  1. Sorry didn't know about setting the whole timeline/details thing. But I live in Northern Virginia (10 minutes outside of Washington DC).

    I thought the N-400 was supposed to be MAILED to a Service Center (in my case, the Vermont Service Center) for processing. Am I wrong?

    You mail it to the service center that has jurisdiction, but the case is adjudicated and researched by local office much like AOS, so you look at your filed office for processing times because the different field offices operate at different speeds depending on their workload.

    If you had Washington listed in your profile, I would have just sent you specific data instead of just pointing at USCIS overall processing times page.

    N-400 is processed by your local office not service centers, you just looked in the wrong place.

  3. This maybe a dumb question but when I review the instructions for the N-400 (Naturalization) it doesn't definitively state where to send you application. WHERE do file/send your N-400?

    It clearly states where to file if you're filing under the military provisions (Nebraska Service Center). I'm assuming I would file at the same Service Center I filed my wife's I-751 (Vermont Service Center).

    I live Northern Virginia (Greater Washington DC Metropolitan area) and filed her I-751 (Removal of Conditions) with the Vermont Service Center.

    My wife will be eligible to file the N-400 in Jan 2008 (3 year anniversary from "Resident Since" on her green card) and I'm trying to prepare well ahead. Your feedback is appreciated.

  4. My wife is a conditional resident alien and we have not applied to remove the conditions. She has held her conditional green card for about a year. I'm comtemplating divorce because of likely infidelity on her part (but maybe hard to prove). What complicates matters is that we have a child together that was born in the US.

    I realize that if I terminate our marriage via divorce she can apply for a waiver to gain permanent resident status but I'm not sure she will. She has told me that she wants to go back to her native country (Argentina) but she will take my son.

    My question is if I file for divorce, do I have to inform USCIS right away or wait until divorce proceedings are final? Also, in cases where a child is involved who is a US citizen, can she legally take my son or is that a matter for the family courts to decide during the divorce?
