.

    I went for an infopass appointment today and the guy there said that I am fine to travel. He just took my advance parole, check it online and he said, i'm good to travel coz in POE, what they usually do is just look on their system if I really have a pending case. He also said that if i am not allowed to travel, USCIS won't approved my AP.. What do you think? ANy ideas?

  11. I had my EAD renewed while my AOS was pending. I pretty sure you can renew yours too. My question is "Have you ever been denied on your AOS before and re-opened your case after that or not." Since I was dennied for my I-485 and I-130 application under AWA and my EAD will be expired in September too. I sent in "Motion to re-open and re-consideration" in March. Do I qualified to renew my EAD under this situation?

    I never been denied on my AOS. In the infopass that we went to last january, the guy that we talk to said that my I-485 is fine, the only problem is my I-130 and that's the reason why I received NOID in the mail and fortunately, we provide the documents that we gather on time.. Now, we are just waiting.

  13. Definitely make an Infopass - your AP says it's good through Feb 2010 and it's now end of April 2010. Since your AOS is still pending, you should be entitled to free renewals of EAD and AP (at least that was the reasoning they gave to public when they enacted fee increase in July 2007).

    You also may have a problem if you were on F1 visa but didn't go to school before you AOSed. Reason being that schools regularly alert USCIS of any students who are not compliant with SEVIS rules (school attendance). If you were reported, your out-of-status days started accruing until you sent in AOS. Since AOS is still pending, you really don't have a real status just yet and may be turned back at POE.

    I am sorry, my AP is from feb 2010 to Feb 2011.

  14. you;re ok to travel w/that since it's still valid and it's excatly what you need since you don't have your gc yet. what happens is when you come back, you show that at airline check-in counter, instead of your visa, and then at the poe, they will check if you really have a pending aos, that's all. :)

    Thank you for the information. Your AOS was approved while you are in the Philippines or here in the US? If it was approved when you are already here in the US, it means, you only use your AP and passport at the port of entry, right? I am a little bit scared too because, I was in an F1 visa before I got married but I didn't went to school for some reason but in my AOS application status, I put F1 because my F1 has D/S (duration of status), no specific expiration and I think, it is fine because I received my EAD and AP without any question.. Any idea?

    I just wanna know about the use of Advance parole. I got my Advance Parole last feb 2009 and it is valid till feb 2010. My AOS is still pending and I don't know when will be the result of it as my husband is an AWA petitioner. My question is, what do immigration people do in the port of departure and port of entry when you just have an advance parole? Is there any possibility that someone may be barred from entering the US even with Advance Parole? Me and my husband and my husband's family are planning to go to my home country to visit for the holidays but i am just scared that I may not be able to enter the US. Any opinions or suggestions will highly appreaciated.

  16. You can renew your EAD and just send them a copy of your I767 for your I485.My AWA petitions had been pending for three years and each year I got my EAD.

  17. That is right about EAD. Biy Drivers License...

    That really depends on a state. SOme states, like mine (Minnesota), put exporetion date for every visa holder with the same date visa expires, and if DL expires and you don't have new visa or Green Card DMV doesn't renew DL. They can't do it on pending petition. Like they told me, they have to put an exporetion date for all non sitizen, without it application can't be completed.

    But our naibor state (Wisconsin) doesn't have this ... yet? But they ask to bring with application 3 proofs of rezidense.

    Please let us know about your EAD and DL. DL is a very painful subject for me and if there is a way to get it, I really need it, cos all this time I drive without it...

    Same here in Georgia. They just put the expiration date on my DL according to expiration date of my EAD. Unlike in my friend's state of residence, Illinois, she still didn't file any of her paperworks at USCIS but she got her DL with just a marriage certificate, marriage license and proof of residence. She got a 5-year DL.
