  1. Thanks to all for the information. I will definitely make sure we have her Permanent Resident card when we travel.

    I will also bring a copy of our marriage certificate but does it need to be a "Certified" copy or can it be a copy of a certified copy?

    Will other documents besides our marriage certificate (or copies)be needed? If so what other supporting documents regarding her legal married name change should we bring?

  2. Hello, my wife is from the Philippines and she has a Philippino passport in her maiden last name.

    We have been married for a few years and went through the process of obtaining her Permanent Resident card which is in her married last name.

    Her drivers license is also in her married last name.

    We are planning to visit her family in the Philippines in a few months. We already booked the tickets for the trip and were told by the airlines

    to book my wife's ticket in the exact same name as it appears on her passport (maiden last name).

    Since her passport is in a different last name than her Permanent Resident card and drivers license, will there be a problem with Customs when we travel? Should we bring a copy of our marriage certificate to the airlines? Is there some other form or document we need to bring?

    On a side note... I assume we NEED to bring her Permanent Resident card for travel, is that correct? If we have to bring it that's fine, I was just concerned that it might get lost or stolen during the trip.

  3. I apologize if I am posting in the wrong forum so mods please move if necessary.

    Here is my situation that I hope someone can help me with.

    I am an American citizen and I married my wife who is from the Philippines. We are going through the

    immigration process. We have recently filed our I-751 (Petition for removal of conditions) and awaiting her

    permanent resident card. She will file for citizenship when applicable.

    We are having difficulty conceiving a child and my wife is very family orientated. She would like to bring over her

    nephew who is 7 years old and was born and lives in the Philippines with his mom, dad,and 2 sisters.

    My wife's sister and brother-in-law are very poor and are agreeable to having their son live with us in hopes of him having a better life.

    So my question is: What are some ways that my wife and I can bring over her nephew and have him live with us? We would need him to be able to go to school here and be covered under our health insurance. I'm not too comfortable with adoption at this point but would prefer to

    become a legal guardian or "sponsor" if possible.

    Has anyone gone through or going through a similar situation?

    Can anyone provide me with some guidance?

    We are going to Canada for 9 days (4 working days because of Memorial weekend) so we hope that the interview, if there is one, will not be scheduled for that week. It would be totally unlucky to be called for an interview on that week, but it may happen, and we would have to cancel our plans and lose some deposit money. So if chances of an interview are low, we will go ahead with our plans.

    "Another question, do I need to have my passport stamped? Can I do it at the biometrics office?"

    My wife just had her biometrics done a few days ago and I asked the immigration "person" if my wife can get her passport stamped. I was told no and that the letter she received confirming the receipt of the submitted I-751 should be used when travelling overseas. YMMV though.

  5. I'm getting all my papers together to send out with my I-751 forms and I wanted to know......

    Do I need to give them a certified copy of our marriage certificate, or can I just photo copy it?

    I have both, so it's no big deal. I made sure I got 2 certified copies when I sent everything out for my AOS 2 years ago. Better to have it and not need it then to need it and not have it.

    I didn't send a copy of our marriage license with our I-751. It wasn't listed in the instructions to do so.

    I believe immigration understands that you are married and the I-751 is for proof that

    you are still living a married life together.

    I hope my information is correct so maybe someone else can chime in to confirm this.

  6. If you use a personal check make sure it has your name and address PRE-printed on the check otherwise they will consider it a starter check which will be refused. I have a checking account but did not have my name and address printed on the checks because my addess was going to be temporary and I did not want to have to order new checks to reflect the new address. So I called USCIS to ask if my personal check would be accepted if my name and address

    were hand written on the check (upper left hand side) and they said no.

    I'm sending in our I-751 application in today and just purchased a USPS money order.

  7. You could simply check the "NO" box(es).

    That seems reasonable but the questions before the YES and NO boxes implies that there IS a diabilityand its asking if the applicant is requesting accomodations because of the diability.

    The section states to read the insructions on how to complete this section but there are no instructions.

    I definitely do not want to get this application sent back for a section of the form that doesn't even apply to us.

    I am completing the I-751 form and have come across a question I hope someone can answer.

    On Part 6: "Accomodations for Individuals with Diabilities and Impairments" it states to "Read the information in the instructions before completing this section".

    Well I read the instructions and there is not any information on how to complete this section.

    This section does not even apply to our circumstance so my question is do I just write an "N/A" after:

    Part 6: "Accomodations for Individuals with Diabilities and Impairments"

    or do I check the three "NO" boxes.

    I have everything else ready to send tomorrow to the VSC and just need this section to complete the I-751 form.

    Can anyone make this clear?

  9. Forgot to mention that I'd like to mail it in a medium sized Priority Mail Flat Rate Box because it is rigid and would protect the package better in the mail transit compared to the pliable Priority mailing envelope.

    I know this seems like a trivial question to ask but will it be o.k. to mail it in a larger, sturdier box such as the Priority Mail Flat Rate Box?

  10. Hello all,

    I contacted the USCIS 3 times and cannot get a definite answer on this. I need to send our I-751 to the Vermont Service Center and plan on sending it with U.S. Postal Service Priority Mail with Certified and a return receipt. This means that someone will need to sign the return receipt to accept

    the package.

    Is sending the I 751 this way common or should I just send it Priority Mail with Delivery Confirmation to avoid any mailing hassle?

    I do not want to have our I-751 returned because no one at the VSC is available to sign for the return receipt.

    How did you all send in the I-751?

  11. USPS has been around for many many years. They know what to do! I am also sure that VSC always receives over sized packages due to the demands they make for ROC so I wouldn't worry about it. By the way, make sure you get a delivery confirmation with your package. Not sure if you just forgot to mention that or you were not planning on it.

    I forgot to mention that I'd like to send the Priority package with a return receipt but don't know if someone at VSC will sign for it if my package is sent to the P.O. box. Should I just get Delivery Confirmation and forget about the Return Receipt?

  12. Since it is a POBox, then it is best if you send it with USPS. Everyone uses it and it gets delivered just fine.

    I planned on sending in our I 751 in a medium flat rate Priority Mail box. But if it will be delivered to a P.O. Box I don't think it will fit and the postal clerk will have to place a notice in the P.O. Box. Will someone from the Vermont Service Center still get the oversized package or should I try and send our I 751

    in a flexible packaging so it would fit in the P.O. Box? I wanted to send it in the medium sized flat rate Priority box in order to keep our packet from getting wrinkled, folded, damaged, etc.

  13. Personal check so that you can verify that they cashed it.

    Our personal checks do not have our names and address pre printed on the upper left hand side. I'm concerned that it will not be accepted

    because it appears that the check could be a "starter" check. I've had an organization refuse our check before because of that.

    I don't know why that would make any difference but I don't want to take the chance. I guess I'll just send a certified bank check

    and hope for the best.

    Thanks for the information on how to obtain the transcripts. I do have a question though....

    It will take some time before I receive the transcripts and the 90 days before my wife's conditional greencard expires starts on Feb. 15th. (expires May 13th)

    If I don't receive the transcripts before the 15th is it o.k. to wait for the transcripts and then send in the I-751? In other words... Is it alright

    to send the I-751 within 80 or 85 days of the conditional greencard expiration or must it be 90 days?

    I'd also like to get our 2009 taxes completed but still waiting for a couple of 1099s to arrive.

    I'm just about ready to submit our I-751 to the Vermont Service Center. What is the best way to send it with the U.S.P.S.? Certified, Priority, Registered?

    If sending Certified with return receipt will someone at the VSC sign for it or will the I-751 be sent back to me because a signature cannot be obtained?

    What happens if the package arrives on Saturday and there is no one there to sign for it; will it be delivered on Monday?

    I know these sound like silly questions but we all know how important it is for the I-751 to arrive without a problem.

  16. THanks for all the responses. It appears highlighting is o.k. then. I'm glad I don't have to redo any copying.

    One other thing though; On the financial documents, is it recommended to blacken out the account number ,or leave it visible?

    I understand leaving the dollar amounts will help the investigator to have an idea of how much money my wife and I have

    together but leaving the account number visible leaves us open to any unscrupulous person who has all of that sensitive information.

    I'm already a victim of identity theft and I'm just overly cautious now. I realize gaining permanent residence for my wife is a priority

    and do not want to jeopardize in any way the success of permanent residency approval, so I definitely will leave our account number visible

    if helpful.

    Any thoughts?

  17. Hello all, I know this may be a silly question but I'd like to ask it anyway.

    Is it O.K. to use a yellow highlighter to highlight my wife's and I names and address on our evidence documents and statements?

    So far we complied the following documents for our I-751:

    2008 tax return. (If we can get our 2009 taxes prepared we will include them also)

    Lease renewal agreements

    Credit card account statements for each month since the conditional greencard was granted (May 15, 2008)

    Phone, Cable, and Electricity statements for month since Jan. 2009 (Cannot access prior statements)

    Investment accounts (2) Yearly statements

    Checking account statement

    Beneficiary form from my wife's employment stating that I am the beneficiary.

    Beneficiary form from my wife's newly acquired Roth IRA account stating that I am the beneficiary.

    Vehicle title showing joint ownership from car purchased after conditional greencard was approved.

    Auto Insurance Declarations for last 2 years showing both names covered

    Copies of plane tickets, flight details, Vacation passes such as Universal Orlando

    Pictures associated with vacations, friends, and family.

    On each of those document and statements have our names and address on them of course. I thought it would help the USCIS investigator/reviewer

    if our names and address were highlighted just to make it easier for him or her to locate it on the documents/statements.

    Has anyone else done this and if so was there any problem with highlighting? Is it recommended to highlight?

    Is there any negative or positive associations with highlighting?
